RECOMMENDED ACTION:
Adopt Resolution No. 2008-338 _ accepting the construction of CT 97-13, Carlsbad Oaks
North - El Fuerte, as complete, directing the City Manager to execute the Acceptance of Public
Improvements and directing the City Clerk to record a Notice of Completion on CT 97-13, Carlsbad
Oaks North - El Fuerte, Drawing No. 415-9E, Agreement No. SEC05004.
ITEM EXPLANATION:
The Carlsbad City Council adopted the Circulation Element of the General Plan as a way to ensure a
comprehensive manner and method for the circulation of people, goods, energy, water, sewage, storm
waters, communications and services. On February 27, 2001, City of Carlsbad Council Policy
Statement No. 63 was issued to establish a policy on the acceptance or conditional acceptance of
Circulation Element roadways or portions of such roadways into the City street system. This policy
states that City Council shall consider the policies of the General Plan, the standards of the Growth
Management Plan, the safety and needs of the traveling public, which in the opinion of the City
Council are necessary and appropriate for the orderly, safe and efficient development of the
circulation system. Policy No. 63 requires formal City Council acceptance of these Circulation
Element roadways into the City's street system. El Fuerte Street meets the criteria of a Circulation
Element roadway.
On September 29, 2008, Techbilt Construction Corporation completed the work on Carlsbad Oaks
North - El Fuerte as listed in Improvement Agreement Number SEC05004, Drawing No. 415-9E. El
Fuerte was constructed from Faraday Avenue to Loker Avenue. The improvements being accepted do
not include the El Fuerte Lift Station. City staff inspected the work and found it to be satisfactory.
Pursuant to CMC Chapter 11.04 Section 11.04.050 (C) this acceptance does not relieve the developer
from liability for any and all defects found after the acceptance of improvements, in accordance with
the improvement agreements or any other similar agreements.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

FISCAL IMPACT:
Acceptance of the road obligates the City to perform the on-going maintenance of the road, which
includes approximately 2.2 lane miles. For an average street, street maintenance (which includes
items such as street sweeping and filling pot holes) costs approximately $6,400 per lane mile per
year. Pavement management (which includes pavement overlay and slurry seals) for an average
street is budgeted at approximately $4,200 per lane mile every year.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
3 CARLSBAD, CALIFORNIA, ACCEPTING THE CONSTRUCTION
OF CARLSBAD OAKS NORTH - EL FUERTE,
4 PROJECT NO. CT 97-13 AS COMPLETE.
5 WHEREAS, the construction of Carlsbad Oaks North - El Fuerte, as shown on
6 Drawing No. 415-9E has been completed to the City's satisfaction by Techbilt Construction
7 Corporation on September 29, 2008; and
8 WHEREAS, the formal project Notices of Completion and the Acceptances of Public
9 Improvements have been prepared; and
10 WHEREAS, El Fuerte Street has been deemed as a circulation element roadway as
11 defined in City of Carlsbad Council Policy Statement No. 63.
12 NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,
13 California, as follows:
14 1. That the above recitations are true and correct.
15 2. That Carlsbad Oaks North - El Fuerte, specifically identified as
16 Project No. CT 97-13 and Drawing No. 415-9E, is deemed complete and is hereby accepted by
17 the City Council of the City of Carlsbad.

3. That the City Manager is authorized and directed to execute the Acceptance of

Public Improvements for Carlsbad Oaks North - El Fuerte, Project No. CT 97-13,

COMPLETION OF PUBLIC IMPROVEMENTS
The developer has constructed the improvements required for Project No. CT 97-13, Carlsbad
Oaks North - El Fuerte, Agreement Number SEC05004, Drawing Number 415-9E and has
requested that the City of Carlsbad accept the public improvements. City forces have inspected
the public improvements and found them to be satisfactory. The public improvements consist
