RECOMMENDED ACTION:
Adopt Ordinance No. CS-006 amending Title 10, Chapter 10.44 of the Carlsbad Municipal
Code by the addition of Section 10.44.840, to establish a prima facie 35 mile per hour speed
limit on Eagle Drive from Palomar Airport Road to its intersection with Lionshead Avenue.
ITEM EXPLANATION:
Ordinance No. CS-006 was introduced and first read at the City Council meeting held on
September 9, 2008. The second reading allows the City Council to adopt the ordinance,
which would then become effective in thirty days. The City Clerk will have the ordinance
published within fifteen days, if adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
4 ADDITION OF SECTION 10.44.840 TO ESTABLISH UPON
EAGLE DRIVE A PRIMA FACIE 35 MILE PER HOUR SPEED
5 LIMIT FROM PALOMAR AIRPORT ROAD TO ITS
INTERSECTION WITH LIONSHEAD AVENUE.6
The City Council of the City of Carlsbad, California, hereby ordains as follows:
SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended

by the addition of 10.44.840 to read as follows:

"10.44.840 Eagle Drive. Upon Eagle Drive from Palomar
10 Airport Road to its intersection with Lionshead Avenue, the
prima facie speed limit shall be thirty-five miles per hour."

12 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption;
13 and the City Clerk shall certify the adoption of this ordinance and cause it to be published at
14 least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days

INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on
the 9th day of September, 2008, and thereafter.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
City of Carlsbad on the 16th day of September, 2008, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Nygaard.
NOES: None.
ABSENT: None.
