RECOMMENDED ACTION:
Approval of Resolution No. 2007-107 accepting the Stipulations with Award authorizing the
payment of $27,370.00 to Judy E. Blackburn
ITEM EXPLANATION:
The claimant was a Senior Planner with the City of Carlsbad. She was employed by the City of
Carlsbad for approximately twelve years prior to sustaining injuries to her right shoulder, left shoulder
and left thumb due to constant use of the computer.
The terms and conditions of the proposed settlement are set forth in the Stipulations with Award (on
file in the Human Resources Department). The terms and conditions were agreed upon by the claimant
and the City and have been approved by TRISTAR, the City's Third Party Administrator, and the
Workers' Compensation Appeals Board.
FISCAL IMPACT:
The cost of the settlement is $27,370.00. There are sufficient funds available in the Workers'
Compensation Self-Insurance Fund to cover the cost of this settlement.

1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
2 CARLSBAD, CALIFORNIA, AUTHORIZING THE EXPENDITURE OF
FUNDS FOR SETTLEMENT OF THE WORKERS' COMPENSATION
3 CLAIM OF JUDY E. BLACKBURN.

WHEREAS, TRISTAR, the City's Third Party Administrator, has recommended a
6 settlement of the Workers' Compensation claim of Judy E. Blackburn; and
' WHEREAS, the settlement has been approved by the Workers' Compensation
o
Appeals Board; and

WHEREAS, there are sufficient funds available in the Workers' Compensation
10
Self-Insurance Fund to pay the settlement.
12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
13 California, as follows:
1. That the above recitations are true and correct.
15 2. That the expenditure of $27,370.00 from the Workers' Compensation Self-

Insurance Fund is authorized for the settlement of said claim.
