CITY MGR. {jj^^ RECOMMENDED ACTION: Adopt Resolution No. 2007-253 rejecting the bids and approving revised contract documents, special provisions and specifications, and authorizing the City Clerk to advertise for bids to perform Traffic Signal UPS and Battery Backup Installation. ITEM EXPLANATION: On April 24, 2007, Council adopted Resolution 2007-090 adopting plans and specifications and authorized the City Clerk to advertise for bids. On June 28, 2007 seven bids were received, opened and recorded. The result of the seven bids received follow: US Energy: TDS Engineering: Republic ITS: Sutherlin Contracting: Moore Electric: Select Electric: T&M Electric: $118,999.14 $136,602.00 $142,380.00 $144,354.06 $144,355.32 $157,680.00 $171,000.00 Staff subsequently reviewed the bid documents and determined that although our specification of certain equipment manufacturers implied the City of Carlsbad's requirement that any system submitted by bidders have a minimum time period of use in traffic signal applications, this requirement was not clearly indicated in the Contract. General Services staff subsequently met with the City Traffic Engineering staff and determined that it is in the best interest of the City to revise the specifications and re-bid the agreement. The installation of uninterruptible power sources in traffic signals is a safety critical application. Any system that has not had a track record of use in this application is suspect and could result in additional liability to the City of Carlsbad if an untested system installed were to fail or not perform in accordance with the requirements. Requiring that a system have a proven track record in this safety critical application would not prevent alternative manufacturers from the specified system, however it would insure that any system submitted by bidders has been fully tested and can be compared fairly. In addition to the above described issue, staff has determined that the budget for FY 07-08 included funding to retrofit an additional fifteen intersections with uninterruptible power sources. Staff recommends adding the additional work to the original agreement to reduce administrative overhead, encourage competitive bids due to economy of scale and reduce inspection costs. Staff recommends that Council reject the bids and approve the revised plans and specifications and authorize the City Clerk to advertise for bids. FOR CITY CLERKS USE ONLY. FISCAL IMPACT: BATTERY BACKUP SYSTEMS AT TRAFFIC SIGNALS PROJECT SUMMARY Construction Contract Contingency TOTAL ESTIMATED PROJECT COST $250,000 $10,000 $260,000 The total project cost is estimated at $260,000, which includes $10,000 for project contingency. Sufficient funds have been appropriated in the City's General Fund, Traffic Signals Department budget and CIP budget to complete the project. EXHIBITS: 1. CONTRACT NO. PWGS 316R WHEREAS, the City Council adopted Resolution No. 2007-090 approving contract 8 documents, special provisions and specifications, and authorized the City Clerk to advertise for 9 bids to Install Uninterruptible Power Sources and Battery Backup Systems in Traffic Signals, 10 hereinafter referred to as the "Project;" and 11 WHEREAS, said bids were received, opened, witnessed and recorded on June 28, 12 2007; and 13 WHEREAS, in accordance with Section 22038 of the Public Contract Code, the City has 14 the authority to reject all and any bids without cause; and 15 WHEREAS, the City Council hereby finds it necessary, desirable, and in the public 16 interest to reject all bids received by the City on June 28, 2007 for said Project; and 17 WHEREAS, the revised contract documents, special provisions and specifications for 18 the furnishing of all labor, material and equipment necessary to Install Uninterruptible Power 19 Sources and Battery Backup Systems in Traffic Signals, Contract No. PWGS316R, have been 20 prepared and are on file in the Public Works/General Services office and are incorporated by 21 reference herein; and 22 WHEREAS, sufficient funds are available for this project in the Traffic Signals 23 Department budget and CIP budget. 24 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, 25 California, as follows: 26 1. That the above recitations are true and correct. 27 28 1 2. That the City Council does hereby reject all bids received by the City on June 28, 2 2007 for the Project. 3 3. That the revised contract documents, special provisions, and specifications on file in 4 the Public Works/General Services office are hereby approved. 5 4.
