RECOMMENDED ACTION:
Adopt Ordinance No. NS-864 amending Title 10, Chapter 10.44 of the Carlsbad Municipal
Code, by the addition of Section 10.44.830 to establish a prima facie 40 mile per hour speed
limit on Gateway Road, from El Camino Real to its intersection with El Fuerte Street.
ITEM EXPLANATION:
Ordinance No. NS-864 was introduced and first read at the City Council meeting held on
November 6, 2007. The second reading allows the City Council to adopt the ordinance,
which would then become effective in thirty days. The City Clerk will have the ordinance
published within fifteen days of adoption of the ordinance.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
ADDITION OF SECTION 10.44.830 TO ESTABLISH UPON
GATEWAY ROAD A PRIMA FACIE 40 MILE PER HOUR SPEED
LIMIT FROM EL CAMINO REAL TO ITS INTERSECTION WITH EL
FUERTE STREET.

The City Council of the City of Carlsbad, California, hereby ordains as follows:

SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
8 by the addition of Section 10.44.830 to read as follows:
9 "10.44.830 Gateway Road. Upon Gateway Road from El Camino
Real to its intersection with El Fuerte Street, the prima facie speed
limit shall be forty miles per hour."
EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption;
12 and the City Clerk shall certify the adoption of this ordinance and cause it to be published at least
13 once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its
14 adoption.

INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on
the 6th day of November, 2007, and thereafter.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
City of Carlsbad on the 13th day of November, 2007, by the following vote:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Nygaard.
NOES: None.
