(M-^ RECOMMENDED ACTION: Introduce and adopt Urgency Ordinance No. Section 1.20.610(E), adopting an ordinance CS-018 pursuant to Carlsbad Municipal Code entitled "Weight Limit - Encinas Creek Bridge, Southbound Carlsbad Boulevard." and adopt Resolution No. 2008-318 authorizing the Public Works Director to formally notify CALTRANS of the city's request to extend the posting of the weight limit. ITEM EXPLANATION: The State of California Department of Transportation ("CALTRANS") routinely provides the city with semi-annual inspection reports assessing the condition of all bridges carrying public vehicular traffic within the City limits including the Encinas Creek Bridge located on southbound Carlsbad between Palomar Airport Road and Poinsettia Lane. The most recent inspection report recommends establishing a reduced weight limit across the bridge as an interim safety measure prior to replacement of the bridge structure. Under California Vehicle Code ("CVC") Section 35751, CALTRANS must make the determination to lower the maximum weight of the vehicles permitted to cross the bridge, however, CALTRANS may not proceed unless it first receives a request to do so from the city council. Staff recommends that the Public Works Director be authorized to formally notify CALTRANS of the city's request to have CALTRANS make this determination. CVC Section 35754 does authorize a local authority to temporarily lower the maximum weight limits of a bridge under certain circumstances. It states in part: 'Whenever, in the opinion of a local authority, a bridge under its jurisdiction is in a dangerous or weak condition, it may temporarily erect suitable signs at all entrances to such bridge specifying the maximum weight which it believes the bridge with safety to itself will sustain. The maximum weight limit so fixed and posted shall remain in effect for not more than 90 days." The posting will include appropriate advance signage on southbound Carlsbad Boulevard, westbound Palomar Airport Road, and surrounding streets potentially carrying larger commercial vehicles. The city council recently adopted ordinance CS-009, which added Section 1.20.610 to the Carlsbad Municipal Code. This section authorizes the city council to adopt an urgency ordinance by a majority vote and to make it effective immediately when a delay would adversely affect public health, safety and welfare. Staff recommends that the city council adopt the urgency ordinance. Upon receipt of the city's formal request to extend the weight limit posting beyond the 90 days, CALTRANS will conduct its own noticed public hearing and based upon the results of the hearing may extend the posting until such time as the bridge structure is replaced by the city. ENVIRONMENTAL IMPACT: Actions in compliance with the California Vehicle Code are exempt from environmental review. FISCAL IMPACT: Cost of the required signage and installation by City staff is estimated to be approximately $2,500. Funds exist with the current Public Works Department operating budget for this work. EXHIBITS: 1. Location map. 2. Upon the advice of the California 9 Department of Transportation (CALTRANS), it has determined that a vehicular weight limit shall be placed on the Encinas Creek Bridge, located on Southbound Carlsbad Boulevard between Palomar Airport Road and Poinsettia Lane as follows and as shown in Exhibit "A": 13 Type 3 1 8 tons Type3S2 28 tons Type 3-3 34 tons 14 This section is to be in effect for ninety (90) days from its adoption and provided CALTRANS finds that the weight limits should be 15 continued, this section shall remain in effect until the Encinas Creek Bridge is repaired and shall be automatically repealed and of no further force and effect upon the filing of a notice of completion of the repair."
