RECOMMENDED ACTION:
Adopt Resolution No. 2008-043 accepting the contract for construction of the 2007 Concrete
Replacement, Project No. 6013, and direct the City Clerk to record a Notice of Completion and
release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On February 13, 2007, D.G. Yeager Construction Company was awarded a contract in the amount of
$105,831.50 for the 2007 Concrete Replacement, Project No. 6013.
D.G. Yeager Construction Company substantially completed the concrete work on July 25, 2007. A
final negotiated change order resolving all claims for disputed work was fully executed on January 31,
2008. City staff has inspected the work and found it to be satisfactory. Staff recommends acceptance
of the improvements by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

5. A work or improvement on the property hereinafter described was substantially completed on July 25,

WHEREAS, the construction of the 2007 Concrete Replacement was substantially

completed on July 25, 2007; and
6
WHEREAS, all work has been completed to the City's satisfaction by D.G. Yeager
Construction Company; and

WHEREAS, the formal project Notice of Completion has been prepared; and
9
WHEREAS, all project costs have been established to date.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,11
California, as follows:12
13 1. That the above recitations are true and correct.
14 2. That the 2007 Concrete Replacement, specifically identified as Project No. 6013,
15 is deemed complete and is hereby accepted by the City Council of the City of Carlsbad.
16 3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
17 execute and record the Notice of Completion for the 2007 Concrete Replacement, Project No.
18 6013.
