RECOMMENDED ACTION:
Adopt Resolution No.2008-143 awarding the contract to Hardy & Harper, Inc., for the
construction of the 2008 Pavement Overlay, Project No. 6001-08OL.
ITEM EXPLANATION:
The 2008 Pavement Overlay Project is part of the City's ongoing Pavement Management Program.
This rehabilitation project will extend the life of Palomar Airport Road, east of El Camino Real, by
applying a rubberized asphalt concrete layer over the existing pavement. The roadway was selected
based on its age and the existing condition of the roadway surface.
On April 28, 2008, eleven (11) sealed bids were received for the construction of this project as shown
on the following table. The engineer's estimate was $1,700,000.

The lowest responsive bidder, Hardy & Harper, Inc., submitted a bid in the amount of $1,565,000.
Staff has completed its review of the contract documents and has determined that they are in order.
Staff recommends that Hardy & Harper, Inc., be awarded the contract.
ENVIRONMENTAL IMPACT:
This project is categorically exempt from the environmental review process under CEQA Guidelines
Section 15301 Class 1(c) Existing Facilities, of the Public Resources Code (California Environmental
Quality Act).

Sufficient funds are available in the TransNet Local Fund to complete Project 6001 (Pavement
Management). The unused funds will go back into the Pavement Management Program for future road
resurfacing projects.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, AWARDING A CONTRACT FOR
THE CONSTRUCTION OF THE 2008 PAVEMENT OVERLAY,
4 PROJECT NO. 6001-08OL
5 WHEREAS, on March 18, 2008, the City Council of the City of Carlsbad approved plans
6 for the construction of the 2008 Pavement Overlay, Project No. 6001-08OL; and
7 WHEREAS, the City Council believes that it is in the public's best interest to construct
g the 2008 Pavement Overlay, Project No. 6001-08OL; and
WHEREAS, eleven (11) sealed bids were received on April 28, 2008 by the City of9
Carlsbad for the construction of the 2008 Pavement Overlay, Project No. 6001-08OL; and

WHEREAS, the lowest responsive and responsible bid to construct said project was
11
submitted by Hardy & Harper, Inc., in the amount of $1,565,000; and
12 WHEREAS, there are sufficient funds available in the Pavement Management Program
13 to complete the project; and
14 WHEREAS, subsection 3.28.040(C)(6) of the Carlsbad Municipal Code authorizes the
15 City Manager to approve change orders in the amount equal to the contingency set at the time of
16 project award.
17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

1. That the above recitations are true and correct,i y
2. That the low bid of $1,565,000 submitted by Hardy & Harper, Inc., for the
construction of the 2008 Pavement Overlay, Project No. 6001-08OL, is accepted and the Mayor is

hereby authorized to execute a contract for this project.
22 3. That the City Manager is hereby authorized to approve construction change
23
orders up to $156,500.
4. That the award of this contract is contingent upon the bidder submitting the
25 lowest responsible bid executing the required contract and submitting the required bonds and
26 insurance policies, as described in the contract, within twenty (20) days of adoption of this
27 resolution. The City Manager may grant reasonable extensions of time.
