RECOMMENDED ACTION:
Adopt Resolution No. 2008-334 approving the final map for CT 05-13, La Costa Ridge,
Neighborhood 2.6 and authorizing the City Clerk to process the map for recordation.
Adopt Resolution No. 2008-335 summarily vacating approximately 0.705 acres of public street
right-of-way located west of Rancho Santa Fe Road, south of Melrose Drive, and south and east of
Corintia Street.
ITEM EXPLANATION:
Engineering staff has completed checking the final map of CT 05-13, known as La Costa Ridge,
Neighborhood 2.6. This subdivision is within Local Facilities Management Plan (LFMP) Zone 11 and is
generally located west of Rancho Santa Fe Road, south of Melrose Drive, and south and east of
Corintia Street. The project proposes a total of 10 lots for the development of 53 detached
condominium units. The lots are comprised of 5 residential lots, 1 private street lot, and 4 open space
lots.
The final map conforms substantially with the tentative map as recommended for approval by the
Planning Commission per PC Resolution No. 6143, approved August 2, 2006, and as approved by
City Council on September 19, 2006 per CC Resolution No. 2006-280. The final map also conforms to
the General Plan, all the applicable requirements of the Municipal Code, City Standards, and Growth
Management Plan. The property owner, Western Pacific Housing Inc., a Delaware corporation, is
requesting the recordation of said final map.
Condition No. 48 of PC Resolution No. 6143 requires that the developer process a street vacation for
a portion of Melrose Drive as identified on the tentative tract map. The location of the vacation is also
shown on the attached Exhibit 1. The portion of right of way to be vacated is a remnant from the
relocated street and right-of-way completed in 2005. The area to be vacated is identified on the final
map. Per Section 8330 of the California Streets and Highways Code, the legislative body of a local
agency may summarily vacate a street or highway that has been superseded by relocation. Surface
improvements no longer exist within the public right-of-way but several active underground utilities still
exist. A public utility easement will be reserved as requested by several utility companies.
Staff has concluded that the excess right-of-way is not required for present or future street purposes
as the ultimate alignment of Melrose Drive intersecting with Rancho Santa Fe Drive has been
established. The vacation would not affect vehicular or non-motorized traffic circulation or the
availability of street parking.

ENVIRONMENTAL IMPACT:
The approval of a final subdivision map is a ministerial project and is exempt from the requirements of
CEQA pursuant to Section 15268 of the State CEQA Guidelines. The street vacation, included as part
of Carlsbad Tract 05-13, remains within the scope of prior environmental documents including the
previously certified Rancho Santa Fe Road Realignment and Mass Grading Project (EIR 91-01 and
Addendum) and the Villages of La Costa Master Plan (MP 98-01/EIR 98-07), which identified this
vacation to be a part of project buildout.
FISCAL IMPACT:
The property owner paid a plan check fee to cover the expense of plan checking and processing the
final map and street vacation for recording. All other processing and development impact fees
required to be paid prior to final map approval have been paid. Additional processing and
development impact fees will be paid, as appropriate, if and when building permits are issued for this
project. The right-of-way was granted to the City for a no fee cost acquisition and the City will vacate
the right-of-way for a no fee cost return to the property owner. Approval of the street vacation will
result in 0.705 acres of land to be returned to the tax rolls.

CARLSBAD, CALIFORNIA, APPROVING THE FINAL MAP FOR
WHEREAS, Western Pacific Housing Inc., a Delaware Corporation, has submitted a final
map known as CT 05-13, La Costa Ridge Neighborhood 2.6, to the City of Carlsbad for approval;
and
WHEREAS, the tentative map of CT 05-13 with conditions, was recommended for
approval by the Planning Commission on August 2, 2006 per PC Resolution No. 6143; and
WHEREAS, the City Council considered said recommendations and approved CT 05-13
with conditions on September 19, 2006 per CC Resolution No. 2006-280; and
WHEREAS, the City Engineer has determined that said map substantially conforms to
said conditionally approved tentative map; and
WHEREAS, the conditions of approval for said final map have been completed or

secured; and14
WHEREAS, the property owner has offered public easements for dedication to the City
15 of Carlsbad; and
WHEREAS, the final map conforms to the City of Carlsbad General Plan and all
17 requirements of City Codes and Standards.
18 I NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
California, as follows:
1. That the above recitations are true and correct.
2. That said final map known as CT 05-13, La Costa Ridge Neighborhood 2.6

which is on file with the City Engineer and is incorporated herein by reference, is accepted.
22 I 3. That the City accepts the dedications shown on the final map.
23 4. That the City Clerk is authorized to sign the Certificate of Acceptance on the
24 final map.
25 5. That the City Clerk is authorized to cause the original final map to be recorded in
the Office of the County Recorder of San Diego County, State of California.
6. That the City Clerk is authorized to release the final map to Chicago Title

Company for recording in the Office of the County Recorder.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CARLSBAD, CALIFORNIA, SUMMARILY VACATING
APPROXIMATELY 0.705 ACRES OF PUBLIC STREET RIGHT-OF-
WAY LOCATED WEST OF RANCHO SANTA FE ROAD, SOUTH OF
MELROSE DRIVE, AND SOUTH AND EAST OF CORINTIA
STREET. STV 07-02.
WHEREAS, a request has been made to vacate a portion of public street right-of-way
located west of Rancho Santa Fe Road, south of Melrose Drive, and south and east of Corintia
Street; and
WHEREAS, the centerline of Melrose Drive was realigned to a position northerly of the
11 original road alignment; and
12 WHEREAS, the realignment created a surplus area of right-of-way in excess of that
13 required for current or future needs; and
14 WHEREAS, the City Engineer has determined that the excess right-of-way is not
15 required for present or future street purposes; and
WHEREAS, the excess right-of-way provides no public street purposes and would not
be useful as a non-motorized transportation facility; and
1ft WHEREAS, the proposed vacation is consistent with the General Plan of the City; and
19 WHEREAS, the vacation of this excess right-of-way will result in approximately 0.705
20 acres of land being returned to the tax rolls; and
21 WHEREAS, the City Engineer has determined that the portion of Melrose Drive to be
22 vacated will be reserved as an easement for general utility and access purposes as shown on
23 the final map known as CT 05-13, La Costa Ridge Neighborhood 2.6, on file with the City
24 Engineer.
25 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
26 California, as follows:
27 1. That the above recitations are true and correct.

1 2. That pursuant to Division 9, Part 3, Chapter 4 of the California Streets and
2 Highway Code, said portion of Melrose Drive, an Easement for County Highway, more
3 particularly described in the attached Exhibit "A", as shown on the final map for Carlsbad Tract
4 CT 05-13, be summarily vacated.
5 3. That the general utility and access easement over said Easement for County
6 Highway be reserved and excepted from said vacation as described in the attached Exhibit "A",
7 as shown on the final map for Carlsbad Tract CT 05-13.
8 4. The City Clerk is directed to record this resolution in the Office of the County
9 Recorder of San Diego County.
10 5. From the date the resolution is recorded in the County Recorder's office, the area
11 vacated no longer constitutes a public street.
