FOR THE CONSTRUCTION OF A TRAFFIC SIGNAL AT
POINSETTIA LANE AND BLACK RAIL ROAD,

RECOMMENDED ACTION:
Adopt Resolution No. 2007-270 accepting bids and awarding a contract for the construction of
the traffic signal at Poinsettia Lane and Black Rail Road, Project No. 3939-1.
ITEM EXPLANATION:
On August 24, 2007, the City Council approved the plans and specifications for the traffic signal at
Poinsettia Lane and Black Rail Road, and directed the City Clerk to advertise for construction bids.
On September 11, 2007, the following four (4) sealed bids were received:
T&M Electric, Inc.
Steiny & Company, Inc.
Select Electric, Inc.
Lekos Electric, Inc.

ENVIRONMENTAL IMPACT:
This project is a Class 1 categorical exemption (minor alteration of existing structure or facilities)
and is, therefore, exempt from the environmental review process under provisions of the
California Environmental Quality Act (CEQA), Section 15301 (c). A Notice of Exemption has been
issued by the Planning Director.
FISCAL IMPACT:
The engineer's estimate for construction was $150,000. The project cost breakdown is as follows:

Funds from the General Capital Construction Fund in the amount of $210,000 have been
previously appropriated. Due to current economic conditions, construction costs for traffic signal
installation have increased significantly since funds were originally budgeted for this project.
Sufficient funds are not currently available in the project account for construction of these
improvements. Therefore, staff recommends the appropriation of additional funds from the
General Capital Construction Fund in the amount of $26,991 in order to complete Project No.
3939-1.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING
A CONTRACT FOR THE CONSTRUCTION OF THE
4 POINSETTIA LANE AND BLACK RAIL ROAD TRAFFIC SIGNAL,
PROJECT NO. 3939-1.

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
6
necessary, desirable, and in the public interest to construct a traffic signal at the intersection of
Poinsettia Lane and Black Rail Road; and

WHEREAS, four (4) sealed bids were received on September 11, 2007 for the project:

WHEREAS, the lowest responsive, responsible bid for the project was submitted by11
T&M Electric, Inc., in the amount of $190,000; and12
WHEREAS, additional funds in the amount of $26,991 need to be appropriated in order\ o
to construct the traffic signal at Poinsettia Lane and Black Rail Road.14
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,15
California, as follows:16
1. That the above recitations are true and correct.17
2. That the low bid submitted by T&M Electric, Inc., in the amount of $190,000, is18
hereby accepted and the Mayor is hereby authorized to execute a contract on behalf of the City for
the construction of the traffic signal at Poinsettia Lane and Black Rail Road.
3. That the Finance Director is hereby authorized to appropriate $26,991 from the
22 General Capital Construction Fund to Project No. 3939-1 for completion of this project.
23 4. That the City Manager is hereby authorized to approve construction change
24 orders up to $28,500 for Project No. 3939-1.

PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council
of the City of Carlsbad on the 9th day of October, 2007, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall and Packard.
NOES: None.
ABSENT: Nygaard.
