RECOMMENDED ACTION:
Adopt Resolution No. 2009-023 accepting the work in accordance with Contract No.
PWS06-29STS, Citywide Asphalt Repairs as complete, and direct the City Clerk to have the Notice of
Completion recorded and release bonds in accordance with State Law and City Ordinances.
ITEM EXPLANATION:
On June 6th, 2006, the City Council adopted Resolution No. 2006-135, awarding Contract No.
PWS06-29STS, to Hardy & Harper, Inc., for $232,000.00 and authorized $58,000.00 in contingency
funds to perform Citywide Asphalt Repairs.
The construction phase of the project was completed on time and all outstanding items have been
received. The new asphalt has been inspected by staff and is acceptable to the Public Works
Manager, General Services.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

CARLSBAD, CALIFORNIA, ACCEPTING THE WORK AS
COMPLETE AND DIRECTING THE RECORDATION OF THE
NOTICE OF COMPLETION FOR CITYWIDE ASPHALT REPAIRS,

WHEREAS, the City Council adopted Resolution No. 2006-135 approving contract
6
documents, special provisions and specifications, and authorized the City Clerk to advertise for
7
bids to perform Contract No. PWS06-29STS, Citywide Asphalt Repairs, hereinafter referred to as
8
the "Project"; and
9
WHEREAS, the City Council has previously awarded a contract for the Project; and
10
WHEREAS, the Project work has been satisfactorily completed; and
11
WHEREAS, a Notice of Completion has been prepared for the Project; and
12
WHEREAS, the City Council hereby finds it necessary, desirable, and in the public interest
13
to accept the completed work to perform Contract No. PWS06-29STS, Citywide Asphalt Repairs.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

California, as follows:

1. That the above recitations are true and correct.

2. That the completed work is hereby accepted and the City Clerk is directed to record

the Notice of Completion and to release bonds in accordance with State Law and City Ordinances.
