C^{§^ CITY MGR. \jS-~~ RECOMMENDED ACTION: Adopt Resolution No. 2008-315 accepting bids and awarding a contract for the construction of the FY 08/09 Concrete Replacement, Project No. 6013. ITEM EXPLANATION: The project is designed to replace curb, gutter, sidewalk, and pedestrian ramps in northeast Carlsbad as part of the City's ongoing Concrete Replacement Program. The concrete replacement will occur at 215 specific locations where there is deterioration, cracking, and/or uplifting of the concrete. On September 23, 2008, City Council authorized the advertisement for bids for construction of the FY 08/09 Concrete Replacement, Project No. 6013. The engineer's estimate was $266,000. Victor Concrete is aware that the contract requires prevailing wages per sections 1770, 1773, and 1773.1 of the Labor Code. Staff has completed its review of the contract documents and has determined that they are in order. Therefore, staff recommends that Victor Concrete be awarded the contract. ENVIRONMENTAL IMPACT: This project is categorically exempt from the environmental review process under CEQA Guidelines Section 15301 Class 1(c) Existing Facilities, of the Public Resources Code (California Environmental Quality Act). FISCAL IMPACT: As shown in the table below, the total estimated cost for the Fiscal Year 2008/09 Concrete Replacement Project (Project No. 6013) is $179,503. Funds remaining at the conclusion of this fiscal year's Concrete Replacement Project will be used for future concrete replacement projects on an annual basis. PROJECT NO. 6013. WHEREAS, the City Council of the City of Carlsbad, California, has determined it to CEQA Section 15301 Class 1(c); and WHEREAS, on September 23, 2008, the City Council approved contract documents and and WHEREAS, the lowest responsive, responsible bid for the project was submitted by 14 Victor Concrete in the amount of $149,503; and WHEREAS, there are sufficient funds available in the Concrete Replacement account 15 (6013) for construction of the project. 16 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad, California, as follows: 1. That the above recitations are true and correct. 2. That the bid submitted by Victor Concrete in the amount of $149,503 is hereby I w accepted and the Mayor is hereby authorized to execute the contract for the construction of the 20 FY 08/09 Concrete Replacement, Project No. 6013, in accordance with the specifications and 21 contract documents referred to herein. 22 3. That the City Manager is hereby authorized to approve construction change orders up to the contingency amount of $15,000 to Victor Concrete for the FY 08/09 Concrete Replacement, Project No. 6013. 24 4. That the award of this contract is contingent upon Victor Concrete executing the 25 "required contract and submitting the required bonds and insurance policies, as described in the contract, within twenty (20) calendar days of adoption of this resolution.
