RECOMMENDED ACTION:
Adopt Resolution No. 2007-186 _ approving plans and specifications, approval of artwork, and
authorizing the City Clerk to advertise for bids for the construction of Alga Norte Community Park,
Project Nos. 3837 and 3925.
ITEM EXPLANATION:
Project Description - The proposed Alga Norte Community Park is located at the northwest corner of
the intersection of Poinsettia Lane and Alicante Road, see Exhibit 1. On December 17, 2002,
the City Council adopted Resolution No. 2002-371 approving the Alga Norte Community Park Master
Plan featuring an aquatics center, three baseball fields, a dog park, a skatepark, basketball courts,
playgrounds, open space, and parking. The aquatics center includes a competitive pool, a 12-lane
instruction pool, a therapy pool, and a recreation component with wet play structures, slides, and a
moving river. The aquatics center also includes 13,000 square feet of building space for a mechanical
building, an administration building, locker room facilities, group meeting facilities, a fitness room, and
a concessions kitchen. Other buildings at the proposed park include a maintenance facility, numerous
pumping station structures, chlorination building, a snack bar, and three public restrooms (refer to
Exhibit 2 for Site Plan).
On January 21, 2003, City Council adopted Resolution No. 2003-024, which authorized acquisition of
a 32.11-acre parcel of land for Alga Norte Community Park. On July 8, 2003, the City Council adopted
Resolution No. 2003-178 approving a professional services agreement for the design of Alga Norte
Community Park with the landscape architectural firm of Wimmer, Yamada, and Caughey.
On September 19, 2006, by Resolution No. 2006-278, City Council approved an agreement with
Dudek & Associates to assist staff in performing a constructability review. The plans and
specifications were completed at the end of December 2006, and submitted to the City for final
review. Staff, along with Dudek & Associates, completed a constructability review in March 2007, and
the architect has incorporated the review comments into the plans and specifications.
LEED Component - The Leadership in Energy and Environmental Design (LEED) rating system was
developed five years ago by the U.S. Green Building Council (USGBC) to assist project owners in
achieving sustainability through a diverse menu of best practices. To earn certification, a building
project must meet certain prerequisites and performance benchmarks within each of six categories.
Projects are awarded Certified, Silver, Gold, or Platinum certification depending on the number of
points they achieve in each category.

In June 2006, the park had a LEED scorecard of 19 points, but, since that time, staff has been
working with the architect to add additional features and other efficiency measures and increased the
LEED item scorecard to 28 points which achieved the "Certified" level (see Exhibit 3). It was
determined that significant additional project scope changes and associated project cost increase
would be needed to incorporate additional elements to achieve the next higher level which is
"silver certification".
A LEED Consultant is required to provide verification that the project actually will meet the various
levels of certification. Additionally, during the Design Phase, a LEED Commissioning Agent reviews
the Design Intent, the Basis of the Design, the project plans and specifications, prepares a
Commissioning Plan that includes an overview of features and systems, identifies primary
participants, provides a description of management, communication and reporting, and outlines the
submittal process, inspection, start-up & testing, training, O&M documentation process and
commissioning specifications. During the Construction Phase, the LEED Commissioning Agent
develops performance testing guidelines and sampling rates for verification and monitoring, makes
site visits on the sampling rate, checks the installation for conformance with contract documents,
performs start-up and checkout, completes a final commissioning report, assists in preparation of the
LEED letter template for submittal to the USGBC to prove that commissioning was performed as
required.
Public Art Element - A variety of public art elements have been incorporated into the design of
Alga Norte Community Park by San Diego-based artist, Paul Hobson. Working closely with the park's
architect, Mr. Hobson developed five different elements that would be integrated into the overall park
design, including three distinct elements for the swim complex area, one element into the parking lot,
and another for each of the various sports fields and activities. Two other artistic elements, again
integrated into the park design, were also developed as potential fundraising projects, and these
designs would only be implemented if separate funds were raised from the public. The proposed art
elements are shown on Exhibit 4.
The design proposal, produced by Mr. Hobson, was presented to and approved by the
Arts Commission on August 5, 2004 by a vote of 4-0. The proposal was then put out on display for
public review and comment at a number of locations in the City, including Stagecoach Park
Community Center, Dove Library, and the Carlsbad Swim Complex. Of the public comments received
from Carlsbad residents, 37 were positive (64%), 11 were split (19%), and 10 were negative (17%).
The detailed design proposal, along with the public comments, was then presented to the
Arts Commission for a second review on August 3, 2006. The Arts Commission voted to recommend
approval to the City Council by a vote of 7-0.
ENVIRONMENTAL IMPACT:
On March 1, 2006, the Planning Commission adopted Resolution No. 6039 and 6040, adopting a
Negative Declaration (ND) and Conditional Use Permit No. 04-08, respectively for the project.

The project costs estimated for Alga Norte Community Park are shown in Table 1 below.

Note: A separate appropriation was made to purchase the land for Alga Norte Community Park in the
amount of $4,034,000, and miscellaneous expenses for $135,000, which is not included in Table 1.
The Aquatics Center appropriation includes the construction cost, estimated at approximately
$21,447,000, combined with the prorated share of the other line item costs in Table 1 for a total
amount of $28,315,490 obtained from Public Facilities Fees (PFF) Fund, General Capital Construction
(GCC), and Proposition C (GCC Fund).

The Community Park appropriation includes the construction cost, estimated at approximately
$17,192,000, combined with the prorated share of all other line item costs in Table 1 for a total
amount of $22,107,510 obtained from PFF fund.
Estimated Revenue and Operation and Maintenance Costs
Staff has prepared preliminary estimates of annual revenue and annual operation and maintenance
costs, summarized as follows:
• The Aquatics Center annual revenue is currently projected to be $1.45 million. Aquatic Center
annual expenses for the Recreation Department are estimated at $1.92 million, with personnel
expenses totaling $1.20 million and maintenance and operations expenses totaling $720,000,
resulting in a cost recovery percentage of 75%. Additional annual Aquatic Center maintenance
and operation expenses from Public Works for Facilities and for Parks are expected to be
$124,000 and $32,000, respectively. In total, annual Aquatic Center expenses are expected to
be approximately $2.08 million, for an overall cost recovery percentage of 70%
• The Community Park, including Ball fields, Basketball Courts, Play Areas, Picnic Areas,
Dog Park, Skate Park and all other Park amenities (exclusive of the Aquatics Center),
has projected combined expenses of approximately $725,000, and is expected to generate
approximately $58,000 in annual revenue.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, APPROVING PLANS AND
SPECIFICATIONS, ARTWORK, AND AUTHORIZING THE CITY
4 CLERK TO ADVERTISE FOR BIDS FOR CONSTRUCTION OF
ALGA NORTE COMMUNITY PARK. PROJECT NOS. 3837 AND 3925.

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
6 necessary, desirable, and in the public interest to construct Alga Norte Community Park,
7 Project Nos. 3837 and 3925; and
8 WHEREAS, Alga Norte Community Park is necessary to comply with the City's Growth
9 Management Plan; and
WHEREAS, the plans and specifications for furnishing all labor, materials, tools,
equipment, transportation, and other expenses necessary or incidental of said project have been
11
prepared and are on file in the Public Works-Engineering Department of the City of Carlsbad and
12 are incorporated herein by reference; and
13 WHEREAS, the design of the public art component for the project has been completed
14 and approved by the Arts Commission at a meeting held on August 3, 2006; and
1(- WHEREAS, funding for said project has been appropriated from PFF and GCC Funds in
the 2007/2008 Capital Improvement Program in the amount of $50,423,000 to cover all project

costs.
17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
18 California, as follows:
19 1. That the above recitations are true and correct.
2Q 2. That the plans, specifications, and contract documents on file in the Engineering
Department of the City of Carlsbad are hereby approved.

3. That the public art component for Alga Norte Community Park is hereby

Dear City Council,
As a resident of Carlsbad, I read an article in today's NC Times that raised my concern. The article states
that you are considering scaling back on the new community acquatics center. I am extremely frustrated
and disappointed by this news.
The current acquatics center is completely inadequate for a city of this size. My 9 year old son plays water
polo, and he has to attend practice from 7-9PM in order to get pool time. He is exhausted by the time the
practice is over, and he still must shower, drive home and get ready for bed. Carlsbad is in dire need of a
larger, second facility.
With respect to scaling back, you were willing to build the most expensive golf course in the country. I find
that golf course to be a complete waste of money, personally, as it will impact the limited number of
people who golf in Carlsbad. Ask yourself what number of children and families will use your acquatics
center, in conjunction with the adults who train each day. If your goal is to be a family oriented community,
then you need to build a family friendly acquatics center. The current high school pool is not a family
facility. It makes more sense to me for the City of Carlsbad to spend money for facilities that will be used
by the majority of the residents. Legoland is not a substitution for a community pool - it costs $45+ per
person to attend, does not serve anyone with older children, and is limited in scope and appeal.
I have to say that when I lived in Maryland, in a community less than half the size of Carlsbad, there were
3 wonderful pools with play equipment, slides and beach entries, all for a season which lasted just 3
months. It is ironic to me that the sunny, warm City of Carlsbad does not have any family pools like this,
and we have the ability to use the pool 12 months per year.
We have voted to approve this second pool, you have the money allocated for the pool, please, stop
waffling and just build it already.

swimming pool at La Costa Canyon. With all of the building that has happened in the Carlsbad area, it is
unbelievable that we do not access to a decent swim center on par with communities like ours.

I am writing as a parent concerned that there may be further delays or cutbacks in the proposed Alga
North swim complex. I am a resident of La Costa Valley who must drive my 9-year-old son to water polo
practice 4 days a week at the Carlsbad H.S. complex, a 15-minute drive each way from my home. He is
often finishing up at 9pm, when his normal bed time is 8:30. This is solely a function of the pool being
overused. One pool serving a community of 100,000 is simply not enough to support a beachside,
physically active family community like Carlsbad.
There are so many good reasons to support this park as proposed. Consider the success of Vista/Es
Wave Waterpark. As fiscally responsible council members, I think you should consider their statistics and
conclusions:
1) They had more than 116,000 recreational visitors during the summer, and an additional
24,000 community and school groups using the pool portion year-round.
2) The Wave Waterpark is a major seasonal employer for local residents, especially teens
and young adults.
3) Revenue from the recreational portion of the park offsets maintenance costs for the pool.
I know being orevenue neutralo has been a significant justification for cost of the municipal golf course u
which will cost three-times the proposed cost of the pool and serve only a fraction of the residents as
would a pool/water park complex.
4) Consider this quote: "Originally I thought the City couldn't afford a waterpark with a
FlowRider and lazy river attraction, but I soon realized that the City couldn't afford a pool without one,"
says Jim Porter, director of Parks and Recreation for the City of Vista.
5) I would strongly encourage you to take 5 minutes and read an article about the success
of Vista/Es Waver Waterpark. http://www.recmanagement.com/200211fp01 .php
I would differ with Councilman Packer/Es stated concern that a water park would compete with Legoland.
In fact, I believe it would make Carlsbad a more worthwhile weekend/weeklong destination. Orlando has
several water parks, including two built by the Walt Disney Co. If they don/Et believe it conflicts with
Disneyworld, I don/Et think we should believe a water park conflicts with Legoland.
There is a strong perception among La Costa residents that the city does not give La Costa/southern
Carlsbad residents the same consideration it gives the center/northern part of the city u despite our hefty
contribution to the city/Es tax base. Building this first-class facility now, when the city has the funds to do it
as designed, would address that concern; it would benefit all of the residents of Carlsbad; as well as add
to our tourism industry and be fiscally prudent running the swimming complex in the long run.
I strongly encourage you to approve the full and complete swim complex, as proposed.

We live in South Carlsbad and drive to the community pool near Carlsbad High School for my son's water
polo practice. Unfortunately, due to the lack of available pool times, my 10 yr old son is often practicing
until after 9:00 at night. In addition, because the pool is so incredibly over-scheduled and over-requested,
we are unable to have waterpolo tournaments or even games there. This means that every weekend we
are required to drive to Santee, Chula Vista, Poway and many other far-reaching areas of the county to
participate in games and of course, never have "home pool" advantage.
We understand the money is available and in place for the building. Please support the swim complex

the following much needed priority: Alga Norte Community Park and Swim Complex-Proceed with
building this community park that will feature a state-of-the-art swim complex.
I am the parent of two school aged children who live in southwest Carlsbad. The only public swimming
pool available to us is the swim complex next to Carlsbad High School. The children in the south end of
the city easier access to a swimming pool. Poinsettia Park, Stagecoach Park, and our new Aviara Park
don't have any swimming facilities.
Swimming provides our children with a healthy alternative to hanging out at the mall or participating in the
overcrowded other sports. A swim complex can also provide our children with summer jobs and support
our high school swim programs.
Please support the swim complex and place Carlsbad on par with other communities who have had much
building and development. Thank you.

I am writing as a parent concerned that there may be further delays or cutbacks in the proposed Alga
North swim complex. I am a resident of La Costa Valley who must drive my 13-year-old daughter to water
polo practice 4 days a week at the Army Navy pool in downtown Carlsbad, a 20-minute drive each way
from my home. It is out doors, small had no changing facility or bathroom at the pool side. It also has
telephone poles and electric wires hanging nearby which cause me concern. A community pool in
southern Carlsbad would be greatly received.
I would differ with Councilman Packard/Es stated concern that a water park would compete with Legoland.
In many area's water parks and amusement parks complement each other. I believe community sports
are being overlooked in that there are many children who would benefit greatly from a local pool.
There is a strong perception among La Costa residents that the city does not give La Costa/southern
Carlsbad residents the same consideration it gives the center/northern part of the city. Building this
first-class facility now, when the city has the funds to do it as designed, would address that concern; it
would benefit all of the residents of Carlsbad; as well as add to our tourism industry and be fiscally prudent
running the swimming complex in the long run.
I strongly encourage you to approve the full and complete swim complex, as proposed.

Dear City Council,
pardon my second email regarding my support of the proposed new swim complex, also please excuse
my poor spelling and typing.
because i am an oceanside ressident yu may not consider mt opinion of high value- however we have had
out of town guests, and we suggested they stay in carlsbad because of safety as well as more fun things
to do- such as walk in the village, your lovely beach access from their hotel, as well as lego land.
Anyone visiting southeren California would be sure to enjoy the added bonus of a water- park adjacent to a
large park with a picnic area, the dog park would also be a plus to tourists andnearby community membes.
Although we do live in Oceanside we frequent the Carlsbad pool, both Carlsbad libraries, as well as many
of the village shops.
One plus about the Vista Wavewater park is the nearby entertainment as well as restaurants which i am
sure gain a lot of business through the wave's patrons. It is unfortunate that the proposed pol site is not
also adjacent to such a mecca of movies, restaurants, and shops.
On another note...IF we as adults put our money and our priority into our children's (familys', and adults),
health and well being then we will strngthen our community. Maybe we will not need to have police
facilities upgraded if we support the activities which such a fantastic swim complex will promote. I am
extremely supportive of police and fire department personnel and facilities and do not know aht your
current needs are in that area. I have a feeling that many of your police and fire personnel have
themselves benfited from pools and themselves would give a huge yes vote to more availability of all that
a swim complex has to offer the community.
What the swim complex/ park will provide is more room for lap swimmers,
a competitive swimming pool (this would bring in teams for meets),
additional space for swim teams and the waterpolo team. People within the health community speak
highly of the Carlsbad waterpolo club's coaches.This is a very special program which I appreciate very
much.
A place for there to be year round recreational swimming.
A family oriented large area for FUN.
Additional attractions for local community members and tourists.
Aplace where people will get hungry and find something to eat in some of the nice eating establishments
in CArlsbad.
I was sorry to hear about the finacial difficulty with the golf course. Money put into the swim complex will
have ahuge return because it is being given to everyone and anyone. No one will need to have a lot of
money to walk their dog or take their grand kids to a lifeguard safe pool and well maintained picnic area,

Having grandchildren in Carlsbad makes me an interested citizen in what your city is doing. Providing
quality facilities for youth should be foremost in your long-term planning. As your community is growing, it
would behoove your entire community to invest in facilities and activities that encourage the community's
youth to remain in their own area. Today's youth spend too much time doing non-physical activities. A
well rounded youth becomes a well rounded adult. I take pride in what my grandchildren are doing both
with their educations and their physical activities. One would hope that you too, would take pride in
considering all ages in your community when you decide how to spend your money.
Long-term planning is essential when building infrastructure and facilities. Managable and sustainable
financing are also important. Your residents are opposed to increased taxes, I'm sure. Your job is
weighty and takes constant consideration of the entire picture.
I suggest you go watch a community pool at a busy time being utilized by fit and enthusiactic youth. My
hope would be that your observations would help to make your job of deciding whether or not to have an

If the article in todays SD Union-Tribune is correct and the projected cost for the Alga Norte Park has
increased $11 million in the past 12 months and is now projected to be $50 million then I belive the
Council should strongly consider scrapping the whole project. Based on the City's past record for cost
control on major construction projects (e.g., "The Crossings") the final cost could well be in the $60 million
range when completed. Before you approve it put it before the citizens for a vote!
