RECOMMENDED ACTION:
Introduce Ordinance No.NS-886 _ to establish no parking seven days a week from
12:00 midnight to 5:00 a.m. on a portion of Celinda Drive and on Kimberly Court, Shawn Court, and
Dana Court.
ITEM EXPLANATION:
At the City Council meeting on April 1, 2008, the President of the Brentwood Heights Homeowners
Association and several residents of the Brentwood Heights subdivision presented their concerns that
result when vehicles are parked on a portion of Celinda Drive, a public street. The concerns centered
around trash strewn on the street, noise late at night, inoperable vehicles being worked on in the
street, vehicles partially blocking driveways, oil leaking from parked vehicles, and verbal abuse of
residents by vehicle operators after they park their vehicle, among other issues. To address the
concerns, the residents requested that a parking restriction be implemented from 12:00 midnight to
5:00 a.m., seven days a week. The request of the homeowners association included both sides of
Celinda Drive from Carlsbad Village Drive southerly to the south property line of 3481 Celinda Drive
and 3482 Celinda Drive, Kimberly Court, Shawn Court, and Dana Court. The parking restriction at
night would apply to the designated streets within the Brentwood Heights subdivision.
Upon consideration of the testimony and materials presented by the residents, the City Council
concurred that a parking restriction from 12:00 midnight to 5:00 a.m. would be appropriate. The City
Council, by a 5-0 vote, directed staff to return with documents to implement no parking from
12:00 midnight to 5:00 a.m., seven days a week, on both sides of Celinda Drive from Carlsbad Village
Drive to the southerly property lines of 3481 Celinda Drive and 3482 Celinda Drive, and on the three
cul-de-sac streets of Kimberly Court, Shawn Court, and Dana Court.
The City Council further directed staff to initiate two actions:
• Install red curb on the west side of Celinda Drive at its intersection with Carlsbad Village Drive.
• Forward a report to City Council six months after the ordinance to restrict parking at night
becomes law that documents the effectiveness of the restriction and/or other associated
problems that may have resulted.
A work order has been issued to install the red curb.
ENVIRONMENTAL IMPACT:
The installation of an official traffic control device is a project that is a Class 1 categorical exemption
(minor alteration of existing structure or facility) and is exempt from the environmental review process
under the provisions of the California Environmental Quality Act (CEQA), section 15301(c).

FISCAL IMPACT:
Installing approximately 40 signs with time restrictions indicated will cost about $6,000.
Sufficient funds are available in the Public Works Streets Department budget.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.40, OF THE CARLSBAD MUNICIPAL CODE TO DECLARE
4 NO PARKING ON VARIOUS STREETS FROM 12:00 MIDNIGHT
TO 5:00 A.M.. SEVEN DAYS A WEEK.

The City Council of the City of Carlsbad, California, hereby ordains as follows:

SECTION 1: That Title 10, Chapter 10.40 of the Carlsbad Municipal Code is amended
7 by the addition of Section 10.40.166 to read as follows:

"10.40.166 Parking Time Limit on a Portion of Celinda Drive.
q When authorized signs are in place giving notice thereof, no person
shall stop, stand or park any vehicle on Celinda Drive
from Carlsbad Village Drive to the south property line of
.. 3481 Celinda Drive and 3482 Celinda Drive, seven days a week
between the hours of 12:00 midnight and 5:00 a.m."
SECTION 2: That Title 10, Chapter 10.40 of the Carlsbad Municipal Code is amended
by the addition of Section 10.40.167 to read as follows:
14 "10.40.167 Parking Time Limit on Kimberlv Court.
15 When authorized signs are in place giving notice thereof, no person
shall stop, stand or park any vehicle on Kimberly Court, seven days
16 a week between the hours of 12:00 midnight and 5:00 a.m."
17 SECTION 3: That Title 10, Chapter 10.40 of the Carlsbad Municipal Code is amended
18 by the addition of Section 10.40.168 to read as follows:
19 "10.40.168 Parking Time Limit on Shawn Court.

shall stop, stand or park any vehicle on Shawn Court, seven days a
week between the hours of 12:00 midnight and 5:00 a.m."
22 SECTION 4: That Title 10, Chapter 10.40 of the Carlsbad Municipal Code is amended
by the addition of Section 10.40.169 to read as follows:

EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption; and
the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in
a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.
