RECOMMENDED ACTION: Adopt Resolution No. 2008-056 ITEM EXPLANATION: Robert L. Nielsen, Trustee under Declaration of Trust dated November 15, 1985, owner of the property located at 381 and 391 Oak Avenue, has requested to vacate 10 feet of public right-of-way ajong the property's street frontage. The property is generally located along Oak Avenue, between Lincoln Street and Washington Street. The APN numbers are 203-260-07 and APN 203-260-12. Streets and Highways Code Section 8334(a) authorizes the summary vacation of excess right-of-way of a street or highway not required for street or highway purposes. Currently, Oak Avenue has an 80-foot wide right-of-way at this location. Oak Avenue is considered a local street. The standard right-of-way width for a local street is 60 feet. Therefore, the 80-foot width is excessive. As proposed, the street vacation will have no effect on the ultimate curb-to-curb width of the street. Staff has concluded that the excess right-of-way is not required for present or future street purposes. The vacation would not affect vehicular or non-motorized traffic circulation or the availability of street parking. The street vacation is considered to be minor, and is consistent with previously-approved street vacations in the same general location. The utility companies have been notified of this street vacation request. Time Warner Cable responded that they have facilities in the area and requested the reservation of an easement for these facilities. Therefore, a public utility easement will be reserved in the area being vacated. ENVIRONMENTAL IMPACT: The activity is exempt from California Environmental Quality Act (CEQA) review per CEQA Sectipn 15061(b)3 as it can be seen with certainty that approving the street vacation will not have a significant effect on the environment in that the vacation will not physically alter the site. FISCAL IMPACT: Approval of this street vacation will result in approximately 797 square feet of land to be returned to the tax rolls. While no detailed economic analysis was conducted, there will be an increase in tax revenue resulting from the vacation and any subsequent development that may benefit from said vacation. The right-of-way for Oak Avenue was dedicated to the City at no cost and the City will vacate the right-of-way at no cost to the property owner. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. Easements and rights necessary to maintain, operate, replace, remove or renew in-place public utility facilities are reserved and excepted from the vacation. 1 3. That pursuant to Division 9, Part 3, Chapter 4 of the California Streets and 2 Highway Code, said excess right-of-way more particularly described in Exhibit A and shown for the 3 sake of clarity in Exhibit B, shall be summarily vacated. 4. The City Clerk is directed to record this resolution, the attached legal description and plat in the Office of the County Recorder of San Diego County. 5 5.
