FOR FISCAL YEARS 2009 THROUGH 2013

RECOMMENDED ACTION:
Adopt Resolution No.2008-175 approving the Carlsbad TransNet Local Street
Improvement Program of Projects for fiscal years 2009 through 2013.
ITEM EXPLANATION:
The 2008 Regional Transportation Improvement Program (RTIP) is a program of proposed
highway, arterial, transit, and bikeway projects for Fiscal Years 2008/09 through 2012/13. The
San Diego Association of Governments (SANDAG) is required by State and Federal laws to
develop and adopt the RTIP every two years.
Each member agency of SANDAG that desires to expend TransNet and/or certain Federal and
State funds must approve a Program of Projects once every two years. In addition to projects with
these funding sources, the Program of Projects also includes regionally significant capacity
increasing projects regardless of the funding source. The Federal Metropolitan Planning and Air
Quality Conformity Regulations also require inclusion of all regionally significant capacity
increasing road projects for air quality emissions analysis.
The approval process includes a public hearing which allows citizens an opportunity to comment
on the City's Program of Projects. The adopted Resolution approving the Carlsbad Program of
Projects is due to SANDAG by June 30th. The Program of Projects is then incorporated into the
2008 RTIP as assembled and submitted to the State by SANDAG by August 1, 2008.
The proposed Carlsbad Program of Projects for fiscal years 2008/09 through 2012/13, which is
attached as Exhibit 1, includes projects with the following funding types:
Federal - SAFETEA-LU (High Priority Project)
Federal - Highway Bridge Program (HBP)
State - Transportation Development Act (TDA)
SANDAG - TransNet Local
Local - City funds
Local - Private funds
The Federal funding included in the Carlsbad Program of Projects consists of $1,600,000 in Federal
SAFETEA-LU, High Priority Project funds for Poinsettia Lane Reach E. The City is also programmed
to receive Federal Highway Bridge Program funding which is included by SANDAG and Caltrans as a
lump sum allocation and therefore is not listed as a funding line item on the City of Carlsbad Program
of Projects.
The State TDA funds are programmed for the preparation of the Carlsbad Pedestrian Master Plan.

The TransNet funds are programmed for a variety of projects including bridge improvement,
roadway improvement and roadway maintenance projects. The Transnet funding will provide the
local matching funds for three bridge projects along Carlsbad Boulevard. The bridges are located
across the Las Encinas Creek, the warm water outfall channel at the Encina power station and the
railroad just south of State Street. The TransNet funds are also programmed for roadway
widening projects which are in progress as well as the ongoing Pavement Management Program.
In addition to these improvement projects, the City is programmed to receive TransNet Bike funds
for the preparation of the Carlsbad Bicycle Master Plan.
The Program of Projects also includes various capacity increasing roadway projects located along
regionally significant arterials, regardless of the funding source. The projects in this category include
various roadway segments and intersection improvements. The majority of these projects are funded
by local City funds such as Traffic Impact Fees and/or local Private funds.
The Program of Projects can be revised as needed on a quarterly basis during the two year period
between the adoption of the 2008 RTIP and the subsequent 2010 RTIP.
ENVIRONMENTAL IMPACT:
This activity is statutorily exempt from CEQA pursuant to State CEQA Guidelines, Section 15276,
which states that CEQA does not apply to the adoption of regional transportation improvement
programs.
FISCAL IMPACT:
Approving the RTIP is a requirement under State law for receiving TransNet, Federal and State
funds. Approval of the RTIP ensures eligibility for funding and programs the funding for future
obligation.
Inclusion in the RTIP, however, is not a guarantee that projects will receive the stated funding. The
amounts shown are the best available estimates of anticipated funding. In the event that funding
falls short or is not available, the City Council is not obligated to proceed with a project just
because it is included in the RTIP.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ADOPTING THE CARLSBAD
TRANSNET LOCAL STREET IMPROVEMENT PROGRAM OF
4 PROJECTS FOR FISCAL YEARS 2009 THROUGH 2013
5 WHEREAS, on November 4, 2004, the voters of San Diego County approved the
6 San Diego Transportation Improvement Program Ordinance and Expenditure Plan (TransNet
7 Extension Ordinance); and
8 WHEREAS, the TransNet Extension Ordinance provides that SANDAG, acting as the
9 Regional Transportation Commission, shall approve a multi-year program of projects submitted
10 by local jurisdictions identifying those transportation projects eligible to use transportation sales
11 tax (TransNet) funds; and
12 WHEREAS, the City of Carlsbad was provided with an estimate of annual TransNet local
13 street and road revenues for Fiscal Years 2009 through 2013; and
14 WHEREAS, the City of Carlsbad has held a clearly noticed public hearing regarding its
15 proposed list of projects in accordance with Section 5(A) of the TransNet Ordinance and Rule 7
16 of the SANDAG Board Policy 31.
17 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
1R10 California, as follows:
1Q 1. That the above recitations are true and correct.
on 2. That pursuant to Section 2(C)(1) of the TransNet Extension Ordinance, the City of
21 Carlsbad certifies that no more than 30 percent of its annual revenues from the TransNet funds
22 shall be spent on maintenance related projects.
93 3. That pursuant to Section 4(E)(3) of the TransNet Extension Ordinance, the City of
24 Carlsbad certifies that all new projects, or major reconstruction projects, funded by TransNet
25 revenues shall accommodate travel by pedestrians and bicyclists, and that any exception to this
2fi requirement permitted under the Ordinance and proposed shall be clearly noticed as part of the
27 City of Carlsbad's public hearing process.

1 4. That pursuant to Section 8 of the TransNet Extension Ordinance, the City of
2 Carlsbad certifies that the required minimum annual level of local discretionary funds to be
3 expended for street and road purposes will be met through the 5-year period consistent with the
4 most recent Maintenance of Effort Requirements adopted by SANDAG.
5 5. That pursuant to Section 9A of the TransNet Extension Ordinance, the City of
6 Carlsbad certifies that it will extract $2,000 from the private sector for each newly constructed
7 residential housing unit in the City of Carlsbad to comply with the provisions of the Regional
8 Transportation Congestion Improvement Program (RTCIP).
9 6. That pursuant to Section 13 of the Transnet Extension Ordinance, the City of
10 Carlsbad certifies that is has established a separate TransNet Improvement Account for
11 TransNet Revenue with interest earned expended only for those purposes for which the funds
12 were allocated.
13 7. That pursuant to Section 18 of the TransNet Extension Ordinance, the City of
14 Carlsbad certifies that each project of $250,000 or more will be clearly designated during
15 construction with TransNet project funding identification signs.
^ 8. That the City of Carlsbad does hereby certify that all other applicable provisions of
17 the TransNet Extension Ordinance and the SANDAG Board Policy 31 have been met.
18 9. That the City of Carlsbad agrees to indemnify, hold harmless and defend SANDAG,
the San Diego County Regional Transportation Commission, and all officers and employees
20 thereof against all causes of action or claims related to local TransNet funded projects.
21 10. That the Carlsbad TransNet Local Street Improvement Program of Projects for fiscal
22 years 2009 through 2013 attached to this Resolution as Exhibit A is hereby approved.
