RECOMMENDED ACTION:
Introduce Ordinance No.CS-006 to establish a prima facie 35 mile per hour speed limit
upon Eagle Drive from Palomar Airport Road to its intersection with Lionshead Avenue.
ITEM EXPLANATION:
Eagle Drive is a low volume, industrial street located in the Palomar Forum industrial park northerly of
Palomar Airport Road. It has one traffic lane in each direction and is constructed to city standards
with curb and gutter, sidewalks, and street lights. The road is 0.27 miles long and is not classified on
the Circulation Element of the General Plan. Eagle Drive has an industrial street curb to curb width of
52 feet with bicycle lanes provided on each side of the road. Parking is not allowed on either side of
Eagle Drive.
At their meeting on March 3, 2008, the Traffic Safety Commission considered the results of the
Engineering and Traffic Survey to establish a prima facie speed limit upon Eagle Drive. The
Commission recommended, by a 4-0 vote, that a 35 mile per hour prima facie speed limit be
established upon Eagle Drive from Palomar Airport Road to Lionshead Avenue.
The current version of the Engineering and Traffic Survey for Eagle Drive is on file in the office of the
City Traffic Engineer.
ENVIRONMENTAL IMPACT:
The installation of an official traffic control device is a project that is a Class 1 categorical exemption
(minor alteration of existing structure or facility) and is, therefore, exempt from the environmental
review process under the provisions of the California Environmental Quality Act (CEQA), Section
15301(c).
FISCAL IMPACT:
Installing two speed limit signs upon Eagle Drive will cost about $250. Sufficient funds are available in
the Public Works Street Department budget.

3 CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
4 ADDITION OF SECTION 10.44.840 TO ESTABLISH UPON
EAGLE DRIVE A PRIMA FACIE 35 MILE PER HOUR SPEED
5 LIMIT FROM PALOMAR AIRPORT ROAD TO ITS
INTERSECTION WITH LIONSHEAD AVENUE.

The City Council of the City of Carlsbad, California, hereby ordains as follows:

SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended
8 by the addition of 10.44.840 to read as follows:
9 "10.44.840 Eagle Drive. Upon Eagle Drive from Palomar
1Q Airport Road to its intersection with Lionshead Avenue, the
prima facie speed limit shall be thirty-five miles per hour."

12 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption;
13 and the City Clerk shall certify the adoption of this ordinance and cause it to be published at
14 least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days
