RECOMMENDED ACTION:
Introduce Ordinance No.NS-865 to establish a prima facie 40 mile per hour speed limit
upon Alicante Road from Poinsettia Lane to its intersection with Gateway Road.
ITEM EXPLANATION:
An existing segment of Alicante Road constructed south of Poinsettia Lane was extended northerly
from Poinsettia Lane to Gateway Road and opened to traffic the past two years. This new portion of
Alicante Road does not have an established prima facie speed limit. It serves residential units and the
industrial park located in Bressi Ranch and is 0.96 miles in length. The subject two-lane segment of
Alicante Road is unclassified in the Circulation Element of the General Plan and has a curb-to-curb
width of 40 feet. Sidewalks have been constructed on the east side with a combination of sidewalk
and a walking trail on the west side. Traffic counts obtained in March 2007 found the two-way 24-hour
traffic volumes on Alicante Road north of Poinsettia Lane to be about 800 vehicles. Alicante Road has
a posted speed limit of 40 miles per hour beginning at Poinsettia Lane and continuing southerly to
Corte de la Vista.
Sections 22357 and 22358 of the California Vehicle Code authorize local authorities to establish a
prima facie speed limit on the basis of the results of an Engineering and Traffic Survey.
The Engineering and Traffic Survey considers such factors as the number of collisions that have
occurred on the road segment, roadway features, adjacent land uses, driveway locations, traffic
volumes, pedestrian volumes, critical speed, horizontal and vertical alignment, stopping sight distance,
and conditions that may not be readily apparent to the driver.
At their meeting on June 4, 2007, the Traffic Safety Commission considered the results of the
Engineering and Traffic Survey to establish a prima facie speed limit upon the subject portion of
Alicante Road. The Commission recommended by a 4-0 vote that a 40 mile per hour prima
facie speed limit be established upon Alicante Road from Poinsettia Lane to its intersection with
Gateway Road.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic
Engineer.
ENVIRONMENTAL IMPACT:
The installation of an official traffic control device is a project that is a Class 1 categorical exemption
(minor alteration of existing structure or facility) and is, therefore, exempt from the environmental
review process under the provisions of the California Environmental Quality Act (CEQA),
Section 15301(c).
FISCAL IMPACT:
Installing six speed limit signs upon Gateway Road will cost about $750.

10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
REVISION OF SECTION 10.44.210 TO ESTABLISH A PRIMA
FACIE 40 MILE PER HOUR SPEED LIMIT UPON ALICANTE
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
by the revision of Section 10.44.210 to read as follows:
"10.44.210 Alicante Road:
a. Upon Alicante Road from Alga Road to its intersection with
Corte de la Vista, the prima facie speed limit shall be forty miles per

b. Upon Alicante Road from Alga Road to its intersection with
Poinsettia Lane, the prima facie speed limit shall be forty miles per
