RECOMMENDED ACTION:
Adopt Resolution No. 2009-024 _ accepting the work in accordance with Contract No. UPS - 2,
Installation of 36 Traffic Signal Battery Backup Systems as complete, and direct the City Clerk to have
the Notice of Completion recorded and release bonds in accordance with State Law and
City Ordinances.
ITEM EXPLANATION:
On August 16th, 2005, the City Council adopted Resolution No. 2005-256, awarding Contract No.
UPS - 2, to Econplite Traffic Engineering and Maintenance, Inc., for $213,120.00 and authorized
$10,650.00 in contingency funds to perform Installation of 36 Traffic Signal Battery Backup Systems.
There were extensive delays during the construction phase of the project and the completion was
delayed by several months. These delays were primarily caused by the failure of the contractor to
provide work and materials that met the project specifications and the contractor's failure to complete
outstanding punch list items. The construction phase of the project was completed and all outstanding
items have been received. The battery backup systems have been inspected by staff and are
acceptable to the Public Works Manager, General Services.
ENVIRONMENTAL IMPACT:
The approval of a Notice of Completion is a ministerial process and is exempt from the requirements
of CEQA pursuant to Section 15268 of the State CEQA Guidelines.

COMPLETE AND DIRECTING THE RECORDATION OF THE
4 NOTICE OF COMPLETION FOR INSTALLATION OF 36 TRAFFIC
SIGNAL BATTERY BACKUP SYSTEMS. PROJECT NO. UPS - 2.

WHEREAS, the City Council adopted Resolution No. 2005-256 approving contract
6
documents, special provisions and specifications, and authorized the City Clerk to advertise for
7
bids to perform Contract No. UPS - 2, Installation of 36 Traffic Signal Battery Backup Systems,
8
hereinafter referred to as the "Project"; and
9
WHEREAS, the City Council has previously awarded a contract for the Project; and
10
WHEREAS, the Project work has been satisfactorily completed; and
11
WHEREAS, a Notice of Completion has been prepared for the Project; and
12
WHEREAS, the City Council hereby finds it necessary, desirable, and in the public interest
13
to accept the completed work to perform Contract No. UPS - 2, Installation of 36 Traffic Signal
14
Battery Backup Systems.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Carlsbad,

California, as follows:

1. That the above recitations are true and correct.

2. That the completed work is hereby accepted and the City Clerk is directed to record

the Notice of Completion and to release bonds in accordance with State Law and City Ordinances.
