(jl/—— NS-866 to establish a prima facie 40 mile per hour speed limit RECOMMENDED ACTION: Introduce Ordinance No. upon Armada Drive from Palomar Airport Road to LEGOLAND Drive. ITEM EXPLANATION: In 1997, a prima facie speed limit of 35 miles per hour was established upon Armada Drive. Current requirements outlined in the California Manual on Uniform Traffic Control Devices specifies the prima facie speed limit should be established at the nearest five mile per hour increment to the 85th percentile speed (critical speed). The critical speed is the speed at which 85% of the vehicles are traveling at or below. It is permissible, however, to have a further reduction of five miles per hour below the nearest five mile per hour speed to the critical speed to match existing conditions with safety needs. A speed survey conducted at two locations on Armada Drive found the critical speeds to be 45 miles per hour and 41 miles per hour. These existing critical speeds would result in the current posted speed limit of 35 miles per hour being unenforceable using radar. Expected changes to the California Manual on Uniform Traffic Control Devices in 2008 will require that in no case shall the posted speed limit be below the 50th percentile speed on the roadway. The 35 mile per hour speed limit that is posted on Armada Drive is at the 37th percentile speed for the speed survey having a critical speed of 41 miles per hour and at the 11th percentile speed for the speed survey having a critical speed of 45 miles per hour. On November 5, 2007, after considering the results of the Engineering and Traffic Survey, including all roadway factors and pedestrian safety, the Traffic Safety Commission recommended by a 5-0 vote that the prima facie speed limit upon Armada Drive be established at 40 miles per hour from Palomar Airport Road to LEGOLAND Drive. The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic Engineer. ENVIRONMENTAL IMPACT: The installation of an official traffic control device is a project that is a Class 1 categorical exemption (minor alteration of existing structure or facility) and is, therefore, exempt from the environmental review process under the provisions of the California Environmental Quality Act (CEQA), Section 15301(c).
