RECOMMENDED ACTION:
Adopt Resolution No. 2007-308 accepting the contract for construction of Station 5 Storage
Building and Skate Park Restrooms, Project No. 3688 as complete, and directing the City Clerk to
record a Notice of Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On July 15, 2003, MSC International was awarded a contract in the amount of $232,273 for the
Station 5 Storage Building and Skate Park Restrooms, Project No. 3688.
MSC International defaulted on the contract and did not complete the work. On May 19, 2006,
a Takeover Agreement was executed between the City of Carlsbad and American Contractors
Indemnity Company (ACIC), MSC International's insurance company.
ACIC substantially completed construction on November 9, 2006, and completed the punch list work
on March 28, 2007. A change order with deleted and diminished value items was executed
on September 4, 2007. City staff has inspected the work and found it to be satisfactory.
Staff recommends formal acceptance of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONTRACT FOR
CONSTRUCTION OF STATION 5 STORAGE BUILDING AND
4 SKATE PARK RESTROOMS, PROJECT NO. 3688, AS
COMPLETE.

WHEREAS, the construction of the Station 5 Storage Building and Skate Park

Restrooms was substantially completed on November 9, 2006, all punch list work was completed
7
on March 28, 2007, and the final change order was executed on September 4, 2007; and
8
WHEREAS, the work was awarded to and begun by MSC International; and
9
WHEREAS, MSC International defaulted on the contract; and
10
WHEREAS, a takeover agreement was executed on May 19, 2006 with
MSC International's surety company, American Contractors Indemnity Company; and
WHEREAS, the work was completed to the City's satisfaction by American Contractors

WHEREAS, the formal project Notice of Completion has been prepared; and

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:1o

20 2. That the Station 5 Storage Building and Skate Park Restrooms, specifically
21 identified as Project No. 3688, is deemed complete and is hereby accepted by the City Council of
22 the City of Carlsbad.
23 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
24 execute and record the Notice of Completion for Station 5 Storage Building and Skate Park
25 Restrooms, Project No. 3688.
