RECOMMENDED ACTION:
Introduce Ordinance No. NS-888 to establish a prima facie 35 mile per hour speed limit
upon southbound Carlsbad Boulevard from a point 1,400 feet south of the southerly boundary of the
right-of-way of Manzano Drive to Island Way.
ITEM EXPLANATION:
Northbound and southbound traffic lanes on Carlsbad Boulevard from south of Manzano Drive to
Island Way are separated by a wide median area of naturally growing vegetation with Encinas Creek
bisecting this portion of roadway. The Encinas Creek Bridge, originally constructed in 1913 by the
California Highway Department, supports the two southbound traffic lanes and bicycle lane.
Age and deteriorated condition of the bridge identified in the Caltrans Bridge Inspection Report with
subsequent confirmation by consulting structural engineers has documented that the bridge serving
southbound vehicles has exceeded its service life. Staff is processing a design for re-construction of
the structure. Until construction is completed in several years, structural engineers have
recommended that because of the bridge condition, southbound traffic lanes be shifted to the easterly
portion of the bridge and that the prima facie speed limit upon southbound Carlsbad Boulevard be
lowered to 35 miles per hour. This lowered speed limit would remain until construction of the new
bridge is completed. At that time, City Council actipn could restore the prima facie speed limit upon
this segment of southbound Carlsbad Boulevard to its current posted speed limit of 50 miles per hour.
The northbound segment of Carlsbad Boulevard between a point 1,400 feet south of the southerly
boundary of the right-of-way of Manzano Drive and Island Way would remain as a 50 mile per hour
speed zone.
California Vehicle Code section 22361 specifies that on multiple-lane highways with two or more
separate roadways, different prima facie speed limits may be established when procedures for
establishing prima facie speed limits are followed.
Staff will have the contractor performing the 2007/2008 Carlsbad Pavement Overlay Project pave the
easterly portion of the southbound lanes to facilitate the shift of traffic. This work will be completed
within one month.
ENVIRONMENTAL IMPACT:
The installation of an official traffic control device is a project that is a Class 1 categorical exemption
(minor alteration of an existing structure or facility) and is exempt from the environmental review
process under the provisions of the California Environmental Quality Act (CEQA), section 15301(c).
FISCAL IMPACT:
Six speed limit signs will cost about $900. The signs will be installed after the pavement overlay is
complete that will be constructed on the easterly side of the existing pavement at the Encinas Creek
Bridge to facilitate the shift in southbound traffic lanes to the easterly portion of the bridge.
Sufficient funds exist in the 2007/2008 Pavement Overlay Contract for the pavement overlay work and
for the cost of sign installations.

The City Council of the City of Carlsbad, California, hereby ordains as follows:

SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended
9 by the revision of Section 10.44.030 to read as follows:
10 "10.44.030 Carlsbad Boulevard
11 (a) Upon Carlsbad Boulevard from the north boundary of the11 City to its intersection with Mountain View Drive the prima facie
speed limit shall be thirty-five miles per hour.
(b) Upon Carlsbad Boulevard from its intersection with
13 Mountain View Drive to its intersection with Tamarack Avenue, the
prima facie speed limit shall be thirty miles per hour.
14 (c) Upon Carlsbad Boulevard from its intersection with
15 Tamarack Avenue to a point 1,400 feet south of the southerly
boundary of the right-of-way of Manzano Drive, for both the
, , southbound and northbound lanes, the prima facie speed limit shall
be thirty-five miles per hour.
17 (d) Upon the southbound lanes of Carlsbad Boulevard from a
point 1,400 feet south of the southerly boundary of the right-of-way
18 of Manzano Drive to Island Way, the prima facie speed limit shall
be thirty-five miles per hour.

and the City Clerk shall certify the adoption of this ordinance and cause it to be published at least
