RECOMMENDED ACTION:
Adopt Resolution No.2008-142 accepting bids and awarding the construction contract and
appropriating funds for Off-Site Wetland Mitigation Restoration for Rancho Santa Fe Road North,
Project No. 3907.
ITEM EXPLANATION:
The regulatory permits for construction of Rancho Santa Fe Road North, Phases 1 and 2 required
mitigation and restoration for disturbance to wetland, upland, and ephemeral stream areas.
This project covers the off-site wetland restoration in San Marcos Creek east of Melrose Drive in the
City of San Marcos. The on-site wetland mitigation restoration work was completed in December 2007
and is now in the 5-year monitoring and maintenance period.
On January 8, 2008, City Council authorized the advertisement for bids for the Off-Site Wetlands
Mitigation Restoration Project. The Purchasing Department received ten (10) sealed bids on April 16,
2008 as shown in Table 1.

ENVIRONMENTAL IMPACT:
The City Council, at their meeting on June 2, 1992, passed Resolution No. 92-152 certifying
EIR No. 91-1 for both Phase 1 and Phase 2 of the Rancho Santa Fe Road project. The City Council,
at their meeting on April 25, 2000, adopted Resolution No. 2000-128 approving Addendum No. 2 to
the final EIR No. 91-1 for Rancho Santa Fe Road. This EIR covers the realignment and widening of
Rancho Santa Fe Road from La Costa Avenue to Melrose Drive.
This off-site wetland mitigation restoration is to comply with requirements of the California Department
of Fish and Game (CDFG) 1601 permit issued for the road realignment project.
FISCAL IMPACT:
The table below summarizes the costs for the construction of Rancho Santa Fe Road Projects,
Project No. 3907 and Project No. 3190.

The estimated cost for the Off-Site Wetland Mitigation Restoration work under consideration is
$2,030,000. The estimated cost of $2,030,000 is comprised of construction costs of $1,598,000, a
fifteen percent (15%) contingency at $240,000 and twelve percent (12%) for construction
management/inspection at $192,000. Additional contract amendments are currently being processed
using the Project's existing available balance. As such, additional funds need to be appropriated from
the Rancho Santa Fe Road Fund in the amount of $2,030,000 to complete the project.
Sufficient funds are currently available in the Rancho Santa Fe Road Fund for this appropriation.

THE CONSTRUCTION CONTRACT AND APPROPRIATING

6 WHEREAS, plans and specification have been approved by the City Council of the
7 City of Carlsbad, California for Off-Site Wetland Mitigation Restoration for Rancho Santa Fe Road

WHEREAS, the lowest responsible and responsive bid received for the Off-Site Wetland

Mitigation Restoration work was submitted by Sierra Pacific West in the amount of $1,598,000.00;
10 and
11 WHEREAS, the total estimated costs for the City's contract for construction of the
12 Off-Site Wetland Mitigation Restoration Project is 2,030,000; and
13 WHERAS, sufficient funds are currently available in the Rancho Santa Fe Road Fund.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

California, as follows:
15 1. That the above recitations are true and correct.
16 2. That the bid of $1,598,000.00 submitted by Sierra Pacific West, Inc., for the
17 Off-Site Wetland Mitigation Restoration for Rancho Santa Fe Road North Project is accepted.
18 3. That the City Manager is hereby authorized to approve construction change
orders for the Off-Site Wetland Mitigation Restoration for Rancho Santa Fe Road North Project,

up to $240,000.
20 4. That the Mayor of the City of Carlsbad is hereby authorized and directed to
21 execute a contract for the Off-Site Wetland Mitigation Restoration for Rancho Santa Fe Road
22 North, Project No. 3907, with Sierra Pacific West, Inc.
23 5. That the award of this contract is contingent upon Sierra Pacific West, Inc.,
executing the required contract and submitting the required bonds and insurance policies, as24
directed in the contract, within twenty (20) days of adoption of this resolution. The City Manager
25 may grant reasonable extensions of time.
26 6. That the Finance Director is hereby authorized and directed to appropriate
27 $2,030,000 from the Rancho Santa Fe Road Fund to Project 3907 for the construction of the
