RECOMMENDED ACTION:
Adopt Resolution No. 2007-209 approving the final map for CT 04-11, Poinsettia Commons,
and authorizing the City Clerk to process the map for recordation.
Adopt Resolution No. 2007-210 vacating a portion of Embarcadero Lane.
ITEM EXPLANATION:
Engineering staff has completed checking the final map of CT 04-11, known as Poinsettia Commons.
This subdivision is within Local Facilities Management Plan (LFMP) 22 and is generally located west
and east of Embarcadero Lane, east of the Poinsettia Commuter Rail Station, and south of
Avenida Encinas. The project proposes a total of 5 lots. The lots are comprised of 51 live/work
condominiums units, 15 loft condominium units, retail commercial, a daycare and 12 affordable
apartments. No further discretionary permits are required before building permits can be issued for
this development.
The final map conforms substantially with the tentative map as recommended for approval by the
Planning Commission per PC Resolution No. 5806, approved January 5, 2005, and as approved by
City Council on February 2, 2005 per CC Resolution No. 2005-030. The final map also conforms to
the General Plan, all the applicable requirements of the Municipal Code, City Standards, and
Growth Management Plan. The applicant, Poinsettia Commons LLC, a Delaware Limited Liability
Company, is requesting the recordation of said final map.
Condition No. 62 of PC Resolution No. 5806 requires that the portion of Embarcadero Lane aligned in
a north and south direction be vacated prior to the approval of the final map. The remaining portion of
Embarcadero Lane will remain as a public street. The portion to be vacated will be replaced with a
private tree-lined street consisting of two lanes and on-street angled parking. A vehicular and
pedestrian access easement for the neighboring property owners within the Poinsettia Properties
Master Planned Community has been secured over the private street as required per Condition No. 63
of PC Resolution No. 5806. All access points to the adjacent properties will remain in the same
locations as they exist today. Also, a public general utility and utility access easement securing access
and maintenance rights for the underlying public sewer and water facilities is being dedicated on the
final map. The construction plans for the private street are designed to the City Engineer's satisfaction
and all securities for its construction are in place.
Utility Companies and pertinent City departments have been notified of the proposed vacation.
No objections have been received.

ENVIRONMENTAL IMPACT:
The approval of a final subdivision map is a ministerial project and is exempt from the requirements of
CEQA pursuant to Section 15268 of the State CEQA Guidelines. The street vacation, included in the
design of CT 04-11 Poinsettia Commons which was approved by the City Council on February 1,
2005, remains within the scope of prior environmental documents including the previously certified
Poinsettia Properties Specific Plan Program EIR 96-01.
FISCAL IMPACT:
The developer pays a plancheck fee to cover the expense of planchecking and processing the final
map and street vacation for recording. All appropriate fees for the final map have been paid.
Approval of the street vacation will result in 1.126 acres of land to be returned to the tax rolls.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, APPROVING THE FINAL MAP FOR
CT 04-11, POINSETTIA COMMONS, AND AUTHORIZING THE
CITY CLERK TO PROCESS THE FINAL MAP FOR
WHEREAS, Poinsettia Commons LLC, a Delaware Limited Liability Company, has
submitted a final map known as CT 04-11, Poinsettia Commons, to the City of Carlsbad for
approval; and
WHEREAS, the tentative map of CT 04-11 with conditions, was recommended for
approval by the Planning Commission on January 5, 2005 per PC Resolution No. 5806; and

WHEREAS, the City Council considered said recommendation and approved CT 04-11

with conditions on February 2, 2005 per CC Resolution No. 2005-030; and
11 WHEREAS, the City Engineer has determined that said map substantially conforms to
said conditionally approved tentative map; and
WHEREAS, the conditions of approval for said final map have been completed or
secured; and
WHEREAS, the developer has offered public easements for dedication to the City of

WHEREAS, the final map conforms to the City of Carlsbad General Plan and all
17 requirements of City Codes and Standards.
18 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
21 2. That said final map known as CT 04-11, Poinsettia Commons, which is on file
with the City Engineer and is incorporated herein by reference, is accepted.
3. That the City accepts the dedications shown on the final map.

4. That the City Clerk is authorized to sign the Certificate of Acceptance on the

25 5. That the City Clerk is authorized to cause the original final map to be recorded in
26 the Office of the County Recorder of San Diego County, State of California.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

WHEREAS, the City Council of the City of Carlsbad on July 17, 2007 did adopt

Resolution of Intention No. 2007-182 declaring their intention to vacate a portion of

Embarcadero Lane; and
7 WHEREAS, the City Council did find in said Resolution that the proposed vacation was
8 in accordance with the Growth Management policies and consistent with the General Plan; and
g WHEREAS, all publication and posting of notices regarding the proposed vacation of
portions of Embarcadero Lane, pursuant to said Resolution have been given as required by law;

and
WHEREAS, the area to be vacated would not be useful as a non-motorized
12 transportation facility; and
13 WHEREAS, the City Council did hear the evidence offered by all persons interested in
14 said proposed vacation and does find from all the evidence submitted that the portion of
Embarcadero Lane proposed to be vacated is unnecessary for present or prospective public
15
use.
16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
17 California, as follows:
18 1 - That the above recitations are true and correct.
ig 2. That pursuant to Division 9, Part 3, Chapter 3 of the California Streets and
Highways Code the portion of Embarcadero Lane as described in Exhibit A and shown for the
sake of clarity on Exhibit B is hereby vacated, closed up and abandoned for public street
21 purposes.
22 3. It also shall be said it is Council's intention to conduct the proceedings for this
23 street vacation under the California Streets and Highways Code, Division 9, Part 3, Chapter 3.
24 4. That easements and rights necessary to maintain, operate, replace, remove or
renew in-place public facilities are reserved by dedication of a public general utility and access^o
easement on the final map known as CT 04-11, Poinsettia Commons.
26 5. From the date the resolution is recorded in the County Recorder's Office, the
27 area being vacated no longer constitutes a public street.
