ESTABLISH A PRIMA FACIE SPEED LIMIT UPON

RECOMMENDED ACTION:
Introduce Ordinance No.CS-019 to establish a prima facie 35 mile per hour speed limit upon
Corte de la Vista from the Alicante Road/El Fuerte Street intersection to its terminus.
ITEM EXPLANATION:
Corte de la Vista is a local road that intersects the Alicante Road/El Fuerte Street intersection in a "T"
intersection configuration. The road has one traffic lane in each direction and a curb to curb width of 40 feet.
Concrete curb, gutter and sidewalk has been constructed on both sides of Corte de la Vista. Street lights are
located only on the north side of the road. Metal guardrail has been installed on the south side of the road
and on-street parking is allowed on both sides of Corte de la Vista. The road is 0.40 miles in length with five
streets intersecting Corte de la Vista. The road follows a generally straight alignment with no centerline
striping installed. Corte de la Vista has low traffic volumes, with 1,057 vehicles per day measured from a two-
way traffic count in September 2008. At their meeting on October 6, 2008, the Traffic Safety Commission
considered the results of the Engineering and Traffic Survey to establish a prima facie speed limit upon Corte
de la Vista. The Commission recommended, by a 3-0 vote, that a 35 mile per hour prima facie speed limit be
established upon Corte de la Vista from the Alicante Road/El Fuerte Street intersection to its terminus.
The current version of the Engineering and Traffic Survey for Corte de la Vista is on file in the office of the
City Traffic Engineer.
ENVIRONMENTAL IMPACT:
The installation of an official traffic control device is a project that is a Class 1 categorical exemption (minor
alteration of existing structure or facility) and is, therefore, exempt from the environmental review process
under the provisions of the California Environmental Quality Act (CEQA), Section 15301 (c).
FISCAL IMPACT:
Installing two speed limit signs upon Corte de la Vista will cost about $250. Sufficient funds are available in
the Public Works Street Department budget.

3 CARLSBAD, CALIFORNIA, AMENDING TITLE 10, CHAPTER
10.44, OF THE CARLSBAD MUNICIPAL CODE BY THE
4 ADDITION OF SECTION 10.44.870 TO ESTABLISH UPON
CORTE DE LA VISTA A PRIMA FACIE 35 MILE PER HOUR
5 SPEED LIMIT FROM THE ALICANTE ROAD/EL FUERTE
STREET INTERSECTION TO ITS TERMINUS.

The City Council of the City of Carlsbad, California, hereby ordains as follows:

SECTION 1: That Title 10, Chapter 10.44 of the Carlsbad Municipal Code is amended
8
by the addition of Section 10.44.870 to read as follows:
9 "10.44.870 Corte de la Vista. Upon Corte de la Vista from the Alicante
IQ Road/El Fuerte Street intersection to its terminus, the prima facie speed
limit shall be thirty-five miles per hour."

12 EFFECTIVE DATE: This ordinance shall be effective thirty (30) days after its adoption; and
13 the City Clerk shall certify the adoption of this ordinance and cause it to be published at least once in
14 a newspaper of general circulation in the City of Carlsbad within fifteen (15) days after its adoption.
