RECOMMENDED ACTION:
That the City Council ADOPT Resolution No. 2008-127 , APPROVING the first amendment to the
Land Use Element of the General Plan in 2008, consisting of one project commonly known as "Bressi
Ranch Medical Plaza" (GPA 07-07).
ITEM EXPLANATION:
State law allows a jurisdiction to amend a mandatory element of the General Plan no more than four
times per calendar year. The mandatory elements are Land Use, Circulation, Housing, Open Space,
Noise, Safety, and Conservation. Each amendment to a mandatory element, however, may include
more than one change to that element.
The General Plan Amendment (GPA) application listed below proposes a change to the Land Use
Element. The City Council approved the application "in concept" at a duly noticed public hearing
(hearing date noted below). The recommended action would formally adopt the changes to the General
Plan (previously approved in concept), which will ensure consistency between the General Plan and
Zoning Ordinance.

GPA 07-07 is part of a project that consists of the construction of a 19,760 square foot
medical office building on a 1.94 acre site within the Bressi Ranch Master Plan (Planning
Area 1). To allow for the development of a medical office on the site, it is necessary to
change the General Plan and Master Plan land use designations on the site from Planned
Industrial (PI) to Office (O), and change the Master Plan Zoning designation from Planned
Industrial (PM) to Office (O).
An environmental review for the project, including GPA 07-07, was processed in accordance
with CEQA. No potentially significant impacts on the environment were identified. A
Negative Declaration was adopted by the City Council on February 5, 2008.

WHEREAS, pursuant to Government Code Section 65358(b), no mandatory
7
element of the General Plan shall be amended more frequently than four times during any
8
calendar year, and any one of those four amendments may include more than one change to
9
the General Plan; and

WHEREAS, the Land Use Element is a mandatory element of the General Plan;
11
and
12
WHEREAS, pursuant to Government Code Section 65358, and the provisions of
the Carlsbad Municipal Code, the Planning Commission did, on December 5, 2007 hold a duly
noticed public hearing as prescribed by law to consider the proposed amendment to the
General Plan; and16
WHEREAS, the Planning Commission adopted Planning Commission Resolution
No. 6360 recommending approval in concept of the proposed amendment to the General Plan;18

WHEREAS, the City Council did, on February 5, 2008 hold a duly noticed public
hearing to consider the Planning Commission's recommendation and to hear all persons
22 interested in the proposed amendment to the General Plan and the related environmental
23 review; and
WHEREAS, the City Council adopted City Council Resolution No. 2008-027 on
25 February 5, 2008, approving in concept the proposed amendment to the General Plan.
26 NOW, THEREFORE, the City Council of the City of Carlsbad, California, does
hereby resolve as follows:

1 . That the above recitations are true and correct.

1 2. That the findings of the City Council set forth in City Council Resolution No.
2008-027 (on file in the City Clerk's office) are made a part hereof by reference.

3. That the first amendment to the Land Use Element of the General Plan during
3 calendar year 2008 is approved as shown on the attached exhibit consisting of 1 page titled
"GPA 07-07 BRESSI RANCH MEDICAL PLAZA" (dated December 5, 2007).
EFFECTIVE DATE: The amendment to the Land Use Element shall become
effective thirty (30) days following the adoption of this resolution.6
