RECOMMENDED ACTION:
Adopt Resolution No. 2008-247 authorizing a refund of business license taxes to 7-Eleven
#271090 of $592 and EMC Document Sciences Corporation of $1,018.
ITEM EXPLANATION:
Both 7-Eleven #27109C and EMC Document Sciences Corporation made a duplicate payment
for their 2008 business license taxes.
The Finance Department audited the account, verifying the duplicate payment and ensuring
compliance with all other business license policies.
Section 5.04.130 of the Carlsbad Municipal Code requires Council approval of any refund in
excess of $500. Therefore, staff is recommending approval of refunds to 7-Eleven #27109C of
$592 and EMC Document Sciences Corporation of $1,018.
FISCAL IMPACT:
The payment will result in $1,610 in refunds. There is no true fiscal impact, as the payments
were in error.
ENVIRONMENTAL IMPACT:
Pursuant to Public Resources Code Section 21065 and CEQA Guidelines Section 15378, this
does not constitute a "project" within the meaning of CEQA and, therefore, does not require an
environmental review.

WHEREAS, 7-Eleven #27109C and EMC Document Sciences Corporation made

duplicate payments for their business license taxes to the City of Carlsbad; and
7
WHEREAS, the Finance Department confirmed the duplicate payment by 7-
8
Eleven #27109C and EMC Document Sciences Corporation and verified the refund
amount.
11 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
12 Carlsbad, California, as follows:
1. That the above recitations are true and correct.

2. That a refund of business license tax of $592 to 7-Eleven #27109C and

$1,018 to EMC Document Sciences Corporation are authorized.
