ENG CONTINUATION OF LOCAL DECLARATION OF EMERGENCY AND REQUEST FOR ADDITIONAL APPROPRIATION FOR BUENA VISTA SEWER LINE SPILL DEPT. HEAD' CITY ATTY. CITY MGR. *rf«3" ^5/x/- RECOMMENDED ACTION: Adopt Resolution No. 2007-092 declaring a continued state of local emergency and appropriating additional funds in the amount of $250,000 for the repair of a ruptured sewer force main at Buena Vista Lagoon. ITEM EXPLANATION: The Vista/Carlsbad Interceptor (Reach 4) is a joint facility owned by the City of Vista and the City of Carlsbad. Ownership of the interceptor is 89.6% and 10.4%, respectively, based on the "Agreement for Ownership, Operation, and Maintenance of the Vista/Carlsbad Interceptor Sewer" ("Agreement"), which Vista and Carlsbad entered into on February 26, 2002. On Sunday, April 2, 2007, at approximately 7 pm, the portion of the line running along Buena Vista Lagoon was determined to be broken and leaking raw sewage into the lagoon. Due to the location of the break along the shore of the lagoon, it was necessary to hire a contractor and build shoring around the location of the leak prior to excavating the pipe and beginning the repair. The leak resulted in an estimated seven million three hundred thousand gallons of sewage being spilled into Buena Vista Lagoon, a State of California Ecological Reserve. Staff has been compiling costs associated with the spill and recovery efforts, both to provide an accounting of the actual costs for the recovery, and to ensure there are sufficient funds available to pay vendors. Although this line is 89.6% owned by the City of Vista, City of Carlsbad staff were the initial first responders, and called out many of the resources necessary to repair the pipeline and conduct monitoring of the lagoon during and after the spill event. Because of this, the City of Carlsbad has agreed with the City of Vista to pay the contractors we called out, and submit invoices to Vista for repayment. Due to the nature of the construction efforts associated with the repair of the force main, it was determined to be necessary to declare a local state of emergency. It is necessary to continue the emergency declaration for at least two more weeks to ensure work associated with the repair and monitoring can be completed. The declaration of emergency will be reviewed by staff, and a recommendation to continue or end the declaration will be made in two weeks. ENVIRONMENTAL IMPACT: This repair is Categorically Exempt from CEQA review under section 15301 of the CEQA Guidelines- repair of an existing facility. By agreement, the City of Vista owns 89.6% of the reach and, therefore, would be responsible for the majority of the costs of this repair. Carlsbad owns 10.4% of this reach. Carlsbad and Vista will share the costs of the repair, monitoring, mitigation, and other expenses in the proportion of their ownership of the reach. On April 10, 2007, City Council appropriated $500,000 from the Sewer Capital Replacement fund to pay for this repair. Based on current anticipated expenses, staff is requesting an additional $250,000 appropriation from this fund to pay for the repair. Actual costs are anticipated to be less than $600,000, with the additional funds making up contingency in the event of unforeseen events. While the construction work at the spill site is complete, the mitigation and monitoring efforts continue. These additional funds will provide for sufficient cash flow to complete the recovery efforts. The table below shows estimates of anticipated expenses. DEPARTMENT CONTACT: Mark Stone, (760) 438-2722, x 7105, mston@ci.carlsbad.ca.us 1 RESOLUTION NO. 2007-092 15 16 17 18 19 26 27 28 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, DECLARING AN EMERGENCY AND APPROPRIATING AN ADDITIONAL $250,000 FROM THE 4 SEWER CAPITAL REPLACEMENT FUND TO PAY FOR THE EMERGENCY REPAIR TO THE VISTA CARLSBAD SEWER 5 REACH 4 AT BUENA VISTA LAGOON. 6 WHEREAS, on April 1, 2007, a break was detected in the Vista-Carlsbad Sewer 7 Reach 4 at the Buena Vista Lagoon; and WHEREAS, it was necessary to mobilize City staff and contractors to facilitate the necessary repairs; and WHEREAS, this emergency did not permit the delay that would result from competitive solicitation of bids and this action was necessary to respond to the emergency; and WHEREAS, although the broken sewer line has been repaired, current estimates are 12 that the cost of the repair and mitigation and monitoring efforts will require up to $750,000; and 13 WHEREAS, on April 10, 2007, the City Council declared an emergency and 14 appropriated $500,000 for the repair efforts. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. There is a need to continue the state of local emergency declared on April 10, 2007 by adoption of resolution 2007-076, which need includes monitoring and mitigation efforts at the site of the sewer main break. 3. Said emergency continues to exist until declared abated by order of the City Manager and City Council. 22 4. That the City Manager is hereby authorized to have repaired the sewer line. 23 5. The need for this continuing emergency shall be reviewed within fourteen (14) 24 days in accordance with state law. 25 6.
