RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. 2007-224 APPROVING the second amendments in
2007 to the Land Use Element and Open Space and Conservation Element of the General Plan,
consisting of three projects commonly known as "DKN Hotel" (GPA 05-05), "Aura Circle" (GPA 05-06),
and "La Costa Glen Corporate Center" (GPA 06-02).
ITEM EXPLANATION:
State law allows a jurisdiction to amend a mandatory element of the General Plan no more than four
times per calendar year. The mandatory elements are Land Use, Circulation, Housing, Open Space,
Noise, Safety, and Conservation. Each amendment to a mandatory element, however, may include
more than one change to that element.
The three General Plan Amendment (GPA) applications listed below propose changes to the Land Use
Element, and two of the GPA applications propose changes to the Open Space and Conservation
Element. The City Council has approved in concept each of the applications at duly noticed public
hearings on the meeting dates noted below. The three applications are now being grouped together to
comprise the second amendments in 2007 to the Land Use Element and Open Space and Conservation
Element. The recommended action would formally adopt the changes to the General Plan (previously
approved in concept), which will ensure consistency between the General Plan and Zoning Ordinance.

GPA 05-05
DKN Hotel
GPA 05-05 is part of a project that consists of: A) the demolition of an existing hotel,
restaurant, and single family residence; B) the construction of a 3-story, 104-room hotel; and
C) an amendment to the land use designation on property located at 3136 Carlsbad Boulevard
on the east side of Carlsbad Boulevard between Pine Avenue and Oak Avenue.
The project will have a positive impact in terms of increased property tax, transient occupancy
tax, and additional employment opportunities. The current assessed value of the project site
is $1,800,000. With the new construction, it is estimated that the assessed value will increase
to approximately $12 million. The increase in value would result in additional tax increment
revenue for the Carlsbad Redevelopment Agency of approximately $102,000 per year.
Additionally, the project may serve as a catalyst for other improvements in the area, either new
development or rehabilitation of existing buildings, through the elimination of a blighting
influence within the area. All public infrastructure required for this project will be funded and/or
constructed by the developer.
GPA 05-06
Aura Circle
GPA 05-06 is part of a project that consists of: A) an 11-lot subdivision (two open space lots
and nine residential lots); B) the construction of nine single-family residences and two second
dwelling units; and C) a change to the land use designation and zoning on a site located west
of Kelly Drive and north of Hillside Drive at the terminus of Aura Circle.
All public infrastructure required for this project will be funded and or/constructed by the
developer. No fiscal impacts to the City have been identified.

GPA 06-02 is part of a project that consists of: A) a 4-lot subdivision (MS 05-28); B) a Site
Development Plan to construct a 21,904 square foot office building on Lot 1 of MS 05-28; C) a
change to the land use designation and zoning on Lots 3 and 4 of MS 05-28; and D) a
modification to the boundaries of the land use designation and zoning on a portion of APN
255-012-05 to correct mapping errors (the project site is located northwest of Calle Barcelona,
west of El Camino Real, and north of Leucadia Boulevard).
All public infrastructure required for this project will be funded and or/constructed by the
developer. No fiscal impacts to the City have been identified.

The amendments to the Land Use Element and the Open Space and Conservation Element of
the General Plan are considered a project, and are therefore subject to CEQA. The
environmental analyses of the four projects that comprise the second amendments in 2007 to
the Land Use Element and Open Space and Conservation Element have been previously
conducted, and reviewed and certified by the City Council in accordance with CEQA
(described below). No additional environmental analysis is necessary.

9 WHEREAS, pursuant to Government Code Section 65358(b), no mandatory
10 element of the General Plan shall be amended more frequently than four times during any
11 calendar year, and any one of those four amendments may include more than one change to
12 the General Plan; and
13 WHEREAS, the Land Use Element and Open Space and Conservation Element
14 are mandatory elements of the General Plan; and
15 WHEREAS, pursuant to Government Code Section 65358, and the provisions of
^ the Carlsbad Municipal Code, the Planning Commission did, on March 7, 2007 (GPA 05-05),
17 May 2, 2007 (GPA 05-06), and January 3, 2007 (GPA 06-02), hold duly noticed public hearings
1 8 as prescribed by law to consider the proposed changes to the General Plan; and

WHEREAS, the Planning Commission adopted Planning Commission
20 Resolutions No. 6255, 6286, and 6214 recommending approval in concept of the proposed
21 changes to the General Plan; and
22 WHEREAS, the City Council did, on May 1, 2007 (GPA 05-05), June 26, 2007
23 (GPA 05-06), and February 20, 2007 (GPA 06-02), hold duly noticed public hearings to consider
24 the Planning Commission's recommendations and to hear all persons interested in the
25 proposed amendments to the General Plan and the related environmental reviews; and

WHEREAS, the City Council adopted City Council Resolutions No. 2007-096
27 (GPA 05-05), 2007-152 (GPA 05-06), and 2007-035 (GPA 06-02) approving in concept the
28 proposed changes to the General Plan; and
1 WHEREAS, the City Council of the City of Carlsbad wishes to consolidate the
2 changes to the Land Use Element and the Open Space and Conservation Element of the
3 General Plan as proposed by GPA 05-05, GPA 05-06, and GPA 06-02 into a single amendment
4 for each element constituting the second Land Use Element Amendment of 2007 and the
5 second Open Space and Conservation Element Amendment of 2007.
6 NOW, THEREFORE, BE IT RESOLVED, the City Council of the City of Carlsbad,
7 California, does hereby resolve as follows:
8 1. That the above recitations are true and correct.

2. That the findings of the City Council set forth in City Council Resolutions No.
1Q 2007-096, 2007-152, and 2007-035 (on file in the City Clerk's office) are made a part hereof by
reference.
3. That the second amendments to the Land Use Element and Open Space and
12 Conservation Element of the General Plan during calendar year 2007 are approved as shown
on the attached exhibits consisting of: a) 1 page titled "GPA 05-05 DKN HOTEL" (dated March
13 7, 2007), b) 1 page titled "GPA 05-06 GENERAL PLAN AMENDMENT AURA CIRCLE" (dated
January 9, 2007), and c) 1 page titled "GPA 06-02 LA COSTA GLEN CORPORATE CENTER"
14 (dated January 3, 2007).
15 EFFECTIVE DATE: The amendments to the Land Use Element and the Open
16 Space and Conservation Element shall become effective thirty (30) days following the adoption
17 of this resolution.
