NOTICE OF COMPLETION FOR THE CONSTRUCTION
CONTRACT ON THE 2006 SLURRY SEAL PROJECT,
PROJECT NO. 3667-12

RECOMMENDED ACTION:
Adopt Resolution No. 2007-205 accepting the construction contract on the 2006 Slurry Seal
Project, Project No. 3667-12 as complete, and directing the City Clerk to record a Notice of
Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On September 12, 2006 American Asphalt South, Inc. was awarded a contract in the amount of
$480,562 for the 2006 Slurry Seal Project, Project No. 3667-12.
American Asphalt South, Inc. substantially completed the work on June 6, 2007. The final punch list
work was completed on June 29, 2007. City staff has inspected the work and found it to be
satisfactory. Staff recommends formal acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION
CONTRACT ON THE 2006 SLURRY SEAL PROJECT, PROJECT
4 NO. 3667-12
5 WHEREAS, the construction of the 2006 Slurry Seal Project was substantially completed
6 on June 6, 2007, and all punch list work was completed on June 29, 2007; and
WHEREAS, all work has been completed to the City's satisfaction by American Asphalt
South, Inc.; and
WHEREAS, the formal project Notice of Completion has been prepared; and
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1 ^1. That the above recitations are true and correct.
14 2. That the 2006 Slurry Seal Project, specifically identified as Project No. 3667-12,
15 is deemed complete and is hereby accepted by the City Council of the City of Carlsbad.

3. The City Clerk of the City of Carlsbad is hereby authorized and directed to

execute and record the Notice of Completion for the 2006 Slurry Seal Project, Project No.

3667-12.
