REC RECEIPT AND APPROPRIATION OF DONATION WITH NAMING RIGHTS FOR A TENNIS COURT IN POINSETTIA PARK DEPT. HEAD CITY ATTY. CITY MGR. RECOMMENDED ACTION: Adopt Resolution No. 2008-237 receiving and accepting a $15,000 donation and directing the appropriation of the donation in association with the naming of a tennis court as "The Glenda Hasselo Tennis Court" at a new tennis court in Poinsettia Park. ITEM EXPLANATION: In June 2007 the Recreation Department was contacted by Joni Miringoff on behalf of the North County Junior Tennis Patrons. The members of this group would like to propose to the City of Carlsbad a donation plan. This donation plan includes a $15,000 donation with a naming rights request in the honor of Glenda Hasselo at one of the new tennis courts currently being constructed at Poinsettia Park. Glenda's name has been selected based on the alignment of her passion for helping the community and the Recreation Department's strategic goals. In the late 1980's Glenda worked to develop the North County Tennis Patrons to the organization it is today. She created a fun and affordable atmosphere for youth to learn about the importance of sportsmanship when participating in tennis activities. Poinsettia Park currently has three tennis courts. Council authorized staff to proceed with the construction of seven additional tennis courts currently under construction and anticipated to be completed in the summer of 2008. (Exhibit 2) In order to process this donation proposal from the North County Junior Tennis Patrons, staff is following the criteria listed in Council Policy 48: Naming Rights of Parks and Municipal Facilities. (Exhibit 3) This policy addresses how to recognize significant contributions that organizations or individuals have made to the public life and well-being of the citizens of the City of Carlsbad. It also provides guidance on how to apply for approval to name or rename parks, facilities, and amenities within those facilities. The request honors individuals, living or deceased, who have made a significant contribution to the City of Carlsbad. 2. The donation amount is consistent with the contribution level. 3. The requested person had a longstanding affiliation with the City. 4. The name provides a sense of place, continuity and belonging reflecting the geographic location, community, neighborhood or street where the park, municipality or amenity within the facility is located. 5. The name recognizes the historical and/or cultural significance of the area. 6. The name reflects unique characteristics of the site. The first three criteria listed within the six naming rights criteria directly relate to this request. 1. The request honors individuals, living or deceased, who have made a significant contribution to the City of Carlsbad. Glenda Hasselo has made a significant contribution to the City of Carlsbad during her work with the North County Tennis Patrons. 2. The donation amount is consistent with the contribution level. The value of a naming right opportunity for a tennis court was determined based on staff research and the advice of a fund raising professional. The fund raising professional surveyed tennis facilities within San Diego County as well as other cities within the State of California. A broad range of valuation between $5,000 and $50,000 was identified for similar naming rights opportunities. The range is based on the location of the court and how it is packaged with other amenities. The selection of the dollar amount is important because it establishes a reasonable value for other tennis court donations. Based on staff research, the donation amount is consistent with the contribution level because it is within the low range of similar tennis court naming right donations. In addition, the North County Tennis Patrons will be working with other groups including the City to help support ongoing tennis programs for youth in the future. 3. The requested person had a longstanding affiliation with the City. Finally, Glenda Hesselo did have a longstanding affiliation with the City. She was a Carlsbad resident for more than 50 years. The organization where she volunteered, the North County Tennis Patrons, has been based in Carlsbad for over 40 years. PageS PARKS & RECREATION COMMISSION ACTION: The Parks and Recreation Commission members unanimously recommended acceptance of this donation for naming rights to the City Council. The naming right will be for one of the new tennis courts under construction at Poinsettia Park. The specific court is yet to be determined. FISCAL IMPACT: The Recreation Department requests that Council receive the cash donation totaling $15,000 which will allow for a naming rights opportunity at a new tennis court in Poinsettia Park. Funds to be deposited in the General Fund. The exact type of sign is yet to be determined. Several unique options are being considered to symbolize the sport of tennis. The sign will be paid for by the donor in addition to the $15,000 naming rights contribution. ENVIRONMENTAL IMPACT: Pursuant to Public Resources Code section 21065 and CEQA Guidelines section 15378, this action does not constitute a "project" within the meaning of CEQA and therefore, does not require an environmental review. PURPOSE; To revise and establish the criteria and procedures for the naming rights of parks, municipal facilities, and amenities within a park or municipal facilities in consideration of financial contributions or in recognition of any significant contributions to the City of Carlsbad that it wishes to honor. STATEMENT OF POLICY; There are three types of naming situations this policy intends to address: • The opening or reopening of parks, municipal facilities, and amenities within those facilities; • Providing recognition of financial contributions to the City of Carlsbad; • Honoring persons, organizations, corporations, or foundations in recognition for their significant contributions to the City of Carlsbad. Names will not be chosen that: • Cause confusion due to duplication or names sounding similar to existing locations within the City of Carlsbad; • Are the names of companies whose business is substantially derived from the sale of alcohol, tobacco, firearms, pornography, and/or sexually explicit goods or services; • Are discriminatory or derogatory considering race, gender, creed, religious or political affiliation, or other similar factors; • Recognize the birth, marriage or anniversary of specific individuals. The City of Carlsbad reserves the right to reject or revoke naming rights opportunities by individuals, groups, or organizations whose views or public statements do not promote the mission, norms and values, or interests of the City. Names of persons, organizations, corporations, or foundations will be considered when they have made a significant contribution to the City of Carlsbad by: • Enhancing the quality of life and well-being of the City and its Citizens; • Contributing to the historical or cultural preservation of the City; • Contributing toward the acquisition, development, or conveyance of land or building to the City; • Exemplary or meritorious contributions to the City; • A direct relationship or association that exists between a former place of residence of the person or group and the parks, facilities, and amenities within those facilities to be named. Where the name of an individual is recommended after an internal discussion, written consent shall be obtained from the individual, their next of kin, or their estate prior to the City Council's public consideration. CITY OF CARLSBAD Page 3 of 4 Policy No. 48 COUNCIL POLICY STATEMENT Date Issued 01/16/07 Effective Date 01/16/07 General Subject: NAMING RIGHTS OF PARKS AND MUNICIPAL FACILITIES Cancellation Date Supersedes No. Specific Subject: Naming Rights Of Parks, Municipal Facilities, And Amenities Within Those Facilities Copies to: City Council, City Manager, City Attorney, Department and Division Heads, Employee Bulletin Boards, Press, File Where the naming opportunity is the result of a financial contribution, the following factors must be considered: • The significance of the contribution made relative to the construction and operating costs of the parks, municipal facilities, and amenities within those facilities; • The cost of establishing the naming option (costs to be determined by the responsible Department on an individual basis). The duration of naming rights of parks, municipal facilities, and amenities within those facilities shall be decided or negotiated on a case-by-case basis. Naming rights of parks, municipal facilities, and amenities within those facilities may be renewed by mutual agreement between all the parties. Existing names will not be changed without consideration of the historical significance of the existing name, the impact on the individual or organization previously named, the cost and impact of changing existing signs, rebuilding community recognition and updating records (i.e. letterhead, databases, and promotional materials). Each naming right application will be considered on a case-by-case basis. PROCEDURE: Applicant(s) shall submit a written request for naming rights to the corresponding Department Director, with justification to aid in considering the proposal. The proposed name shall be placed on the Board and/or Commission agenda (if required), allowing appropriate time for review by the Board and/or Commission and subcommittee if necessary, and to publicize and receive input from the public at the Board and/or Commission meeting. The Board and/or Commission's recommendation will be forwarded to the City Council for their determination of the official name. In the case of City-sponsored support groups raising funds on behalf of the City (i.e. Friends of the Library and/or Friends of Carrillo Ranch), it will be necessary to establish naming rights gift levels prior to soliciting gifts and offering naming rights to prospective donors. The recommended gift levels will then be submitted to the corresponding Department Director for its review and then submitted to the corresponding Board and/or Commission. The Board and/or Commission's recommendation on the gift levels will then be forwarded to the City Council for its final approval prior to the support group soliciting donations for naming rights. 0
