HEAD RT.T CITYATTY. <£^' CITY MGR. <~O)Ov^JT RECOMMENDED ACTION: Introduce Ordinance No.NS-843 to require a stop on El Fuerte Street at its intersection with Unicornio Street and to require a stop on El Fuerte Street at its intersection with Chorlito Street. ITEM EXPLANATION: At their meeting on May 8, 2007, the City Council determined that stop control shall be placed on El Fuerte Street at the intersection of Unicornio Street and at the Chorlito Street intersection. Unicornio Street is a four-leg intersection and Chorlito Street is a three-leg intersection. Both Unicornio Street and Chorlito Street are stop controlled where they intersect El Fuerte Street. ENVIRONMENTAL IMPACT: The installation of an official traffic control device is a project that is a Class 1 categorical exemption (minor alteration of existing structure or facility) and is, therefore, exempt from the environmental review process under the provisions of the California Environmental Quality Act (CEQA), Section 15301(c). FISCAL IMPACT: For the two intersections, the estimated cost for installing stop signs, stop ahead signs, pavement legends, and crosswalks or limit lines will be about $3,000. EXHIBITS: 1. Drivers shall stop where the following described street intersects Unicornio Street: El Fuerte Street." SECTION 2: That Title 10, Chapter 10.28 of the Carlsbad Municipal Code is amended 12 by the addition of Section 10.28.890 to read as follows: 13 "10.28.890 Chorlito Street. Drivers shall stop where the following described street intersects Chorlito Street: 14 El Fuerte Street." 15 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption; and 16 as to Chorlito Street, shall be effective thirty (30) days after its adoption, or upon removal of the 17 vegetation to the satisfaction of the City Engineer, whichever is later. Lisa, the vegetation to be removed is from the back of sidewalk to a point 4.5 feet behind the sidewalk (which is where the right of way line is located) and for a distance of 130 feet from Chorlito extending north. However, this trimming location and amount removed was not as requested by staff and does not achieve the corner sight distance that would be provided if he will remove the vegetation that is growing from his property into the public right of way. Trimming as requested by staff will improve corner sight distance. AGENDA ITEM #___£_ c: Mayor City Council City Manager City Attorney City Clerk AGENDA ITEM # £L c: Mayor The Honorable Mayor Lewis City Council May 22,2007 City of Carlsbad City Manager 1200 Carlsbad Village Drive City Attorney Carlsbad, California - 92008 CWy C e Dear Mayor Lewis, Thank you again for your help in sorting through our all-way stop sign issue, but I'm still uneasy about the "130 feet of landscape" that City Engineering has asked me to remove before they finally agree to install the all-way stop at the Chorito - El Fuerte intersection. As you know, a concrete retaining wall was installed by the City about 8 years ago for construction of a missing section of sidewalk along El Fuerte Street, and this wall does obstruct the Corner Sight Distance available to the waiting driver on Chorlito Street. The enclosed computer generated 3-D images show a "Sight Line" that is limited by this retaining wall, which could be used as a "guide" for removing this offending landscape. I believe that all landscaping and over-hanging flowers should be removed for an unimpeded "Sight Line" view of El Fuerte traffic coming uphill from Rancho Pancho Street, which would only be limited by the presence of a city owned retaining wall. Right now the "overhang" is about one foot in several areas and our gardener has been asked to trim this "landscape" completely away from the retaining wall and the sidewalk. We intend to immediately remove a large tree on our property at the corner of the Chorlito - El Fuerte Street intersection, and are presently seeking bids to do this. Our dealings with City Engineering have been largely ineffectual and I wonder if they are sufficiently concerned about the interests of the citizens of Carlsbad who live in our area. My central question is: does City Engineering accept this 3-D model and agree with the zone for "landscape removal" that is bounded by the retaining wall and sidewalk, and does the City accept the "landscape free zone" we have established for our gardener? Given the dismissive attitude by City Engineering, I am understandably uneasy about receiving a fair and logical treatment regarding this "landscape removal" issue; could you intercede on our behalf to provide some assurance that I'm being treated fairly? Unfortunately I will miss the May 22 City Council meeting, and that is why I've decided to "FedEx" this information to you, the City Council, and City Engineering directly. Sincerely, Dwight N.
