ESTABLISH A PRIMA FACIE SPEED LIMIT

RECOMMENDED ACTION:
Adopt Ordinance No. CS-007 amending Title 10, Chapter 10.44 of the Carlsbad Municipal
Code by the amendment of Section 10.44.320, to establish a prima facie 45 mile per hour
speed limit on Faraday Avenue from Orion Street to the east City limit.
ITEM EXPLANATION:
Ordinance No. CS-007 was introduced and first read at the City Council meeting held on
September 16, 2008. The second reading allows the City Council to adopt the ordinance,
which would then become effective in thirty days. The City Clerk will have the ordinance
published within fifteen days, if adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
4 AMENDMENT OF SECTION 10.44.320 TO ESTABLISH A PRIMA
FACIE 45 MILE PER HOUR SPEED LIMIT UPON FARADAY
5 AVENUE FROM ORION STREET TO THE EAST CITY LIMIT.
6 The City Council of the City of Carlsbad, California, hereby ordains as follows:
7 SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended
by the revision of 10.44.320 to read as follows:
"10.44.320 Faraday Avenue:
a. Upon Faraday Avenue from College Boulevard to its
intersection with Orion Street, the prima facie speed limit shall
1 1 be forty miles per hour.
b. Upon Faraday Avenue from College Boulevard to
12 Cannon Road, the prima facie speed limit shall be forty miles
per hour.
13 c. Upon Faraday Avenue from Orion Street to the east
city limit, the prima facie speed limit shall be forty-five miles per
14 hour."

EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption;

and the City Clerk shall certify the adoption of this ordinance and cause it to be published at
17
least once in a newspaper of general circulation in the City of Carlsbad within fifteen (15) days
18
after its adoption.

INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on
the !6m day of September. 2008, and thereafter.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
City of Carlsbad on the 23- day of September. 2008, by the following vote to wit:
AYES: Council Members Lewis, Kulchin, Hall, Packard and Nygaard.
NOES: None.
ABSENT: None.
ABSTAIN: None.
