T63f> RECOMMENDED ACTION: That the City Council ADOPT Resolution No. 2007-224 APPROVING the second amendments in 2007 to the Land Use Element and Open Space and Conservation Element of the General Plan, consisting of three projects commonly known as "DKN Hotel" (GPA 05-05), "Aura Circle" (GPA 05-06), and "La Costa Glen Corporate Center" (GPA 06-02). ITEM EXPLANATION: State law allows a jurisdiction to amend a mandatory element of the General Plan no more than four times per calendar year. The mandatory elements are Land Use, Circulation, Housing, Open Space, Noise, Safety, and Conservation. Each amendment to a mandatory element, however, may include more than one change to that element. The three General Plan Amendment (GPA) applications listed below propose changes to the Land Use Element, and two of the GPA applications propose changes to the Open Space and Conservation Element. The City Council has approved in concept each of the applications at duly noticed public hearings on the meeting dates noted below. The three applications are now being grouped together to comprise the second amendments in 2007 to the Land Use Element and Open Space and Conservation Element. The recommended action would formally adopt the changes to the General Plan (previously approved in concept), which will ensure consistency between the General Plan and Zoning Ordinance. COUNCIL ACTION: APPROVED DENIED CONTINUED WITHDRAWN AMENDED *D D D D CONTINUED TO DATE SPECIFIC CONTINUED TO DATE UNKNOWN RETURNED TO STAFF OTHER -SEE MINUTES D D D D Page 2 FISCAL IMPACT: TABLE B FISCAL IMPACT OF THE SECOND AMENDMENTS IN 2007 TO THE LAND USE ELEMENT AND THE OPEN SPACE AND CONSERVATION ELEMENT Project Fiscal Impact GPA 05-05 DKN Hotel GPA 05-05 is part of a project that consists of: A) the demolition of an existing hotel, restaurant, and single family residence; B) the construction of a 3-story, 104-room hotel; and C) an amendment to the land use designation on property located at 3136 Carlsbad Boulevard on the east side of Carlsbad Boulevard between Pine Avenue and Oak Avenue. The project will have a positive impact in terms of increased property tax, transient occupancy tax, and additional employment opportunities. The current assessed value of the project site is $1,800,000. With the new construction, it is estimated that the assessed value will increase to approximately $12 million. The increase in value would result in additional tax increment revenue for the Carlsbad Redevelopment Agency of approximately $102,000 per year. Additionally, the project may serve as a catalyst for other improvements in the area, either new development or rehabilitation of existing buildings, through the elimination of a blighting influence within the area. All public infrastructure required for this project will be funded and/or constructed by the developer. GPA 05-06 Aura Circle GPA 05-06 is part of a project that consists of: A) an 11-lot subdivision (two open space lots and nine residential lots); B) the construction of nine single-family residences and two second dwelling units; and C) a change to the land use designation and zoning on a site located west of Kelly Drive and north of Hillside Drive at the terminus of Aura Circle. All public infrastructure required for this project will be funded and or/constructed by the developer. No fiscal impacts to the City have been identified. GPA 06-02 La Costa Glen Corporate Center GPA 06-02 is part of a project that consists of: A) a 4-lot subdivision (MS 05-28); B) a Site Development Plan to construct a 21,904 square foot office building on Lot 1 of MS 05-28; C) a change to the land use designation and zoning on Lots 3 and 4 of MS 05-28; and D) a modification to the boundaries of the land use designation and zoning on a portion of APN 255-012-05 to correct mapping errors (the project site is located northwest of Calle Barcelona, west of El Camino Real, and north of Leucadia Boulevard). All public infrastructure required for this project will be funded and or/constructed by the developer. No fiscal impacts to the City have been identified. ENVIRONMENTAL IMPACT: TABLE C ENVIRONMENTAL STATUS OF THE SECOND AMENDMENTS IN 2007 TO THE LAND USE ELEMENT AND THE OPEN SPACE AND CONSERVATION ELEMENT Project Environmental Status Second Amendment to the General Plan in 2007 The amendments to the Land Use Element and the Open Space and Conservation Element of the General Plan are considered a project, and are therefore subject to CEQA. The environmental analyses of the four projects that comprise the second amendments in 2007 to the Land Use Element and Open Space and Conservation Element have been previously conducted, and reviewed and certified by the City Council in accordance with CEQA (described below). No additional environmental analysis is necessary. 2. That the above recitations are true and correct. Q 2. That the findings of the City Council set forth in City Council Resolutions No. 1Q 2007-096, 2007-152, and 2007-035 (on file in the City Clerk's office) are made a part hereof by reference. 3.
