RECOMMENDED ACTION:
If the City Council concurs, its action is to introduce Ordinance No. NS-858 adjusting Council
compensation which will become operative following the November 2008 election.
ITEM EXPLANATION:
State law provides that compensation of City Council Members may be increased by an
ordinance in an amount not to exceed 5% for each calendar year from the operative date of the
last salary adjustment. The operative date of the last City Council compensation adjustment
was following the general election of November 2006. The adjustment in Council compensation
will become effective following the November 2008 election in which one or more members of
the City Council become eligible for a new term of office. The proposed ordinance would adjust
the current compensation from $1,329 per month to $1,462 per month.
FISCAL IMPACT:
Increase in Council compensation as explained above. The increase would become effective
with the first pay period following the November 2008 election at which time one or more
members of the City Council become eligible to be seated.
ENVIRONMENTAL IMPACT:
This action is not a project within the meaning of CEQA and no further review is required.

CARLSBAD, CALIFORNIA, AMENDING TITLE 2, CHAPTER
2.04 OF THE CARLSBAD MUNICIPAL CODE BY THE

COMPENSATION OF THE MAYOR AND MEMBERS OF THE

NOW, THEREFORE, the City Council of the City of Carlsbad ordains
as follows:
8 SECTION I: That section 2.04.010 of the Carlsbad Municipal Code is

amended to read as follows:

CITY COUNCIL
(1) Each member of the city council shall receive as salary the sum of
six hundred dollars per month as authorized by Section 36516 of the Government
Code, for cities over seventy-five thousand and up to and including one hundred fifty
thousand in population plus the sum of eight hundred and sixty-two dollars ($862)
per month, which represents the total of increases of five percent per year for each
calendar year from the operative date of the last adjustment of salary, for a total of
one thousand four hundred sixty-two dollars ($1462) per month payable at the same
time and in the same manner as salaries are paid to other officers and employees of
the city.
(2) The salaries established by this section are exclusive of any
amounts payable to each member of the city council as reimbursement for actual
and necessary expenses incurred in the performance of official duties for the city.
(3) This section shall become operative only on and after the date upon
which one or more members of the city council become eligible pursuant to Section
20 36516.5 of the Government Code for a salary increase by virtue of beginning a new
term of office following adoption of this section.

EFFECTIVE DATE: This ordinance shall be effective thirty days after
23 its adoption; and the city clerk shall certify the adoption of this ordinance and cause it

to be published at least once in a newspaper of general circulation in the City of
25
Carlsbad within fifteen days after its adoption.
