RECOMMENDED ACTION:
Adopt Resolution No. 2008-023 accepting bids and awarding the contract for construction of
the Cynthia Lane Storm Drain, Project No. 6601.
ITEM EXPLANATION:
The Cynthia Lane Storm Drain is located at the west end of Cynthia Lane and extends westward to
Pio Pico Drive approximately 250 feet. The project is designed to improve storm water drainage from
Cynthia Lane to Pio Pico. The project consists of installing a new curb inlet and storm drain pipe,
replacing a deteriorated section of corrugated metal pipe, and installing a cured-in-place pipe liner.
On December 19, 2007, twenty (20) bids were received for the construction of the Cynthia Lane Storm
Drain. The apparent low bidder, Bert W. Salas Inc., made a mathematical error in totaling their bid.
After the error was corrected, the actual low bidder was Southwest Civil Contracting. The bids are

The lowest responsive bidder, Southwest Civil Contracting, submitted a bid in the amount of $93,649.
Staff has completed its review of the contract documents and has determined that they are in order.
Therefore, staff recommends that Southwest Civil Contracting be awarded the contract.

ENVIRONMENTAL IMPACT:
This project is exempt from environmental review as a minor alteration of an existing public facility
under Sections 15301(b) and 15304(f) of the California Environmental Quality Act.
FISCAL IMPACT:
The Engineer's Estimate for the construction contract was $159,000. The construction bids ranged
from $93,649 to $154,530.

The total estimated cost is $143,820 for the Cynthia Lane Storm Drain, Project No. 6601. The Capital
•Improvement Program has allocated $248,000 for this project; therefore, sufficient funds are available
to complete the Cynthia Lane Storm Drain Improvements.

3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, ACCEPTING BIDS AND AWARDING A
4 CONTRACT FOR CONSTRUCTION OF THE CYNTHIA LANE
STORM DRAIN IMPROVEMENTS. PROJECT NO. 6601.

WHEREAS, the City Council of the City of Carlsbad, California, has determined it
6
necessary, desirable, and in the public interest to construct the Cynthia Lane Storm Drain
7
Improvements; and
8
WHEREAS, the project is exempt from the California Environmental Quality Act pursuant
9
to CEQA Sections 15301(b) and 15304(f); and
10
WHEREAS, on November 6, 2007, through the adoption of Resolution No. 2007-287,
the City Council approved plans and specifications for furnishing of all labor, materials, tools,12
equipment, transportation, and other expenses necessary or incidental to the Cynthia Lane Storm

WHEREAS, twenty (20) sealed bids were received on December 19, 2007 for the

WHEREAS, the lowest responsive, responsible bid for the project was submitted by
Southwest Civil Contracting, in the amount of $93,649; and18
WHEREAS, Capital Improvement Program funds in the amount of $248,000 arei y
available for construction of the project in the 2007-08 Fiscal Year; and
21 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
22 California, as follows:
23 1. That the above recitations are true and correct.
24 2. That the bid submitted by Southwest Civil Contracting, in the amount of $93,649
25 is hereby accepted and the Mayor is hereby authorized to execute the contract for the construction

3. That the City Manager is hereby authorized to approve construction change
orders up to the contingency amount of $15,000 to Southwest Civil Contracting, for the Cynthia
Lane Storm Drain, Project No. 6601.
4. That the award of this contract is contingent upon Southwest Civil Contracting,
executing the required contract and submitting the required bonds and insurance policies,
as described in the contract, within twenty (20) calendar days of adoption of this resolution.
The City Manager may grant reasonable extensions of time.
