On April 16, 2008, the Planning Commission recommended approval (5-0-2; Commissioner
Boddy absent, Commissioner Douglas abstained) of a Specific Plan Amendment and Local
Coastal Program Amendment to amend the Carlsbad Ranch Specific Plan, Planning Area 7
(The Flower Fields).
The amendment is to allow for a second driveway access for ingress only into the Armstrong
Garden Center/Flower Fields property from westbound Palomar Airport Road approximately
530 feet east of the Paseo del Norte/Palomar Airport Road intersection. Improvements for the
driveway include a 375-foot long deceleration lane extending between Armada Drive and the
proposed 16-foot wide driveway. Landscape improvements along this frontage will remain very
similar to what is currently planted.
Other than the applicant's presentation, no other public comment was received at the Planning
Commission hearing. A full disclosure of the Planning Commission's actions and a complete
project description and staff analysis of the proposed project are included in the attached
minutes and Planning Commission staff report. The Planning Commission and Staff are
recommending approval of the proposed discretionary actions.

No fiscal impacts to the City have been identified.
ENVIRONMENTAL IMPACT:
A determination that the project is within the scope of the previously certified Carlsbad Ranch
Specific Plan Final Program EIR 94-01 is being recommended by the Planning Commission.
Findings to support this action have been made by the Planning Commission in Resolutions No.
6414 and 6415.

The City Council of the City of Carlsbad, California, does ordain as follows:

WHEREAS, the Carlsbad Ranch Specific Plan was originally adopted by City
Council Ordinance No. NS-227 on March 16, 1993 and has been amended several times and

contains the uses, development standards and design guidelines for the development of the
subject property; and
WHEREAS, the City Council of the City of Carlsbad has reviewed and14
considered a Specific Plan Amendment (SP 207(G)) for the Carlsbad Ranch Specific Plan; and
WHEREAS, after procedures in accordance with requirements of law, the City16
Council has determined that the public interest indicates that said Specific Plan Amendment (SP
207(G)) be approved.

NOW, THEREFORE, the City Council of the City of Carlsbad does ordain as

21 SECTION 1: That Specific Plan (SP 207(G)), on file in the Planning Department,
22 and incorporated herein by reference, is adopted. The Carlsbad Ranch Specific Plan (SP
23 207(G)) shall constitute the development plan for the property and all development within the
24 plan area shall conform to the plan.
25 SECTION 2: That the Carlsbad Ranch Specific Plan (SP 207), as amended to
26 date, and further amended by Specific Plan Amendment 207(G), dated April 16, 2008, is
27 approved.

1 SECTION 3: That Specific Plan Amendment (SP 207(G)) replaces text on Pg.
2 161 and Figure 49 on Pg. 162 in the Carlsbad Ranch Specific Plan, as shown on Attachments
3 SP 207(G).
4 SECTION 4: That the findings and conditions of the Planning Commission, in
5 Planning Commission Resolution No. 6414, shall constitute the findings and conditions of the
6 City Council.
7 EFFECTIVE DATE: This ordinance shall be effective thirty days after its
8 adoption, but not until Local Coastal Program Amendment LCPA 07-07 is approved by the
9 California Coastal Commission, and the City Clerk shall certify to the adoption of this ordinance
10 and cause it to be published at least once in a publication of general circulation in the City of

2. That the CEQA findings of the Planning Commission as set forth in Planning
24 Commission Resolution No. 6414 on file with the City Clerk, and made a part hereof by
reference, are the findings of the City Council.

3. That the Local Coastal Program Amendment (LCPA 07-07) findings and
26 conditions of the Planning Commission as set forth in Planning Commission Resolution No.
6415 on file with the City Clerk, and made a part hereof by reference, are the findings and
27 conditions of the City Council.

1 4. That the application for a Local Coastal Program Amendment (LCPA 07-07) on
property generally located northeast of Palomar Airport Road and Paseo del Norte is approved
2 as shown in Planning Commission Resolution No. 6415.
5. That the approval of LCPA 07-07 shall not become effective until it is approved
4 by the California Coastal Commission and the California Coastal Commission's approval
becomes effective.
6. This action is final the date this resolution is adopted by the City Council and is
6 subject to the approval of the LCPA 07-07 by the California Coastal Commission. The
Provisions of Chapter 1.16 of the Carlsbad Municipal Code, "Time Limits for Judicial Review"
7 shall apply:

9 The time within which judicial review of this decision must be sought is
governed by Code of Civil Procedure, Section 1094.6, which has been
10 made applicable in the City of Carlsbad by Carlsbad Municipal Code
Chapter 1.16. Any petition or other paper seeking review must be filed in
11 the appropriate court not later than the nineteenth day following the date
on which this decision becomes final; however, if within ten days after the
12 decision becomes final a request for the record of the deposit in an
amount sufficient to cover the estimated cost or preparation of such
13 record, the time within which such petition may be filed in court is
extended to not later than the thirtieth day following the date on which the
14 record is either personally delivered or mailed to the party, or his attorney

23 WHEREAS, said verified application constitutes a request for a Specific Plan

25 Amendment as shown on Exhibit(s) "X" dated April 16, 2008, attached hereto, and on file in
26 the Carlsbad Planning Department, PALOMAR AIRPORT ROAD DRIVEWAY - SP 207(G)

WHEREAS, the Planning Commission did, on April 16, 2008, hold a duly
noticed public hearing as prescribed by law to consider said request; and
WHEREAS, at said public hearing, upon hearing and considering all testimony
and arguments, if any, of all persons desiring to be heard, said Commission considered all factors
relating to the Specific Plan Amendment; and
1 WHEREAS, on January 16, 1996, the City Council approved SP 207(A), as

6 NOW, THEREFORE, BE IT HEREBY RESOLVED by the Planning
Commission of the City of Carlsbad as follows:
A) That the foregoing recitations are true and correct.
10 B) That based on the evidence presented at the public hearing, the Commission
11 RECOMMENDS APPROVAL OF PALOMAR AIRPORT ROAD
DRIVEWAY - SP 207(G) based on the following findings and subject to the
following conditions:

14 Findings:
1. The proposed development as described by the Specific Plan Amendment (SP 207(G))
16 is consistent with the provisions of the General Plan, in that the proposed project does
not increase the size or alter the allowed uses within Planning Area 7 of the
Carlsbad Ranch Specific Plan, and it supports General Plan Open Space and
Conservation Element Goals, Policies and Objectives promoting agriculture by
19 | making it easier for visitors to access and enjoy the Flower Fields and Armstrong
Garden Center, which in turn ensures the success and viability of those operations.
21 2. The proposal to add a second driveway access for ingress only into the Armstrong
22 Garden Center/Flower Fields property from Palomar Airport Road (PAR) is
consistent with the Carlsbad Ranch Specific Plan (SP 207) in that the second
driveway will support the existing agricultural and commercial agricultural uses
24 located in Planning Area 7 by making it easier for visitors to access and enjoy the
25 Flower Fields and Armstrong Garden Center, which in turn ensures the success and
viability of those operations.
27 3. The Planning Director has determined that:
28 a. the project is a(n) subsequent activity of the Carlsbad Ranch Specific Plan (SP
207(A)) for which a program EIR was prepared, and a notice for the activity has
been given, which includes statements that this activity is within the scope of the
program approved earlier, and that the program EIR adequately describes the
activity for the purposes of CEQA; [15168(c)(2) and (e)]; and
b. this project is consistent with the Carlsbad Ranch Specific Plan cited above; and
c. the Carlsbad Ranch Specific Plan EIR 94-01 was certified by the City Council
on January 9, 1996 in connection with the prior plan; and

d. the project has no new significant environmental effect not analyzed as significant
2 in the prior EIR; and
3 e. none of the circumstances requiring a Subsequent EIR or a Supplemental EIR
under CEQA Guidelines Sections 15162 or 15163 exist; and
f. all feasible mitigation measures or project alternatives identified in the Carlsbad
Ranch Specific Plan EIR 94-01, which are appropriate to this Subsequent
Project, have been incorporated into this Subsequent Project.
8 4. The Planning Commission has reviewed each of the exactions imposed on the Developer
contained in this resolution, and hereby finds, in this case, that the exactions are imposed
10 to mitigate impacts caused by or reasonably related to the project, and the extent and the
degree of the exaction is in rough proportionality to the impact caused by the project.
12 Conditions:

Note: Unless otherwise specified herein, all conditions shall be satisfied prior to issuance of a
grading permit or building permit, whichever occurs first.

1. If any of the following conditions fail to occur, or if they are, by their terms, to be
implemented and maintained over time, if any of such conditions fail to be so
implemented and maintained according to their terms, the City shall have the right to
18 revoke or modify all approvals herein granted; deny or further condition issuance of all
future building permits; deny, revoke, or further condition all certificates of occupancy
issued under the authority of approvals herein granted; record a notice of violation on the
property title; institute and prosecute litigation to compel their compliance with said
21 conditions or seek damages for their violation. No vested rights are gained by Developer
22 or a successor in interest by the City's approval of this Specific Plan Amendment.
23 2. Staff is authorized and directed to make, or require Developer to make, all corrections
24 and modifications to the Specific Plan Amendment document(s) necessary to make
,. them internally consistent and in conformity with final action on the project.
Development shall occur substantially as shown in the approved Exhibits. Any proposed
26 development, different from this approval, shall require an amendment to this approval.

3. Developer shall comply with all applicable provisions of federal, state, and local laws and
regulations in effect at the time of building permit issuance.
4. If any conditions for construction of any public improvements or facilities, or the
payment of any fees in-lieu thereof, imposed by this approval or imposed by law on this
Project are challenged, this approval shall be suspended as provided in Government Code
Section 66020. If any such condition is determined to be invalid, this approval shall be
invalid unless the City Council determines that the project without the condition complies
with all requirements of law.
5. Developer/Operator shall and does hereby agree to indemnify, protect, defend, and hold
harmless the City of Carlsbad, its Council members, officers, employees, agents, and
representatives, from and against any and all liabilities, losses, damages, demands, claims

and costs, including court costs and attorney's fees incurred by the City arising, directly
2 or indirectly, from (a) City's approval and issuance of this Specific Plan Amendment,
3 (b) City's approval or issuance of any permit or action, whether discretionary or
nondiscretionary, in connection with the use contemplated herein, and
(c) Developer/Operator's installation and operation of the facility permitted hereby,
5 including without limitation, any and all liabilities arising from the emission by the
x- facility of electromagnetic fields or other energy waves or emissions. This obligation
survives until all legal proceedings have been concluded and continues even if the City's
' approval is not validated.

6. This project shall comply with all conditions and mitigation measures which are required
as part of the Zone 13 Local Facilities Management Plan and any amendments made to
10 that Plan prior to the issuance of building permits.

7. This approval is granted subject to the approval of LCPA 07-07, CUP 98-20(B), and
CDP 98-.91(A), and is subject to all conditions contained in Planning Commission
13 Resolutions No. 6415, 6416, 6417 for the other approval incorporated herein by
reference.
15 8. Prior to the issuance of any permits for the project, the applicant shall submit to the
16 Planning Director a digital copy and a camera-ready master copy of the Carlsbad
Ranch Specific Plan SP 207(G), in addition to the required number of bound copies.

20 Please take NOTICE that approval of your project includes the "imposition" of fees,
? - dedications, reservations, or other exactions hereafter collectively referred to for convenience as
"fees/exactions."

23 You have 90 days from date of final approval to protest imposition of these fees/exactions. If
you protest them, you must follow the protest procedure set forth in Government Code Section
66020(a), and file the protest and any other required information with the City Manager for
25 processing in accordance with Carlsbad Municipal Code Section 3.32.030. Failure to timely
follow that procedure will bar any subsequent legal action to attack, review, set aside, void, or
annul their imposition.
28 You are hereby FURTHER NOTIFIED that your right to protest the specified fees/exactions
DOES NOT APPLY to water and sewer connection fees and capacity charges, nor planning,
zoning, grading, or other similar application processing or service fees in connection with this
project; NOR DOES IT APPLY to any fees/exactions of which you have previously been given a
NOTICE similar to this, or as to which the statute of limitations has previously otherwise
expired.

of the Mello II segment of the Carlsbad Local Coastal Program not being amended by
this amendment, in that the proposed amendment is consistent with the Carlsbad
24 Ranch Specific Plan and will not affect any of the Mello II Land Use Policies related
to grading, landscaping, erosion, steep slopes, landslides, slope instability, seismic
hazards, erosion control practices, or removal of native vegetation.

27 2. That the proposed amendment to the Implementation Plan of the Mello II segment of
the Carlsbad Local Coastal Program is required to bring it into consistency with the

207(A)) for which a program EIR was prepared, and a notice for the activity has

b. this project is consistent with the Carlsbad Ranch Specific Plan cited above; and

contained in this resolution, and hereby finds, in this case, that the exactions are imposed
to mitigate impacts caused by or reasonably related to the project, and the extent and the

I.RECOMMENDATION
That the Planning Commission ADOPT Planning Commission Resolutions No. 6414 and 6415
RECOMMENDING APPROVAL of Specific Plan Amendment SP 207(G) and Local Coastal
Program Amendment LCPA 07-07, and ADOPT Planning Commission Resolutions No. 6416
and 6417 APPROVING a Conditional Use Permit Amendment CUP 98-20(B) and Coastal
Development Permit Amendment CDP 98-91 (A), based on the findings and subject to the
conditions contained therein.
II. INTRODUCTION
The applicant is proposing to amend the Carlsbad Ranch Specific Plan to add a second driveway
access for ingress only into the Armstrong Garden Center/Flower Fields property from Palomar
Airport Road (PAR). The project site is located within Planning Area 7 of the Carlsbad Ranch
Specific Plan, which is located on the northeast corner of PAR and Paseo del Norte. The
Specific Plan, which was adopted by ordinance, implements the General Plan and governs the
development of Carlsbad Ranch. Therefore, the Specific Plan serves as the implementing
ordinance for the Local Coastal Program (LCP) and an LCP amendment is required.
Modifications to the site plan for the Armstrong Garden Center are required in order to
accommodate the proposed deceleration lane and second driveway access. Therefore, an
amendment to the Armstrong Garden Center's Conditional Use Permit and Coastal Development
Permit are included.

The deceleration lane improvements will extend along the north side of PAR from Armada Drive
to Paseo del Norte. The proposed deceleration lane improvements are dependent on and
consistent with the City's proposal to widen PAR, which will include an additional westbound
through lane and an additional right-turn lane onto Paseo del Norte. The City of Carlsbad is
currently processing a Coastal Development Permit (CDP 08-07) for the widening of PAR,
which requires discretionary approval by the Planning Commission. The deceleration lane and
driveway project is dependent upon the City's widening improvements and is therefore
contingent upon the approval of the City's CDP 08-07.
III. PROJECT DESCRIPTION AND BACKGROUND
The applicant is requesting approval a Specific Plan Amendment, Local Coastal Program
Amendment, Conditional Use Permit Amendment, and Coastal Development Permit
Amendment to add a deceleration lane and a second driveway access for ingress only from PAR
into the Armstrong Garden Center/Flower Fields property. The project includes a 375 foot long
deceleration lane along westbound PAR between Armada Drive and Paseo del Norte, a 16 foot
wide driveway entrance for ingress only into the Armstrong Garden Center/Flower Fields—
property from Palomar Airport Road, and landscaping modifications to the project frontage
along PAR.
Surrounding land uses include the Carlsbad Premium Outlets to the north, Palomar Airport Road
to the south, the Flower Fields and Pacific Palisades hotel to the east, and Paseo del Norte to the
west.
The Armstrong Garden Center and Flower Fields are located within Planning Area 7 (The
Flower Fields) of the Carlsbad Ranch Specific Plan. The Specific Plan establishes development
standards for Planning Area 7, which are listed in Chapter III, Section H (Pages 159 - 163).
Under Section H(l)(e) of Chapter III, vehicular access to Planning Area 7 reads as follows:
a. Access
Vehicular access to Planning Area 7 shall be at a City Engineer approved location on
the east side of Paseo del Norte north of the intersection of Paseo del Norte and
Palomar Airport Road.
The applicant is requesting approval of a text amendment to Chapter III, Section H(l)(e) in order
to approve the project as proposed. The text amendment will read as follows:
a. Access
Vehicular access to Planning Area 7 shall be at two (2) a City Engineer approved
locations. One on the east side of Paseo del Norte north of the intersection of Paseo
del Norte and Palomar Airport Road, and the other (for ingress only), on the north
side of Palomar Airport Road east of the intersection.
An amendment to Figure 49 (Pg 162) of the Specific Plan accompanies the proposed text
amendment, which identifies the second driveway access on PAR, and specifically indicates that

vehicular access along this frontage is for ingress only (see attached Figure 49 — Planning Area 7
- Flower Fields).
A Conditional Use Permit (CUP 98-20) and a Coastal Development Permit (CDP 98-91) for the
Armstrong Garden Center was approved by the Planning Commission on October 20, 1999, and
established the current site plan for the Armstrong Garden Center and Flower Fields parking lot.
Amendments to the Conditional Use Permit and Coastal Development Permit site plans are
required in order to accommodate the new driveway, deceleration lane and landscaping along
PAR.
Site plan improvements include a 16 foot wide driveway for vehicular access located
approximately 530 feet east of the intersection of Paseo del Norte and PAR. To accommodate
the additional right-turn lane that the City is proposing as part of widening PAR, the current
parking lot and landscape planter design along this entire frontage is proposed to be modified.
The landscape planter area along PAR, extending between Paseo del Norte and the proposed
driveway, will have a width of between 14 feet and 29 feet (including public right-of-way) post
widening. In order to maximize landscaping along PAR, the existing parking lot drive aisle for—
the Armstrong Garden Center/Flower Fields that runs parallel to PAR has been narrowed to the
minimum width of 24 feet. The appearance of this frontage will remain very similar to what is
currently planted. A 30-inch high landscape berm topped with a two rail white vinyl fence is
designed to screen parked cars. Bower vine (Pandorea jasminoides 'Rosea') will be trellised on
the fence, and Coast Live Oak (Quercus agrifolia) and White Alder (Alnus rhombifolia) trees
will be planted along the entire frontage wKen the project is built.
As designed, frontage improvements east of the proposed driveway and extending to Armada
Drive include a 375 foot long deceleration lane and a 4.5 foot wide landscape planter area. An
existing 6.5 foot tall black vinyl chain link fence will be relocated with the proposed
improvements behind the landscape planter. The appearance of this frontage will remain very
similar to what is currently planted with Natal Plum (Carrissa macrocarpa) planted in a hedge
row along the entire frontage, and Bower vine trellised on the fence.
The original Carlsbad Ranch Specific Plan (SP 207) was approved in 1993. The first amendment
to the Specific Plan was to allow for the Legoland theme park in 1996 (SP 207(A)). It increased
the land area of the original specific plan by 23.89 acres; redistributed land uses to focus on
recreational, retail, and visitor serving land uses, and superseded the original Carlsbad Ranch
Specific Plan in its entirety. A minor amendment (SP 207(B)) to permit the realignment of the
flower fields trail followed, and since then, amendments for the development of the Museum of
Making Music (SP 207(D)) and the development of Planning Area 5 as a hotel/timeshare project
(SP 207(E)) have occurred. As recently as February 12, 2008, the City Council adopted SP
207(F), which was an amendment that allows for the administrative approval of future Inner Park
development projects within Legoland, an expansion of the allowed uses within the Legoland
theme park to include overnight uses, and the addition of definitions and procedures for Minor
and Major Specific Plan Amendments.

IV. ANALYSIS
The proposed project is subject to the following plans, ordinances and standards as analyzed
within the following section of this staff report:
A. General Plan Open Space (OS) Land Use designation;
B. Open Space (OS) Zone (C.M.C. Chapter 21.33);
C. Carlsbad Ranch Specific Plan (SP 207(E);
D. Local Coastal Program Amendment and compliance with the Mello II Segment of
the Local Coastal Program and Coastal Resource Protection Overlay Zone
(C.M.C. Chapter 21.203);
E. Conditional Use Permit (C.M.C. Chapter 21.42); and
F. Growth Management Ordinance (Local Facilities Management Plan Zone 13).
The recommendation for approval of this project was developed by analyzing the project's
consistency with the applicable regulations and policies. The project's compliance with each of
the above regulations is discussed in detail in the sections below. —
A. General Plan
The existing Open Space General Plan Land Use designation for Planning Area 7 was adopted
concurrently with the Carlsbad Ranch Specific Plan (SP 207). Planning Area 7 allows for a
variety of open space uses including agriculture (the Flower Fields), and the Armstrong Garden
Center (with a CUP). The proposed driveway project is a common accessory open space use
which supports the permitted agricultural uses. Furthermore, the project supports General Plan
Open Space and Conservation Element Goals, Policies and Objectives promoting agriculture by
making it easier for visitors to access and enjoy the Flower Fields and Armstrong Garden Center,
which in turn ensures the success and viability of those operations.
The Carlsbad Ranch Specific Plan was found to comply with all applicable General Plan Goals,
Objectives and Policies. This project is in conformance with the Specific Plan and therefore is
also in compliance with the General Plan.
The proposed deceleration lane also complies with the General Plan Circulation Element goal
(A.2) of providing a comprehensive network of streets that maximize access to all neighborhoods
and land uses.
B. Zoning
Planning Area 7 of the Carlsbad Ranch Specific Plan is located in the Open Space (OS) Zone.
However, development within the Specific Plan area is subject to the development standards of
the Specific Plan rather than the City's Zoning Ordinance. The Specific Plan does not
specifically allow driveways as a permitted use within Planning Area 7. However, the Open
Space zone clearly allows driveways as an accessory use required for the conduct of permitted
uses in the zone and also allows transportation rights-of-way. The proposed driveway and
deceleration lane have been designed to comply with City of Carlsbad Engineering standards.
Therefore the proposed driveway and deceleration lane uses are consistent with the Open Space
SP 207(G)/ LCPA 07-07/CUP 98-20(B)/CDP 98-91 (A) - PALOMAR AIRPORT ROAD

zone as implemented through SP 207. As discussed below, an amendment to SP 207 is proposed
to modify an exhibit and text for Planning Area 7 to establish a second driveway access for
ingress only to the site.
C. Carlsbad Ranch Specific Plan
The proposal to add a second driveway access for ingress only into the Armstrong Garden
Center/Flower Fields property from PAR is consistent with the Carlsbad Ranch Specific Plan
(SP 207) in that the second driveway will support the existing agricultural and commercial
agricultural uses located in Planning Area 7 by making it easier for visitors to access and enjoy
the Flower Fields and Armstrong Garden Center, which in turn ensures the success and viability
of those operations
D. Local Coastal Program Amendment and compliance with the Mello II Segment of
the Local Coastal Program and Coastal Resource Protection Overlay Zone
With regard to consistency with the Local Coastal Program, the Carlsbad Ranch Specific Plan rs—
the implementing ordinance and land use plan for the LCP. The LCP Amendment is necessary
to ensure consistency between the LCP and the Specific Plan. The Carlsbad Ranch Specific Plan
is the implementing Coastal Land Use Plan. As discussed in Section "C" above the second
driveway project is consistent with the Carlsbad Ranch Specific Plan. With regard to applicable
Coastal Land Use Policies, the deceleration lane and a second driveway project is required to
comply with relevant policies of the MelTo II Segment of the Local Coastal Program and the
Coastal Resource Protection Overlay Zone. The proposed driveway will not result in any
conflict with the provisions of the LCP, nor affect any of the Mello II Land Use Policies related
to grading, landscaping, erosion, steep slopes, landslides, slope instability, seismic hazards,
erosion control practices, or removal of native vegetation.
A six-week LCPA public notice of availability period was required for the project, and was
provided between November 23, 2007 and January 4, 2008. No comments were received as of
the date of preparation of this report.
£. Conditional Use Permit
All required findings to amend the existing conditional use permit for the Armstrong Garden
Center/Flower Fields to accommodate a deceleration lane and a second driveway access for
ingress only from PAR can be made as discussed below.
1. The requested use is necessary or desirable for the development of the community, and is
in harmony with the various elements and objectives of the general plan, including, if
applicable, the certified local coastal program, specific plan or master plan, in that the
proposed project provides circulation relief to the existing uses, and supports General
Plan Open Space and Conservations Element Goals, Policies and Objectives promoting
agriculture by making it easier for visitors to access and enjoy the Flower Fields and
Armstrong Garden Center, which in turn ensures the success and viability of those
operations.

2. That the requested use is not detrimental to the existing uses (Armstrong Garden Center
and Flower Fields) or to uses specifically permitted in the zone in which the proposed use
is to be located in that, the project provides circulation relief to the existing uses, which in
turn ensures the success and viability of those operations.
3. That the site for the proposed conditional use is adequate in size and shape to
accommodate the yards, setbacks, walls, fences, parking, loading facilities, buffer areas,
landscaping and other development features prescribed in this code and required by the
planning director, planning commission or city council, in order to integrate the use with
other uses in the neighborhood, in that the development of the proposed project complies
with all City standards, and all frontage improvements will be richly landscaped in
accordance with the City of Carlsbad Landscape Manual.
4. That the street system serving the proposed use is adequate to properly handle all traffic
generated by the proposed use, in that the proposed project is providing additional access
to the site for circulation relief and will not be increasing ADT.
F. Growth Management
The proposed project is located within Local Facilities Management Zone 13. The proposal to
add a second point of vehicular access for ingress only from PAR into the project site does not
impact public facilities.
V. ENVIRONMENTAL REVIEW
The proposed project has been reviewed pursuant to the California Environmental Quality Act
(CEQA). Staff has reviewed the project and concluded that no potentially significant impacts
would result with the implementation of the project that was not previously examined and
evaluated in the Final Program Environmental Impact Report for the Carlsbad Ranch Specific
Plan (EIR 94-01), dated January 9,1996. EIR 94-01 evaluates the potential environmental effects
of the development and operation of the "Carlsbad Ranch Specific Plan" and associated actions
inclusive of the proposed planning area projects reviewed herein.
The City Council certified EIR 94-01 on January 9, 1996. At that time CEQA Findings of Fact,
a Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program
were approved. All mitigation measures contained in the adopted Mitigation Monitoring and
Reporting Program from EIR 94-01 applicable to the proposed Planning Area project have been
completed, incorporated into the project design or are required as conditions of approval for the
project. The EIR 94-01 "Findings of Fact and Statement of Overriding Considerations" applies
to all subsequent projects covered by the Carlsbad Ranch Specific Plan Final Program EIR.
The proposed project will have no effects beyond those analyzed in the program EIR, as they are
a part of the program analyzed earlier. The proposed driveway (ingress only) does not increase
traffic, nor does it expand the scope of the existing project. This project is within the scope of
Final Program EIR 94-01 and no further CEQA compliance is required. EIR 94-01 is available
for review at the Planning Department.

Mr. Neu introduced Agenda Item 4 and stated Principal Planner Chris DeCerbo would make the Staff
presentation assisted by Associate Engineer Clyde Wickham.
Chairperson Whitton asked if the applicant wished to proceed with the hearing without a full Commission
present. The applicant stated he wanted to proceed.
Chairperson Whitton opened the public hearing on Item 4.
Commissioner Douglas recused herself due to a conflict of interest.
Mr. DeCerbo gave a detailed presentation and stated he would be available to answer any questions.
Chairperson Whitton asked if there were any questions of Staff.
Commissioner Baker asked if these improvements would be done in conjunction with the widening of
Palomar Airport Road. Mr. DeCerbo stated that was the intention.
Commissioner Cardosa inquired about the proposed signage. Mr. DeCerbo described the proposed
signage which is to include a new truss sign that would span Palomar Airport Road and it may include a
directional sign for the driveway into the Flower Fields. The balance of the truss sign would have
through-way arrows for getting to the freeway and for right-hand turns. Commissioner Cardosa inquired
about any "Do Not Enter" signs from the parking lot because this project is an entrance only. Mr.
DeCerbo stated that is not currently shown on the plans but it could be included. Commissioner Cardosa
suggested a "Caution" sign for pedestrian crossing. Mr. DeCerbo noted the suggestion and stated he
would make sure it was included in the signage.

Commissioner Baker asked Mr. Wickham to explain the design of the driveway lane. Mr. Wickham
explained that the lane is a trap lane where, with appropriate signage, a vehicle would enter into the
Flower Fields and it would cut-out the vehicles progressing towards Paseo Del Norte.
Commissioner Dominguez asked about the internal circulation of the new driveway. Mr. Wickham
directed the Commission's attention to a slide and indicated the traffic circulation of the driveway.
Commissioner Montgomery commented on the importance of the new signage. He further inquired if this
driveway would contribute to cut-through traffic to the outlet center. Mr. Wickham stated the applicant
could respond to that issue.
Chairperson Whitton inquired about the bike lane along the proposed driveway. Mr. Wickham stated the
bike lane does continue through to the intersection.
Chris Calkins, CB Ranch Enterprises, gave a brief presentation and stated he would be available to
answer any questions.
Chairperson Whitton asked Mr. Calkins if he is concerned with the speed of traffic traveling through the
parking lot for the Flower Fields. Mr. Calkins stated there are several methods they can use to slow traffic
down through the parking lot.
Commissioner Dominguez asked Mr. Calkins if he has readily researched traffic calming measures for the
site. Mr. Calkins stated he has, and that he also agrees with the importance of the signage.
Commissioner Baker asked if people have stated it is difficult to find the entrance to the Flower Fields.
Mr. Calkins stated yes and this new project will help with that issue.
Chairperson Whitton asked if any member of the audience wished to speak on the item. Seeing none, he
opened and closed public testimony.
Commissioner Cardosa asked about the possibility to name the driveway as the Flower Fields Exit. Mr.
DeCerbo stated there may be analysis going on right now.

ACTION: Motion by Commissioner Montgomery, and duly seconded, that the Planning
Commission adopt Planning Commission Resolutions No. 6414 and 6415
recommending approval of Specific Plan Amendment SP 207(G) and Local Coastal
Program Amendment LCPA 07-07, and adopt Planning Commission Resolutions
No. 6416 and 6417 approving a Conditional Use Permit Amendment CUP 98-20(6)
and Coastal Development Permit Amendment CDP 98-91 (A), based on the findings
and subject to the conditions contained therein.
