(|^— ^~ RECOMMENDED ACTION: Adopt Resolution No. 2007-095 to approve and authorize Amendment No. 1 to the architectural services agreement with RRM Design Group, for site planning of a Police / Fire Training Center and Public Works Center, Project No. 3686. ITEM EXPLANATION: On September 28, 2004, the City entered into an agreement with RRM Design Group in the amount of $54,910 to perform programming to develop pertinent information to locate a Public Works Center and a Police and Fire Department Training Center. This work was completed in 2005. On January 2, 2007, the City entered into another agreement with RRM Design Group in an amount not-to-exceed $97,949 to develop a site plan and floor plan for construction of a Police Training Facility including a shooting range, a Fire Training Facility including a training tower, and provide space for a Public Works Center which would all be located at the City's Safety Center site located along Orion Street just north of Faraday Avenue. Amendment No. 1 in an amount not-to-exceed $10,000 is to have the architect develop additional "Site Arrangement Diagrams" to be used by staff in assessing the best and most creative arrangement of the facilities on the site. ENVIRONMENTAL IMPACT: The planning phase of the project is statutorily exempt from the requirements of the California Environmental Quality Act (CEQA) per Section 15262, Feasibility and Planning Studies, of the State CEQA Guidelines and will not have any adverse significant impact on the environment. The project will be subject to CEQA upon the selection of the site arrangement and a CEQA document and Notice of Determination will be processed and filed prior to adoption of the project's plan and advertisement for construction. FISCAL IMPACT: The planning phase study expenses are summarized in the table below. Sufficient funds are available for completion of the site planning phase. An engineer's cost estimate for construction will be completed as part of this phase and any necessary revisions to the project budget, including additional appropriation for construction costs, will be incorporated as part of the FY 2007-08 CIP under a future agenda bill. PROJECT NO. 3686. 5 WHEREAS, a professional architectural services agreement was executed on January 2, 6 2007 between the City of Carlsbad and RRM Design Group to provide site planning services for a 7 Police / Fire Training Center and Public Works Center; Project No. 3686; and 8 WHEREAS, it is necessary to increase the architectural services budget by $10,000 with 9 RRM Design Group for Project No. 3686; and 10 WHEREAS, the City Council of the City of Carlsbad, California, has determined it necessary and in the public interest for the City of Carlsbad to enter into Amendment No. 1 with 12 RRM Design Group for Site Planning of a Police / Fire Training Center and Public Works Center, 13 Project No. 3686, in an amount not-to-exceed $1 0,000; and 14 WHEREAS, $950,000 in General Capital Construction funds have been appropriated in 15 the Capital Improvement Program for Project No. 3686; sufficient to fund this Amendment No. 1. 16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 17 California, as follows: 18 1 . WOOD, City Clerk (SEAL) AMENDMENT NO.1 TO AGREEMENT FOR ARCHITECTURAL SERVICES (RRM DESIGN GROUP) This Amendment No.1 is entered into and effective as of the / _ day of 2007, amending the agreement dated January 2, 2007 (the "Agreement ) by and between the City of Carlsbad, a municipal corporation, ("City"), and RRM DESIGN GROUP, ("Contractor") (collectively, the "Parties") for Site Planning Public Works Center, Police Shooting Range, and Fire Training Center. RECITALS A. The Parties desire to alter the Agreement's scope of work to develop and provide alternative site plans; and D. The Parties have negotiated and agreed to a supplemental scope of work and fee schedule, which is attached to and incorporated by this reference as Exhibit "A", Scope of Services and Fee. NOW, THEREFORE, in consideration of these recitals and the mutual covenants contained herein, City and Contractor agree as follows: 1. In addition to those services contained in the Agreement, as may have been amended from time to time, Contractor will provide those services described in Exhibit "A". 2. City will pay Contractor for all work associated with those services described in Exhibit "A" on a time and materials basis not-to-exceed ten thousand dollars ($10,000). Contractor will provide City, on a monthly basis, copies of invoices sufficiently detailed to include hours performed, hourly rates, and related activities and costs for approval by City. 3. Contractor will complete all work described in Exhibit "A" by August 31, 2007. 4. All other provisions of the Agreement, as may have been amended from time to time, will remain in full force and effect. 5. All requisite insurance policies to be maintained by Contractor pursuant to the Agreement, as may have been amended from time to time, will include coverage for this Amendment.
