RECOMMENDED ACTION:
Introduce Ordinance No. NS-867 to establish a prima facie 40 mile per hour speed limit
upon Marron Road from El Camino Real to the city limits at Highway 78.
ITEM EXPLANATION:
Marron Road, a secondary arterial on the Circulation Element, is 1.01 miles in length between
El Camino Real and the east city limits at Highway 78. It is a four-lane roadway with a posted speed
limit of 35 miles per hour.
In accordance with criteria contained in the California Manual on Uniform Traffic Control Devices,
speed limits should be posted at the nearest five mile per hour increment to the 85th percentile speed
(critical speed) that is established by a speed survey. The critical speed is the speed at which 85% of
the vehicles are traveling at or below.
Staff conducted speed surveys on Marron Road in two locations and found the critical speeds to be
43 miles per hour and 44 miles per hour. Based upon existing conditions and the safety needs of the
roadway corridor, the Engineering and Traffic Survey supports the establishment of a prima facie
40 mile per hour speed.
At their meeting November 5, 2007, the Traffic Safety Commission considered the results of the
Engineering and Traffic Survey to establish a prima facie speed limit upon the subject portion of
Marron Road. The Commission recommended by a 4-1 vote that a 40 mile per hour prima facie speed
limit be established upon Marron Road from El Camino Real to the city limits at Highway 78.
The current version of the Engineering and Traffic Survey is on file in the office of the City Traffic
Engineer.
ENVIRONMENTAL IMPACT:
The installation of an official traffic control device is a project that is a Class 1 categorical exemption
(minor alteration of existing structure or facility) and is, therefore, exempt from the environmental
review process under the provisions of the California Environmental Quality Act (CEQA), Section
15301(c).
FISCAL IMPACT:
Replacing four speed limit signs upon Marron Road will cost about $500.

The City Council of the City of Carlsbad, California, hereby ordains as follows:

SECTION 1: That Title 10, Chapter 10.44, of the Carlsbad Municipal Code is amended
8
by the revision of Section 10.44.130 to read as follows:
9 "10.44.130 Marron Road.
(a) Upon Marron Road from 140 feet east of Avenida de Anita
to its intersection with El Carhino Real, the prima facie speed limit
shall be thirty-five miles per hour.
12 (b) Upon Marron Road from El Camino Real to the city limits at
Highway 78, the prima facie speed limit shall be forty miles per
hour."
14 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption;
and the City Clerk shall certify the adoption of this ordinance and cause it to be published at least
once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its
