CITY MGR. ~5&-^ RECOMMENDED ACTION: Adopt Resolution No. 2007-128 quitclaiming Relinquishment of Access Rights easement over Lots 5, 6, 19, and 20 of Carlsbad Tract No. 98-10, Map No. 15013. ITEM EXPLANATION: Carlsbad Tract No. 98-10, recorded May 3, 2005, relinquished vehicular access rights to Lionshead Avenue from Lots 5, 6, 19 and 20 except for certain driveway locations as required. Subsequent development plans (PIP 05-07, 05-10, and 05-17) have proposed minor changes to these access openings with staff concurrence. The changes are necessary to support the final design and placement of buildings on the subdivided lots. Staff has approved the final design and supports the proposed quitclaim of Relinquishment of Access Rights. Staff has combined three separate projects into this agenda bill and resolution to relinquish access to four driveways. ENVIRONMENTAL IMPACT: The activity is exempt from California Environmental Quality Act (CEQA) review per CEQA Section 15061(b)3, because it can be seen with certainty that there is no possibility that the quitclaim may have a significant effect on the environment. FISCAL IMPACT: The item has no fiscal impact to the City. The easements were granted to the City for a no fee cost acquisition and the City will quitclaim the easements for a no fee cost return to the property owner. The owner has paid the standard fee for processing this quitclaim. EXHIBITS: 1. Location Map. 2.
