ACCEPTANCE OF PROJECT TO INSTALL A SYNTHETIC
TURF ATHLETIC FIELD AT STAGECOACH PARK

RECOMMENDED ACTION:
Adopt Resolution No. 2007-318 accepting the work in accordance with Contract No. 39371,
Project No. PKS 04-03, Stagecoach Park Synthetic Turf Field as complete, and direct the City Clerk to
have the Notice of Completion recorded and release bonds in accordance with State Law and City
Ordinances.
ITEM EXPLANATION:
On July 19, 2005, the City Council adopted Resolution No. 2005-231 awarding Contract No. 39371,
Project No. PKS 04-03, to Western Rim Constructors, Inc. for $1,452,737 and authorized $150,000 in
contingency funds to construct a synthetic turf field at Stagecoach Park.
Although the construction phase of the project was completed on time, several important issues
prevented the City from recording the Notice of Completion and releasing project retention.
The synthetic turf subcontractor failed to provide the City with three contractually required items.
The items required, but not submitted, included a bond or insurance policy guaranteeing that surety or
insurance company would repair or replace any deficient items for a minimum of eight years after
project acceptance, an appropriate warranty document covering all issues in accordance with the
agreement for a period of eight years, and a roll of spare tan infield turf that would allow the City to
make any repairs to the field as needed. General Services and the Prime Contractor, Western Rim
Constructors, Inc., repeatedly notified the subcontractor of the outstanding issues and the City notified
the bonding company of the discrepancies. Numerous letters were sent to all parties by the project
manager detailing the outstanding issues. The City successfully procured the warranty and the
insurance policy several months after the completion of the construction, however, the turf
subcontractor failed to deliver the spare turf until November 2, 2007.
At this time, all outstanding items have been received and the retention has been released.
The synthetic turf field has been inspected by staff and is acceptable to the Public Works Manager,
General Services.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

The total construction cost for this project is $1,521,700. Change orders for the project totaled $68,963
of the approved contingency total of $150,000. Change Orders included relocation of existing irrigation
mains, remediation of unsuitable materials, installation of vehicle barriers, repairs to the baseball backstops
and installation of additional concrete surface improvements.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE WORK AS
COMPLETE AND DIRECTING THE RECORDATION OF THE
4 NOTICE OF COMPLETION FOR STAGECOACH PARK SYNTHETIC
TURF FIELD. CONTRACT NO. 39371. PROJECT NO. PKS 04-03.

WHEREAS, the City Council adopted Resolution No. 2004-352 approving contract
6
documents, special provisions and specifications, and authorized the City Clerk to advertise for
7
bids to perform Contract No. 39371, Project No. PKS 04-03, Stagecoach Park Synthetic Turf Field,
8
hereinafter referred to as the "Project;" and
9
WHEREAS, the City Council has previously awarded a contract for the Project; and
10
WHEREAS, the Project work has been satisfactorily completed; and
11
WHEREAS, a Notice of Completion has been prepared for the Project; and
12
WHEREAS, the City Council hereby finds it necessary, desirable, and in the public interest
13
to accept the completed work to perform Contract No. 39371, Project No. PKS 04-03, Stagecoach
14
Park Synthetic Turf Field.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

California, as follows:

1. That the above recitations are true and correct.

2. That the completed work is hereby accepted and the City Clerk is directed to record the

Notice of Completion and to release bonds in accordance with State Law and City Ordinances.
