RECOMMENDED ACTION:
Introduce Ordinance No.NS-857 to establish a prima facie 40 mile per hour speed limit
upon Town Garden Road from El Camino Real to Alicante Road.
ITEM EXPLANATION:
Town Garden Road is unclassified on the Circulation Element of the General Plan but functions as a
collector road. The street has a curb-to-curb width of 52 feet and the subject road segment is
0.34 miles in length. One lane of traffic is provided in each direction with lanes separated by a
two-way left turn lane that functions as a striped median in some locations. East of Alicante Road,
Town Garden Road has a posted speed limit of 25 miles per hour as it traverses a residence district.
Town Garden Road has a daily two-way traffic volume of 2,211 vehicles per day.
At their meeting on June 4, 2007, the Traffic Safety Commission considered the results of the
Engineering and Traffic Survey to establish a prima facie speed limit upon Town Garden Road.
The Commission recommended by a 4-0 vote that a 40 mile per hour prima facie speed limit be
established upon Town Garden Road from El Camino Real to Alicante Road.
The current version of the Engineering and Traffic Survey for Town Garden Road is on file in the
office of the City Traffic Engineer.
ENVIRONMENTAL IMPACT:
The installation of an official traffic control device is a project that is a Class 1 categorical exemption
(minor alteration of existing structure or facility) and is, therefore, exempt from the environmental
review process under the provisions of the California Environmental Quality Act (CEQA),
Section 15301(c).
FISCAL IMPACT:
Installing two speed limit signs upon Town Garden Road will cost about $250.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER 10.44,
OF THE CARLSBAD MUNICIPAL CODE BY THE ADDITION OF
4 SECTION 10.44.820 TO ESTABLISH UPON TOWN GARDEN ROAD
A PRIMA FACIE 40 MILE PER HOUR SPEED LIMIT FROM
5 EL CAMINO REAL TO ALICANTE ROAD.
6 The City Council of the City of Carlsbad, California, hereby ordains as follows:
7 SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
g by the addition of Section 10.44.820 to read as follows:
9 "10.44.820 Town Garden Road. Upon Town Garden Road from
El Camino Real to Alicante Road, the prima facie speed limit shall be
10 forty miles per hour."
H EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption; and
12 the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in
12 a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.
