CONSTRUCTION OF THE CYNTHIA LANE STORM
DRAIN IMPROVEMENTS, PROJECT NO. 6601

RECOMMENDED ACTION:
Adopt Resolution No. 2008-298 accepting the contract for construction of the Cynthia Lane
Storm Drain Improvements, Project No. 6601, as complete, and directing the City Clerk to record a
Notice of Completion and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On February 5, 2008, the City of Carlsbad awarded a contract to Southwest Civil Contracting, Inc. in
the amount of $93,649 for the construction of the Cynthia Lane Storm Drain Improvements, Project
No. 6601.
Southwest Civil Contracting, Inc. completed the contract work that was substantially completed on
June 27, 2008. The contractor completed the punch list work on October 1, 2008. City staff has
inspected the work and found it to be satisfactory. Staff recommends acceptance of the improvements
by the City Council.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONTRACT FOR
CONSTRUCTION OF THE CYNTHIA LANE STORM DRAIN
4 IMPROVEMENTS. PROJECT NO. 6601.
5 WHEREAS, the construction of the Cynthia Lane Storm Drain Improvements was
substantially completed on June 27, 2008, and punch list work was completed to the City's
7 satisfaction by Southwest Civil Contracting, Inc. on October 1, 2008; and
8 WHEREAS, the formal project Notice of Completion has been prepared; and
9 WHEREAS, all project costs have been established to date.
10 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
â˘10 1. That the above recitations are true and correct.
13 2. That the Cynthia Lane Storm Drain Improvements, specifically identified as
14 Project No. 6601, is deemed complete and is hereby accepted by the City Council of the City of
15 Carlsbad.

3. The City Clerk of the City of Carlsbad is hereby authorized and directed to
17
execute and record the Notice of Completion and to release bonds in accordance with State Law
18
and City Ordinances for the Cynthia Lane Storm Drain Improvements, Project No. 6601.
