PW-ADM CITY OF CARLSBAD - AGENDA BILL AUTHORIZE STAFF TO EXECUTE ALL NECESSARY FORMS FOR THE CALIFORNIA BEVERAGE CONTAINER RECYCLING AND LITTER REDUCTION ACT PROGRAM ^DEPT. HEAD J^ CITY ATTY. 4^ CITY MGR. ^J^V^ RECOMMENDED ACTION: Adopt Resolution No. 2007-137 authorizing the City Manager or designee to execute, in the name of the City of Carlsbad, all necessary forms for the purpose of securing payments and to implement and carry out the purposes specified in Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act and to appropriate prior receipts. ITEM EXPLANATION: Pursuant to Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act, the Department of Conservation distributes a total of $1.5 million to eligible cities and counties specifically for beverage container recycling and litter cleanup activities. Each city is eligible to receive a minimum of $5,000 or an amount calculated by the State, per capita based, whichever is greater. The per capita amount calculated by the State is based upon the population, as of January 1, 2000, in incorporated areas of a city, as stated in the Annual Demographic Report submitted to the Governor by the Department of Finance. The City of Carlsbad is eligible to receive $26,207 for this program in 2007-08. Staff submitted a funding request form to the State that describes the recycling activities for which the funds mentioned above will be expended. Staff is requesting the funds focus on the purchase and installation of recycling containers for use in public offices and City parks, promotional and advertising programs, educational programs. The promotional and advertising programs are intended to utilize utility bill inserts, newsletters, print media and brochures to disseminate information to the public on recycling programs available within the City of Carlsbad. ENVIRONMENTAL IMPACT: The approval of this grant application is not considered a project under the California Environmental Quality Act and, therefore, is not required to go through environmental review. FISCAL IMPACT: The City will be allocated $26,207 for 2007-08 to administer the aforementioned programs within the City of Carlsbad. The City receives these funds on an annual basis for different initiatives. No matching funds are required. EXHIBITS: 1. COUNCIL ACTION: APPROVED DENIED CONTINUED WITHDRAWN AMENDED D Dn D CONTINUED TO DATE SPECIFIC D CONTINUED TO DATE UNKNOWN D RETURNED TO STAFF D OTHER - SEE MINUTES D 1 RESOLUTION NO. 2007-137 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF 3 CARLSBAD, CALIFORNIA, AUTHORIZING THE PUBLIC WORKS DIRECTOR, PUBLIC WORKS MANAGER, * MANAGEMENT ANALYST, OR DESIGNEE, TO EXECUTE IN THE NAME OF THE CITY OF CARLSBAD, ALL NECESSARY FORMS FOR THE PURPOSE OF SECURING PAYMENTS AND TO IMPLEMENT AND CARRY OUT THE PURPOSES SPECIFIED IN SECTION 14581 (a)(4)(A) OF THE CALIFORNIA 6 BEVERAGE CONTAINER RECYCLING AND LITTER REDUCTION ACT AND APPROPRIATE PRIOR RECEIPTS. 7 WHEREAS, the people of the State of California have enacted the California Beverage 8 Container Recycling and Litter Reduction Act that provides funds to cities and counties for g beverage container recycling and litter cleanup activities; and WHEREAS, the California Department of Conservation's Division of Recycling has been 11 delegated the responsibility for the administration of the program within the State, setting up 12 necessary procedures for cities and counties or their designees under the program; and 13 WHEREAS, per Section 14581 (a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act (Division 12.1 of the Public Resources Code, Section 14500 et.seq.), 14 the eligible participant must submit the funding request form by the due date and time in order to 15 request funds from the Department of Conservation's Division of Recycling; and 16 WHEREAS, the City is entitled to an allocation of $26,207 for fiscal year 2007-2008. 17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That Council authorizes the submittal of the Funding Request Form to the Department of Conservation's Division of Recycling. 21 3. That the City Manager or designee is hereby authorized and empowered to op execute, in the name of the City of Carlsbad, all necessary forms hereto for the purpose of 23 securing payments and to implement and carry out the purposes specified in the Section 14581 24 (a)(4)(A) of the California Beverage Container Recycling and Litter Reduction Act and provide 25 information regarding this program to the Department of Conservation's Division of Recycling upon request.26 4.
