ITEM EXPLANATION:
On October 29, 2007 the City Council ratified the Declaration of a Local Emergency that had
been declared by the Interim City Manager on October 22, 2007 due to the numerous
wildfires that were burning throughout San Diego County. The Council received an update
from staff on the City's response on Tuesday, November 6, 2007.
State law requires that the Council review the status of the local emergency and extend it until
it is terminated and there is no longer a need for emergency powers and that the situation has
resulted in conditions which are now deemed to be within the control of the normal protective
services, personnel, equipment and facilities of the City. Staff has found that conditions are

City. If Council deems it appropriate, staff will present a report on the scope of this
emergency, the responses to it and the necessity and appropriateness of future response
actions.
FISCAL IMPACT:
At this time the fiscal impact is unknown. The City Manager, through the Finance
Department has asked City staff to track fire related expenses. A report and final accounting
of the total costs and reimbursements will be presented to the City Council when they are
known.
ENVIRONMENTAL IMPACT:
Emergency projects are statutorily exempt from CEQA pursuant to CEQA Guidelines section
15269.

3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, TERMINATING THE EXISTENCE OF
4 A LOCAL EMERGENCY

WHEREAS, on October 21, 2007, a series of wildfires began in San Diego County;
6
and
7
WHEREAS, it was necessary to mobilize City staff to protect Carlsbad and the
8
surrounding communities from the dangers created by the wildfires; and
9
WHEREAS, local forces in the County of San Diego were insufficient to respond to
10
such emergency and additional resources from the State of California were requested; and
WHEREAS, the Governor of the State of California declared a state of emergency12
on October 22, 2007; and13
WHEREAS, on October 22, 2007 the interim City Manager declared a state of Local14
Emergency due to the threat posed by the wildfires; and

WHEREAS, on October 29, 2007, at a Special Meeting, the City Council ratified the16
state of Local Emergency declared by the interim City Manager by Resolution No. 2007.284: and
WHEREAS, said Local Emergency has been abated and there is no need for the18
state of Local Emergency to continue.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
21 Carlsbad, California, as follows:
22 1 • That the above recitations are true and correct.
23 2. The Declaration of Emergency is hereby terminated according to State law.
