ENG ACCEPTING BIDS AND AWARDING A CONTRACT FOR CONSTRUCTION OF FIRE STATION NO. 6 PROJECT NO. 3901 DEPT. HEAD /n r JKT:/KCITY ATTY. \gg&* CITY MGR. 4^> r RECOMMENDED ACTION: Adopt Resolution No. 2007-110 accepting bids and awarding a contract for the construction of Fire Station No. 6, Project No. 3901. ITEM EXPLANATION: In the late 1980s, the City identified a fire facility shortfall in the La Costa area. Shortly thereafter, the City acquired a 0.5 acre site adjacent to Rancho Santa Fe Road for the sole purpose of building a fire station to address the shortfall. However, because of the pending realignment of Rancho Santa Fe Road at that time, and uncertainties regarding road elevations, the City chose to build a temporary fire station on Levante Street in La Costa and operate it until the realignment of Rancho Santa Fe Road was complete. Now that the road project is complete, the City is able to construct the permanent fire station. Proposed Fire Station No. 6 will be located approximately 300-feet west of new Rancho Santa Fe Road and approximately 1-mile north of the Rancho Santa Fe Road and La Costa Avenue intersection. The site is surrounded by open space with the nearest existing residences being approximately 1/4 mile to the south; homes in the planned La Costa Oaks North development will be approximately 200-feet to the north when constructed. Access to Fire Station No. 6 will be from a newly-constructed driveway connecting to Rancho Santa Fe Road. Fire Station No. 6 will be two stories high and approximately 6,200 square feet in size with two apparatus bays. The station will be operated by a three-person crew with dormitory accommodations for a crew of four. The building features include concrete roof tiles, stone veneer accents, and exterior colors that blend well with the surrounding natural environment and nearby residences. Other significant elements of the project include the extension of water, sewer, and dry utilities to the site, installation of a traffic signal on Rancho Santa Fe Road to serve the fire station driveway, and the demolition of the temporary fire station on Levante Street. On March 29, 2007, the City received seven (7) sealed bids for the construction of Fire Station No. 6, which are summarized in Table 1. COUNCIL ACTION: APPROVED H' CONTINUED TO DATE SPECIFIC DENIED D CONTINUED TO DATE UNKNOWN CONTINUED D RETURNED TO STAFF WITHDRAWN D OTHER - SEE MINUTES AMENDED D n D D D Page 2 In addition to the Base Bid shown in Table 1, each bidder was required to provide an alternate bid for the construction of a temporary sewer pump station and forcemain that may be required in the event that the future gravity sewer being constructed by the La Costa Oaks North subdivision is not complete and available for the Fire Station No. 6 project. The "Instructions to Bidders" specifies that the bidders must provide a cost for the alternate bid item and that the award of the contract will be based on the base bid amount only, regardless of whether the City chooses to accept the alternate bid item. Staff has reviewed the bids and found that the apparent low bid submitted by ST. Baggett, Inc., was non-responsive because of their failure to provide a cost for the alternate bid item as required and stated in the "Instructions to Bidders". Subsequently, staff has completed their review of the bid documents submitted by the 2 low bidder, Edge Development, and found them to be in order. Additionally, Edge Development provided a cost for the alternate bid item to construct the temporary sewer pump station and forcemain in the amount of $114,430. At this time, the gravity sewer is not yet constructed and available for Fire Station No. 6 to connect into. Therefore, staff recommends that the Council accept the alternate bid item and that the Council award the contract for the construction of Fire Station No. 6 to Edge Development in the amount of $4,118,437, which is the total of the base bid and alternate bid item. The architect's estimate for the combined base bid and alternate bid item for the construction of the project was $4,130,000. ENVIRONMENTAL IMPACT: On September 26, 2006, the City Council adopted Resolution No. 2006-288 approving a Mitigated Negative Declaration and Mitigation Monitoring and Reporting Program for Fire Station No. 6, finding the project to be in conformance with the requirements of the California Environmental Quality Act. Environmental mitigation requirements established for the project and approved by the U.S. Fish & Wildlife Service will be satisfied at the City's Lake Calavera Mitigation Bank and by creation of 0.31 acre of coastal sage scrub adjacent to the project. A separate public works contract for habitat creation and 5 years of maintenance and monitoring will be bid later in 2007. FISCAL IMPACT: The estimated project costs for the Fire Station No. 6 project are shown below in Table 2. Currently, there are insufficient funds available in the project account as budgeted and appropriated through the Capital Improvement Program process of prior years. It is estimated that additional funds in the amount of $430,000 from the Public Facilities Fees (PFF) fund will be needed to complete the project. Sufficient monies are currently available in the PFF fund; however, this additional appropriation may affect appropriations to other projects in future years. The budget amount for construction was established in early 2005 with the expectation that the project would be bid in FY 2005-2006. As a result, the additional funding needed to offset construction cost inflation for the current fiscal year was not appropriated and Council was informed by staff at the December 5, 2006 Council meeting that an additional appropriation may be needed. PROJECT NO. 3901. 4 WHEREAS, the City Council of the City of Carlsbad, California, has determined it 5 necessary, desirable, and in the public interest to construct Fire Station No. 6, Project No. 3901; 6 and 7 WHEREAS, the fire station is necessary to comply with the City's Growth Management 8 Plan; and g WHEREAS, on December 5, 2006, through Resolution No. 2006-354, the City Council of the City of Carlsbad approved the plans and specifications and authorized the advertisement for bids for the construction of Fire Station No. 6, Project No. 3901; and 11 WHEREAS, seven (7) sealed bids were received on March 29, 2007 by the City of 12 Carlsbad for the construction of Fire Station No. 6, Project No. 3901; and 13 WHEREAS, the lowest responsive, responsible base bid for the project was submitted 14 by Edge Development, in the amount of $4,004,007; and 15 WHEREAS, staff recommends that Council accept the alternate bid submitted by 16 Edge Development for the construction of a temporary sewer pump station and forcemain in the amount of $114,430; and 17 WHEREAS, the total of the base bid and alternate bid item submitted by 18 Edge Development is $4,118,437; and 19 WHEREAS, funding for said project has been appropriated from the Public Facilities 20 Fees (PFF) fund in the 2006/2007 Capital Improvement Program in the amount of $5,400,000; and 21 WHEREAS, there are currently insufficient funds available to complete the project as 22 estimated at $5,830,000 and additional funds in the amount of $430,000 are requested; and WHEREAS, subsection 3.28.040(C)(6) of the Carlsbad Municipal Code authorizes the <£W City Manager to approve change orders in the amount equal to the contingency set at the time of 24 award; and WHEREAS, a Mitigated Negative Declaration has been adopted by the City Council by 26 Resolution No. 2006-288, dated September 26, 2006, as required by the California Environmental 27 Quality Act. 5 1 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 2 California, as follows: 3 1. That the above recitations are true and correct. 4 2. That the total of the base bid and alternate bid in the amount of $4,118,437 submitted by Edge Development, for the construction of Fire Station No. 6, Project No. 3901, is 6 accepted and the Mayor is hereby authorized to execute a contract with Edge Development. 3. That the City Manager is hereby authorized to approve construction change 8 orders up to $412,000 for Project No. 3901. 4. That the award of this contract is contingent upon Edge Development executing 10 the required contract and submitting the required bonds and insurance policies, as described in 11 the contract, within twenty (20) days of adoption of the resolution with the understanding that the 12 City Manager may grant reasonable extensions of time. 13 5.
