ENG SUMMARILY VACATE A PORTION OF OLD RANCHO SANTA FE ROAD AND RESERVE A GENERAL UTILITY AND ACCESS EASEMENT (STV 07-01) DEPT. HEAD CITY ATTY. CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. 2007-120 summarily vacating a portion of old Rancho Santa Fe Road and reserving a general utility and access easement (STV 07-01), all within Lot 199, Map 14379, CT 99-04-01. ITEM EXPLANATION: As a condition of approval of CUP 05-13, Fire Station No. 6 is required to vacate a portion of old Rancho Santa Fe Road directly adjacent to the fire station site. Condition No. 33 of the Conditional Use Permit for Fire Station No. 6 requires that prior to building permit issuance, the portion of old Rancho Santa Fe Road directly adjacent to the fire station site be vacated and a public utility easement be granted for the maintenance and access of existing utilities within the old road right-of-way. With the recent relocation and widening of Rancho Santa Fe Road North to the east, the portion of old Rancho Santa Fe Road within Lot 199, Map 14379, CT 99-04-01, is no longer needed for road right-of-way. The portion of old Rancho Santa Fe Road adjacent to the site for Fire Station No. 6 is located within the section of road in Lot 199, Map 14379, CT 99-04-01. Staff recommends vacating the portion of old Rancho Santa Fe Road within Lot 199 and reserve a general utility and access easement over the westerly 30 feet of the old road alignment from the south portion of Lot 199 to the south edge of the old road adjacent to the Fire Station No. 6 site. The general utility and access easement would then widen to encompass the full road right-of-way to the northerly property line of Lot 199. This action will satisfy Condition No. 33 of CUP 05-13, as well as provide "clean up" of unneeded road right-of-way. The utility companies have been notified and no objections have been received. The Street Vacation Resolution specifies that a thirty (30) foot wide portion along the westerly side of the area being vacated be reserved as a general utility and access easement. ENVIRONMENTAL IMPACT: This activity is exempt from California Environmental Quality Act (CEQA) review per CEQA Section 15061(b)3. That the above recitations are true and correct. 18 2. That pursuant to Division 9, Part 3, Chapter 4 of the California Street and 19 Highways Code, said portion of the old Rancho Santa Fe Road North alignment more particularly 20 described in Exhibit A, and shown for sake of clarity in Exhibit B, be summarily vacated. 21 3. That the general utility and access easement more particularly described in 22 Exhibit A, and shown for sake of clarity in Exhibit B, be reserved and excepted from the vacation. 23 4. Easements and rights necessary to maintain, operate, replace, remove, or renew 24 in-place public utility facilities are reserved and excepted from the vacation. 25 5. The City Clerk is directed to record this resolution in the Office of the County Recorder of San Diego County.26 6.
