HEAD CITY ATTY. CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. 2007-165 accepting bids and awarding the contract to Roy Allan Slurry Seal for construction of the 2007 Slurry Seal, Project No. 3667-14/6001-13. ITEM EXPLANATION: The 2007, Slurry Seal Project No. 3667-14/6001-13, which is part of the City's ongoing Pavement Management Program, will provide a new, flexible wearing surface to the existing pavement and extend the useful life of the various roadways identified for this year's program (refer to Exhibit 1 for list of streets). The roadways included in this project will be sealed with a rubberized slurry seal. The application of rubberized slurry seal rejuvenates and protects the roadway surface from the harmful effects of sunlight and it protects the underlying base material from the damaging effects of water penetration. During the bidding process, staff issued Addendum No. 1, which allowed bidders to submit bids using either Rubberized Emulsion Aggregate Slurry (REAS) or Tire Rubber Modified Slurry Seal (TRMSS) as an equal (Refer to Exhibit 4). On April 24, 2007, five (5) sealed bids were received for the construction of this project as shown on the following table. CONTRACTOR 1. Roy Allan Slurry Seal TRMSS $157,412.48 2. Pavement Coatings Company REAS $203,163.60 The Engineer's Estimate of cost for this project is $290,000. The third low bidder, American Asphalt South, has submitted a bid protest (refer to Exhibit 3). American Asphalt South is claiming Roy Allan Slurry Seal (apparent low bidder) is non-responsive. American Asphalt South is also claiming that Pavement Recycling Systems (apparent second low bidder) does not have the qualifications required to perform the work. Staff's response to the two claims is described below. FOR CITY CLERKS USE ONLY. Through Addendum No. 1, as mentioned above, staff determined that they are equal. The composition of the two slurry seals indicates both contain automobile tire rubber, fine aggregate (sand), and asphaltic emulsion. The contract specifications further require that there shall be a maximum loss of 50 grams per square foot using the modified "Wet Track Abrasion Test". The firm of LaBelle Marvin, Inc., which specializes in the design and management of pavements, performed a recent Wet Track Abrasion Test on TRMSS. The test resulted in a loss of 27 grams per square foot, which is well within the specification limits. The main difference between the two products is that TRMSS uses a cationic (positively charged) quick set emulsion which cures chemically, while the REAS uses an anionic emulsion which cures by evaporation. The cationic quick set emulsion allows TRMSS to cure faster than REAS. In addition, TRMSS is not a proprietary formula so any bidder can make it. American Asphalt South has also claimed that since the original specifications for this project called for REAS, the City should reject the TRMSS bid from Roy Allan Slurry Seal. However, Public Contract Code Section 3400 requires municipalities to allow "...any equal material, product, thing, or service" regardless of whether or not the specifications make reference to a specific material, product, thing, or service and if a local agency calls for a specific product, it must also name acceptable alternatives. Claim that Pavement Recycling Systems Does Not Have Experience Qualification: The claim did not provide any information on why they were indicating that Pavement Recycling Systems did not have the experience to perform the work. Pavement Recycling Systems has met the requirements to have the appropriate California State License by having a Class A General Engineering Contractor License. Conclusion: All bid documents submitted by Roy Allan Slurry Seal have been reviewed by staff and were found to be in order. Staff recommends awarding the construction contract to Roy Allan Slurry Seal in the amount of $157,412.48. ENVIRONMENTAL IMPACT: This project is categorically exempt from the environmental review process under Section 15301 Class 1 (c) of Title 14 of the California Code of Regulations. FISCAL IMPACT: The estimated construction costs associated with this project are summarized in the following table. (hereinafter "American"), to submit a Bid Protest with respect to evaluation of the bids received on the above-referenced Project. It is our understanding that Roy Allan, Inc. (hereinafter "RAI"), is the apparent low bidder. However, an examination of the bid submitted by RAI reveals that it is "non- responsive." RAI has listed Tire Rubber Modified Slurry Seal (hereinafter "TRMSS") as the "or equal" product to Rubberized Emulsion Aggregate Slurry (hereinafter "REAS"). Additionally, Pavement Recycling System, Inc. (hereinafter "Pavement"), is the apparent second low bidder. However, Pavement does not have the experience qualification required for the specification. As a result, the bid of Pavement is non-responsive. Addendum No. 1 to this Project changed Bid Items 5 and 6 to allow contractors to bid using an equal to REAS. The Addendum mentioned that TRMSS was an equal. However, TRMSS has not been tested on any sizable project for any appreciable amount of time. TRMSS is basically conventional slurry seal. The specification is exactly the same as conventional slurry seal with the exception of the bare asphalt specified to be one with rubber in it. It is not "or equal" to REAS. As a result, the bid of RAI is non-responsive. TRMSS is not "or equal" to REAS; The fact that it has some partially digested tires in the asphalt used to make the TRMSS emulsion does not change the fact that TRMSS is basically conventional slurry seal. Lance Allen recently stated that the long term performance of this new product should be accepted based on the fact that it is basically conventional slurry seal, and that product has been used for decades. There is no evidence to back up that statement. If that is the comparison he uses, why does he think it is comparable to REAS? The two products have their own standard specifications in the Greenbook, clearly delineating them as separate products. REAS vs. TRMSS - The Numbers: REAS has both more asphalt binder content and more rubber tire content than either rubber containing or non rubber containing conventional slurry seal. Comparing REAS, TRMSS and conventional slurry seal in the following table, you can clearly see the differences in residual binder content, and rubber content. You can also see that the numbers for conventional slurry seal and TRMSS are the same, except the rubber content. Long Term Performance; No one can really say with certainty anything about how this product will perform long term in regards color, or any other area of performance. TRMSS has not been tested on any sizeable projects for any appreciable amount of time. REAS has been tested in the field for over 13 years, with over 25,000 lane miles of slurry on municipal streets, and has been the subject to several long term performance studies done by objective parties. The Specification: While Roy Allen Slurry Seal is promoting a "Standard Specification for Tire Rubber Slurry Seal", whose standards is it? Not the Greenbook, despite trying to look like it. But upon examination, it does appear to be mostly a Greenbook specification - the one for conventional slurry seal. The Cost; TRMSS contains less than half of the emulsion content of REAS. Emulsion is the most costly component of any slurry seal, so how can REAS compete on a price basis? TRMSS is unavailable to all but two contractors; TRMSS is only available to two contractors (who jointly own the only company which is making the product). So, even if other contractors wanted to bid TRMSS, they are not able to do so. As a result, the bid of RAI is non-responsive. Please confirm that the City of Carlsbad will find the bid of RAI non-responsive and award the Project to the lowest responsive bidder. Contract No. 3667-14 Addendum No. 1 June 26, 2007 TO: Bob Johnson, Acting City Engineer FROM: Associate Engineer, Design Division VIA: ^5 Eva Plajzer, Senior Civil Engineer BID PROTEST REGARDING REAS AND TRMSS 2007 SLURRY SEAL PROJECT, CONTRACT NO. 3667-14 In regards to the aforementioned bid protest, I have researched the issue and made the following findings: The Rubberized Emulsion Aggregate Slurry (REAS) and the Tire Rubber Modified Slurry Seal (TRMSS) are very similar in composition: both contain tire rubber, fine aggregate, and asphaltic emulsion. The two products are also very similar in function: both provide a thin, black, flexible layer over the existing asphalt concrete. The main difference between the two products is that TRMSS uses a cationic quick set emulsion which cures chemically, while the REAS uses an anionic emulsion which cures by evaporation, and therefore, cures more slowly. When applying slurry seal in a coastal community such as Carlsbad with a marine fog layer, the TRMSS will cure faster and will cause less disruption to the flow of traffic. In addition, the chemical curing mechanism of the TRMSS will allow for slurry seal application in the cooler months of winter and spring. In order to measure the wearing of the product, the contract specifications require that there shall be a maximum loss of 50 grams per square foot using the modified "Wet Track Abrasion Test." The firm of LaBelle Marvin, Inc., which specializes in the design and management of pavements, performed a recent Wet Track Abrasion Test on TRMSS. The test resulted in a loss of 27 grams per square foot, which is well within the specification limits. I personally visited the site of a test area of TRMSS in Oceanside at the intersection of Oceanside Boulevard and Corporate Way. The material appeared to hold up well at the busy intersection after over one year of wear. Oceanside Public Works staff reported "TRMSS has performed well with no deficiencies." In a staff report dated June 20, 2007 Oceanside staff recommended that Roy Allan be awarded Oceanside's Annual Slurry Seal Project FY 2006-07. |Z I personally called all of the references provided by Roy Allan Slurry Seal and found that all municipalities contacted were satisfied with the performance of the TRMSS product on test applications. Also, Roy Allan Slurry Seal received positive reviews as a contractor by the agencies that it has performed work for in the past year, including the cities of Santa Barbara, Goleta, Mission Viejo, and Poway. Despite claims to the contrary by the third low bidder, American Asphalt South, TRMSS is not conventional slurry. TRMSS utilizes an asphalt binder with a minimum of 10% ground whole scrap tire rubber which is incorporated into the asphalt binder. Conventional slurry has no rubber content. In conclusion, while the two products, TRMSS and REAS, are not identical in composition, they are very similar: both contain tire rubber, fine aggregate, and asphaltic emulsion. The two products are also substantially equal in performance and characteristics. The chemical curing of the TRMSS allows it to cure faster in poor weather conditions and provide for less traffic disruption. All municipalities contacted were satisfied with the performance of the TRMSS product and with the workmanship of Roy Allan Slurry Seal. The TRMSS exceeds the specification for wear in the ASTM standard Wet Track Abrasion Test. With these findings, I conclude that TRMSS and REAS are substantially equal, and I recommend that the low bidder, Roy Allan Slurry Seal, be awarded the contract for the 2007 Slurry Seal Project. I am sure the City Manager will leave it there and when it comes up on the agenda staff will be asked if the protest was withdrawn and an affirmative answer would most likely result in a quick approval of the award of the slurry seal contract. Staff should still plan on being at the Council meeting with the PowerPoint presentation just in case. I don't think Jon Schauble now needs to be at the City Council meeting. However, you or Eva should be at the Council meeting to present the item just in case someone has questions, be it the public or Council. The City Manager has indicated that for the Monday Council briefings, someone only needs to be available on telephone standby. His office is located in Carlsbad and he is the material supplier of asphalt slurry mix to several contractors that submitted bids on the City's recent asphalt slurry project. His product is referred to as Rubberized Emulsion Aggregate Slurry (REAS). Based on my call he came in and met with myself and Eva Plajzer. He is objecting to the City's term "Equal" when comparing his product to an alternative product the City allowed for the project during the bidding process. He said the City should have used another term in the bidding process such as "either or" rather than "Equal". He was not as interested in a comparison of the performance of his product to the other product but made the point that they are not equal products. The Public Contracts Code and our General Provisions however only use the term "equal" when a material offered is equivalent to that specified. He also said the aternative product has not demonstrated that it has sufficient record of use since it is relatively new. He was aware that Oceanside had recently awarded a similar project using the alternative material. Finally, he indicated that the supplier of the alternative material would only provide a quote to one contractor rather than to all of the contractors. Mr. Burris was informed that staff was recommending to Council that the project be awarded to the contractor specifying the alternative material, and he could make a presentation to the Council on Tuesday. He concluded that he preferred that we cancel the bids and readvertise to receive new bids using either the alternative material or using the term "either or" to include both materials and eliminate the words "equal".
