RECOMMENDED ACTION:
Adopt Ordinance No. CS-016 amending Section 21.050.030 of the Carlsbad Municipal Code,
by an Amendment to the Zoning Map to grant a Zone Change from R-1-15,000 to R-1 -15,000
and Open Space on the south side of Adams Street along the north shore of the Agua
Hedionda Lagoon between Highland Drive and Park Drive within the Agua Hedionda
Segment of the Local Coastal Program and Local Facilities Management Zone 1, ZC 06-07.
ITEM EXPLANATION:
Ordinance No. CS-016 was introduced and first read at the City Council meeting held on
November 18, 2008. The second reading allows the City Council to adopt the ordinance.
Ordinance No. CS-016 will become effective no sooner than thirty days after adoption but not
until Local Coastal Program Amendment LCPA 06-08 is approved by the California Coastal
Commission. The City Clerk will have the ordinance published within fifteen days, if adopted.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
2 CARLSBAD, CALIFORNIA, AMENDING SECTION 21.05.030 OF
THE CARLSBAD MUNICIPAL CODE BY AN AMENDMENT TO
3 THE ZONING MAP TO GRANT A ZONE CHANGE, ZC 06-07,
FROM R-1-15,000 TO R-1-15,000 AND OS ON PROPERTY
4 GENERALLY LOCATED ON THE SOUTH SIDE OF ADAMS
STREET ALONG THE NORTH SHORE OF THE AGUA
5 HEDIONDA LAGOON BETWEEN HIGHLAND DRIVE AND PARK
DRIVE WITHIN THE AGUA HEDIONDA SEGMENT OF THE

WHEREAS, the City Council did on the 18-_ day of November, hold a duly
9
noticed public hearing as prescribed by law to consider said request; and
10
WHEREAS, said application constitutes a request for a Zone Change as shown
on Exhibit "ZC 06-07" dated October 1, 2008, attached hereto and made a part hereof; and

WHEREAS at said public hearing, upon hearing and considering all testimony

and arguments, if any, of all persons desiring to be heard, said City Council considered all14
factors relating to the ZC 06-07 - Adam Street Subdivision.
NOW, THEREFORE, the City Council of the City of Carlsbad does ordain as
16 follows:
17 SECTION I: That Section 21.050.30 of the Carlsbad Municipal Code, being the
1 O0 zoning map, is amended as shown on the map marked Exhibit "ZC 06-07," dated October 1,
in 2008, attached hereto and made a part hereof.
20 SECTION II: That the findings and conditions of the Planning Commission as set
21 forth in Planning Commission Resolution No. 6476 shall also constitute the findings and
22 conditions of the City Council.
23 EFFECTIVE DATE: This ordinance shall be effective no sooner than thirty days
24 after its adoption but not until Local Coastal Program Amendment LCPA 06-08 is approved by
25 the California Coastal Commission, and the City Clerk shall certify to the adoption of this
ordinance and cause it to be published at least once in a publication of general circulation in the
27 City of Carlsbad within fifteen days after its adoption.

INTRODUCED AND FIRST READ at a regular meeting of the Carlsbad City Council on
the 18th day of November, 2008, and thereafter.
PASSED, APPROVED AND ADOPTED at a Regular Meeting of the City Council of the
City of Carlsbad on the 2nd day of December, 2008, by the following vote to wit:
AYES: Council Members Lewis, Hall, Packard and Nygaard.
NOES: None.
ABSENT: Council Member Kulchin.
ABSTAIN: None.
