CONTRACT FOR CONSTRUCTION OF THE RANCHO SANTA
FE ROAD FILL FAILURE AT AGUA DULCE PROJECT,

RECOMMENDED ACTION:
Adopt Resolution No.2007-309 accepting the contract for construction of the Rancho Santa
Fe Road Fill Failure at Agua Dulce, Project No. 1001 (FHWA Project No. KJK-CBD-001-2) as
complete, and directing the City Clerk to record a Notice of Completion and release bonds in
accordance with State Law and City Ordinances.
ITEM EXPLANATION:
At an emergency meeting of the City Council held on March 18, 2005, the City Council adopted
Resolution No. 2005-089 authorizing emergency repairs to the slope adjacent to Rancho Santa Fe
Road and Agua Dulce Court. Emergency work commenced immediately and a Public Works contract
was executed with Erreca's, Inc.
The repairs at Agua Dulce for which Erreca's, Inc. was responsible for were substantially completed
on August 1, 2006. The final punch list work was completed on July 30, 2007. City staff has inspected
the work and found it to be satisfactory. Staff recommends formal acceptance of the slope repair work
by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.
FISCAL IMPACT:
The table below shows the construction costs for the Rancho Santa Fe Road Fill Failure at Agua
Dulce, Project 1001 (FHWA Project No. KJK-CBD-001-2):

CONSTRUCTION OF THE RANCHO SANTA FE ROAD FILL

(FHWA PROJECT NO. KJK-CBD-001-2) AS COMPLETE.

WHEREAS, the construction of the Rancho Santa Fe Road Fill Failure at Agua Dulce

project was substantially completed on August 1, 2006, and all punch list work was completed on
7
July 30, 2007; and
8
WHEREAS, all work has been completed to the City's satisfaction by Erreca's, Inc.; and
9
WHEREAS, the formal project Notice of Completion has been prepared; and
10
WHEREAS, all project costs have been established to date.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:13
,, 1. That the above recitations are true and correct.
15 2. That the Rancho Santa Fe Road Fill Failure at Agua Dulce project, specifically
16 identified as Project No. 1001 (FHWA Project No. KJK-CBD-001-2), is deemed complete and is
1 7 hereby accepted by the City Council of the City of Carlsbad.
18 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
19 execute and record the Notice of Completion for the Rancho Santa Fe Road Fill Failure at Agua
20 Dulce project, Project No. 1001 (FHWA Project No. KJK-CBD-001-2).
