RECOMMENDED ACTION:
Adopt Resolution No. _2007-135 accepting the construction contract on the Carlsbad
Boulevard Left-Turn Lane at Breakwater Road, Project No. 3947-1 as complete, and directing the City
Clerk to record a Notice of Completion and release bonds in accordance with State Law and City
Ordinances.
ITEM EXPLANATION:
On May 3, 2005, GIM General Engineering was awarded a contract in the amount of $180,954 for the
construction of the Carlsbad Boulevard Left-Turn Lane at Breakwater Road, Project No. 3947-1.
GIM General Engineering substantially completed the road work on July 17, 2006. Contract
negotiations continued and the final change order was executed on March 27, 2007. City staff has
inspected the work and found it to be satisfactory. Staff recommends formal acceptance of the
improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

WHEREAS, the construction of the Carlsbad Boulevard Left-Turn Lane at Breakwater

Road has been completed to the City's satisfaction by GIM General Engineering on July 17, 2006;
6
and
7
WHEREAS, the formal project Notice of Completion has been prepared; and
8
WHEREAS, all project costs have been established to date.9
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,10
California, as follows:
1. That the above recitations are true and correct.
13 2. That the Carlsbad Boulevard Left-Turn Lane at Breakwater Road, specifically
14 identified as Project No. 3947-1, is deemed complete and is hereby accepted by the City Council
15 of the City of Carlsbad.
16 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
17 execute and record the Notice of Completion for the Carlsbad Boulevard Left-Turn'Lane at
18 Breakwater Road, Project No. 3947-1.
